הַקְהֵ֣ל אֶת־הָעָ֗ם הָֽאֲנָשִׁ֤ים וְהַנָּשִׁים֙ וְהַטַּ֔ף וְגֵרְךָ֖ אֲשֶׁ֣ר בִּשְׁעָרֶ֑יךָ לְמַ֨עַן יִשְׁמְע֜וּ וּלְמַ֣עַן יִלְמְד֗וּ וְיָֽרְאוּ֙ אֶת־יְהֹוָ֣ה אֱלֹהֵיכֶ֔ם וְשָׁמְר֣וּ לַעֲשׂ֔וֹת אֶת־כׇּל־דִּבְרֵ֖י הַתּוֹרָ֥ה הַזֹּֽאת׃

Gather the people—men, women, children, and the strangers in your communities—that they may hear and so learn to revere the ETERNAL your God and to observe faithfully every word of this Teaching.

וּבָאתָ֗ אֶל־הַכֹּהֲנִים֙ הַלְוִיִּ֔ם וְאֶ֨ל־הַשֹּׁפֵ֔ט אֲשֶׁ֥ר יִהְיֶ֖ה בַּיָּמִ֣ים הָהֵ֑ם וְדָרַשְׁתָּ֙ וְהִגִּ֣ידוּ לְךָ֔ אֵ֖ת דְּבַ֥ר הַמִּשְׁפָּֽט׃ וְעָשִׂ֗יתָ עַל־פִּ֤י הַדָּבָר֙ אֲשֶׁ֣ר יַגִּ֣ידֽוּ לְךָ֔ מִן־הַמָּק֣וֹם הַה֔וּא אֲשֶׁ֖ר יִבְחַ֣ר יְהֹוָ֑ה וְשָׁמַרְתָּ֣ לַעֲשׂ֔וֹת כְּכֹ֖ל אֲשֶׁ֥ר יוֹרֽוּךָ׃ עַל־פִּ֨י הַתּוֹרָ֜ה אֲשֶׁ֣ר יוֹר֗וּךָ וְעַל־הַמִּשְׁפָּ֛ט אֲשֶׁר־יֹאמְר֥וּ לְךָ֖ תַּעֲשֶׂ֑ה לֹ֣א תָס֗וּר מִן־הַדָּבָ֛ר אֲשֶׁר־יַגִּ֥ידֽוּ לְךָ֖ יָמִ֥ין וּשְׂמֹֽאל׃

and appear before the levitical priests, or the magistrate in charge at the time, and present your problem. When they have announced to you the verdict in the case, you shall carry out the verdict that is announced to you from that place that GOD chose, observing scrupulously all their instructions to you. You shall act in accordance with the instructions given you and the ruling handed down to you; you must not deviate from the verdict that they announce to you either to the right or to the left.

וְתַנְיָא: כׇּל עִיר שֶׁאֵין בָּהּ עֲשָׂרָה דְּבָרִים הַלָּלוּ אֵין תַּלְמִיד חָכָם רַשַּׁאי לָדוּר בְּתוֹכָהּ: בֵּית דִּין מַכִּין וְעוֹנְשִׁין, וְקוּפָּה שֶׁל צְדָקָה נִגְבֵּית בִּשְׁנַיִם וּמִתְחַלֶּקֶת בִּשְׁלֹשָׁה, וּבֵית הַכְּנֶסֶת, וּבֵית הַמֶּרְחָץ, וּבֵית הַכִּסֵּא, רוֹפֵא, וְאוּמָּן, וְלַבְלָר, וְטַבָּח, וּמְלַמֵּד תִּינוֹקוֹת. מִשּׁוּם רַבִּי עֲקִיבָא אָמְרוּ: אַף מִינֵי פֵירָא, מִפְּנֵי שֶׁמִּינֵי פֵירָא מְאִירִין אֶת הָעֵינַיִם.

And it is taught in a baraita: A Torah scholar is not permitted to reside in any city that does not have these ten things: A court that has the authority to flog and punish transgressors; and a charity fund for which monies are collected by two people and distributed by three, as required by halakha. This leads to a requirement for another three people in the city. And a synagogue; and a bathhouse; and a public bathroom; a doctor; and a bloodletter; and a scribe [velavlar] to write sacred scrolls and necessary documents; and a ritual slaughterer; and a teacher of young children. With these additional requirements there are a minimum of 120 men who must be residents of the city. They said in the name of Rabbi Akiva: The city must also have varieties of fruit, because varieties of fruit illuminate the eyes.

הוּא הָיָה אוֹמֵר, אֵין בּוּר יְרֵא חֵטְא, וְלֹא עַם הָאָרֶץ חָסִיד, וְלֹא הַבַּיְשָׁן לָמֵד, וְלֹא הַקַּפְּדָן מְלַמֵּד, וְלֹא כָל הַמַּרְבֶּה בִסְחוֹרָה מַחְכִּים. וּבְמָקוֹם שֶׁאֵין אֲנָשִׁים, הִשְׁתַּדֵּל לִהְיוֹת אִישׁ:

He used to say: A brute is not sin-fearing, nor is an ignorant person pious; nor can a timid person learn, nor can an impatient person teach; nor will someone who engages too much in business become wise. In a place where there are no men, strive to be a man.

אָמַר רַבִּי יִצְחָק: אֵין מַעֲמִידִין פַּרְנָס עַל הַצִּבּוּר אֶלָּא אִם כֵּן נִמְלָכִים בַּצִּבּוּר, שֶׁנֶּאֱמַר: ״רְאוּ קָרָא ה׳ בְּשֵׁם בְּצַלְאֵל״, אָמַר לוֹ הַקָּדוֹשׁ בָּרוּךְ הוּא לְמֹשֶׁה: מֹשֶׁה, הָגוּן עָלֶיךָ בְּצַלְאֵל? אָמַר לוֹ: רִבּוֹנוֹ שֶׁל עוֹלָם, אִם לְפָנֶיךָ הָגוּן — לְפָנַי לֹא כׇּל שֶׁכֵּן! אָמַר לוֹ: אַף עַל פִּי כֵן, לֵךְ אֱמוֹר לָהֶם. הָלַךְ וְאָמַר לָהֶם לְיִשְׂרָאֵל: הָגוּן עֲלֵיכֶם בְּצַלְאֵל? אָמְרוּ לוֹ: אִם לִפְנֵי הַקָּדוֹשׁ בָּרוּךְ הוּא וּלְפָנֶיךָ הוּא הָגוּן, לְפָנֵינוּ לֹא כׇּל שֶׁכֵּן!

With regard to Bezalel’s appointment, Rabbi Yitzḥak said: One may only appoint a leader over a community if he consults with the community and they agree to the appointment, as it is stated: “And Moses said unto the children of Israel: See, the Lord has called by name Bezalel, son of Uri, son of Hur, of the tribe of Judah” (Exodus 35:30). The Lord said to Moses: Moses, is Bezalel a suitable appointment in your eyes? Moses said to Him: Master of the universe, if he is a suitable appointment in Your eyes, then all the more so in my eyes. The Holy One, Blessed be He, said to him: Nevertheless, go and tell Israel and ask their opinion. Moses went and said to Israel: Is Bezalel suitable in your eyes? They said to him: If he is suitable in the eyes of the Holy One, Blessed be He, and in your eyes, all the more so he is suitable in our eyes.

יְהוֹשֻׁעַ בֶּן פְּרַחְיָה וְנִתַּאי הָאַרְבֵּלִי קִבְּלוּ מֵהֶם. יְהוֹשֻׁעַ בֶּן פְּרַחְיָה אוֹמֵר, עֲשֵׂה לְךָ רַב, וּקְנֵה לְךָ חָבֵר, וֶהֱוֵי דָן אֶת כָּל הָאָדָם לְכַף זְכוּת:

Joshua ben Perahiah and Nittai the Arbelite received [the oral tradition] from them. Joshua ben Perahiah used to say: appoint for thyself a teacher, and acquire for thyself a companion and judge all men with the scale weighted in his favor.

״וָאֱהִי לָהֶם לְמִקְדָּשׁ מְעַט״, אָמַר רַבִּי יִצְחָק: אֵלּוּ בָּתֵּי כְנֵסִיּוֹת וּבָתֵּי מִדְרָשׁוֹת שֶׁבְּבָבֶל. וְרַבִּי אֶלְעָזָר אָמַר: זֶה בֵּית רַבֵּינוּ שֶׁבְּבָבֶל.

The verse states: “Yet I have been to them as a little sanctuary in the countries where they have come” (Ezekiel 11:16). Rabbi Yitzḥak said: This is referring to the synagogues and study halls in Babylonia. And Rabbi Elazar said: This is referring to the house of our master, i.e., Rav, in Babylonia, from which Torah issues forth to the entire world.

אָמַר רָבִין בַּר רַב אַדָּא, אָמַר רַבִּי יִצְחָק: מִנַּיִן שֶׁהַקָּדוֹשׁ בָּרוּךְ הוּא מָצוּי בְּבֵית הַכְּנֶסֶת — שֶׁנֶּאֱמַר: ״אֱלֹהִים נִצָּב בַּעֲדַת אֵל״. וּמִנַּיִן לַעֲשָׂרָה שֶׁמִּתְפַּלְּלִין שֶׁשְּׁכִינָה עִמָּהֶם — שֶׁנֶּאֱמַר: ״אֱלֹהִים נִצָּב בַּעֲדַת אֵל״.

In explaining Abba Binyamin’s statement, Ravin bar Rav Adda said that Rabbi Yitzḥak said: From where is it derived that the Holy One, Blessed be He, is located in a synagogue? As it is stated: “God stands in the congregation of God; in the midst of the judges He judges” (Psalms 82:1). The congregation of God is the place where people congregate to sing God’s praises, and God is located among His congregation. And from where is it derived that ten people who pray, the Divine Presence is with them? As it is stated: “God stands in the congregation of God,” and the minimum number of people that constitute a congregation is a quorum of ten.

וְכֵן הָרַב שֶׁאֵינוֹ הוֹלֵךְ בְּדֶרֶךְ טוֹבָה אַף עַל פִּי שֶׁחָכָם גָּדוֹל הוּא וְכָל הָעָם צְרִיכִין לוֹ אֵין מִתְלַמְּדִין מִמֶּנּוּ עַד שׁוּבוֹ לַמּוּטָב. שֶׁנֶּאֱמַר (מלאכי ב ז) "כִּי שִׂפְתֵי כֹהֵן יִשְׁמְרוּ דַעַת וְתוֹרָה יְבַקְשׁוּ מִפִּיהוּ כִּי מַלְאַךְ ה' צְבָאוֹת הוּא". אָמְרוּ חֲכָמִים אִם הָרַב דּוֹמֶה לְמַלְאַךְ ה' צְבָאוֹת תּוֹרָה יְבַקְּשׁוּ מִפִּיהוּ אִם לָאו אַל יְבַקְּשׁוּ תּוֹרָה מִפִּיהוּ:

even though he is a very wise man and his [instruction] is required by the entire nation, until he returns to a good path, as [implied by Malachi 2:7]: "For the priest's lips shall keep knowledge, and they shall seek Torah from his mouth, because he is a messenger from the Lord of Hosts." Our Sages said: If a teacher resembles "a messenger of the Lord of Hosts," seek Torah from his mouth. If he does not, do not seek Torah from his mouth.

בֵּית דִּין הַגָּדוֹל שֶׁבִּירוּשָׁלַיִם הֵם עִקַּר תּוֹרָה שֶׁבְּעַל פֶּה. וְהֵם עַמּוּדֵי הַהוֹרָאָה וּמֵהֶם חֹק וּמִשְׁפָּט יוֹצֵא לְכָל יִשְׂרָאֵל. וַעֲלֵיהֶן הִבְטִיחָה תּוֹרָה שֶׁנֶּאֱמַר (דברים יז יא) "עַל פִּי הַתּוֹרָה אֲשֶׁר יוֹרוּךָ" זוֹ מִצְוַת עֲשֵׂה. וְכָל הַמַּאֲמִין בְּמשֶׁה רַבֵּנוּ וּבְתוֹרָתוֹ חַיָּב לִסְמֹךְ מַעֲשֵׂה הַדָּת עֲלֵיהֶן וְלִשָּׁעֵן עֲלֵיהֶן: כָּל מִי שֶׁאֵינוֹ עוֹשֶׂה כְּהוֹרָאָתָן עוֹבֵר בְּלֹא תַּעֲשֶׂה שֶׁנֶּאֱמַר (דברים יז יא) "לֹא תָסוּר מִכָּל הַדָּבָר אֲשֶׁר יַגִּידוּ לְךָ יָמִין וּשְׂמֹאל". וְאֵין לוֹקִין עַל לָאו זֶה מִפְּנֵי שֶׁנִּתָּן לְאַזְהָרַת מִיתַת בֵּית דִּין. שֶׁכָּל חָכָם שֶׁמּוֹרֶה עַל דִּבְרֵיהֶם מִיתָתוֹ בְּחֶנֶק שֶׁנֶּאֱמַר (דברים יז יב) "וְהָאִישׁ אֲשֶׁר יַעֲשֶׂה בְזָדוֹן" וְגוֹ'. אֶחָד דְּבָרִים שֶׁלָּמְדוּ אוֹתָן מִפִּי הַשְּׁמוּעָה וְהֵם תּוֹרָה שֶׁבְּעַל פֶּה. וְאֶחָד דְּבָרִים שֶׁלְּמַּדוּם מִפִּי דַּעְתָּם בְּאַחַת מִן הַמִּדּוֹת שֶׁהַתּוֹרָה נִדְרֶשֶׁת בָּהֶן וְנִרְאָה בְּעֵינֵיהֶם שֶׁדָּבָר זֶה כָּךְ הוּא. וְאֶחָד דְּבָרִים שֶׁעֲשָׂאוּם סְיָג לַתּוֹרָה וּלְפִי מַה שֶּׁהַשָּׁעָה צְרִיכָה וְהֵן הַגְּזֵרוֹת וְהַתַּקָּנוֹת וְהַמִּנְהָגוֹת. כָּל אֶחָד וְאֶחָד מֵאֵלּוּ הַשְּׁלֹשָׁה דְּבָרִים מִצְוַת עֲשֵׂה לִשְׁמֹעַ לָהֶן. וְהָעוֹבֵר עַל כָּל אֶחָד מֵהֶן עוֹבֵר בְּלֹא תַּעֲשֶׂה. הֲרֵי הוּא אוֹמֵר (דברים יז יא) "עַל פִּי הַתּוֹרָה אֲשֶׁר יוֹרוּךָ" אֵלּוּ הַתַּקָּנוֹת וְהַגְּזֵרוֹת וְהַמִּנְהָגוֹת שֶׁיּוֹרוּ בָּהֶם לָרַבִּים כְּדֵי לְחַזֵּק הַדָּת וּלְתַקֵּן הָעוֹלָם. וְעַל הַמִּשְׁפָּט אֲשֶׁר יֹאמְרוּ אֵלּוּ דְּבָרִים שֶׁיִּלְמְדוּ אוֹתָן מִן הַדִּין בְּאַחַת מִן הַמִּדּוֹת שֶׁהַתּוֹרָה נִדְרֶשֶׁת בָּהֶן. מִכָּל הַדָּבָר אֲשֶׁר יַגִּידוּ לְךָ זוֹ הַקַּבָּלָה שֶׁקִּבְּלוּ אִישׁ מִפִּי אִישׁ:

The Supreme Sanhedrin in Jerusalem are the essence of the Oral Law. They are the pillars of instruction from whom statutes and judgments issue forth for the entire Jewish people. Concerning them, the Torah promises Deuteronomy 17:11: "You shall do according to the laws which they shall instruct you...." This is a positive commandment. Whoever believes in Moses and in his Torah is obligated to make all of his religious acts dependent on this court and to rely on them. Any person who does not carry out their directives transgresses a negative commandment, as Ibid. continues: "Do not deviate from any of the statements they relate to you, neither right nor left." Lashes are not given for the violation of this prohibition, because it also serves as a warning for a transgression punishable by execution by the court. For when a sage rebels against the words of the court, he should be executed by strangulation, as the following verse states: "A person who will act deliberately...." We are obligated to heed their words whether they: a) learned them from the Oral Tradition, i.e., the Oral Law, b) derived them on the basis of their own knowledge through one of the attributes of Biblical exegesis and it appeared to them that this is the correct interpretation of the matter, c) instituted the matter as a safeguard for the Torah, as was necessary at a specific time. These are the decrees, edicts, and customs instituted by the Sages. It is a positive commandment to heed the court with regard to each of these three matters. A person who transgresses any of these types of directives transgresses a negative commandment. This is derived from the continuation of the above verse in the following manner: "According to the laws which they shall instruct you" - this refers to the edicts, decrees, and customs which they instruct people at large to observe to strengthen the faith and perfect the world. "According to the judgment which they relate" - this refers to the matters which they derive through logical analysis employing one of the methods of Biblical exegesis. "From all things that they will tell you" - This refers to the tradition which they received one person from another.

וכך ישראל, אף על גב שכל ישראל כולם קדושים, צריכים אל כהן מיוחד נבדל מהם. לא שיהיו הכל כהנים, כי צריך שיהיה כאן כהן מיוחד.

חש בגרונו יעסוק בתורה, שנאמר (שם) "וענקים לגרגרותיך". אמר רב יהודה בריה דרבי חייא, בא וראה שלא כמדת הקב"ה מדת בשר ודם; ולפיכך שולטים שם הפגעים, אשר הם מתנגדים אל העולם, ולכך יש לחוש שישלטו בו פגעים, אשר אינם מסדר העולם.

And [the Talmud] further [recounts] ibid [Sotah 22a]: '[If] he has read [i.e., studied Scripture] and studied the Oral Law, yet did not apprentice himself to Torah scholars - Rabbi Eliezer says: this one is a commoner; Rabbi Samuel son of Nachmeni says: this one is an ignoramus; Rabbi Yanai says: this one is a Samaritan; Rav Acha son of Jacob says: this one is a magus. Rav Nachman son of Isaac said: The opinion of Rav Acha son of Jacob seems most plausible, as people say: A magus chants without knowing what he's chanting; a tanna teaches without knowing what he's teaching.' And the explanation of this [Talmudic passage] is that when he studied the Law [lit: Mishna] but did not apprentice himself to a Torah scholar to clarify the reasons for the Law - for it is a clear mind [that one has] when one has arrived at [lit: stood upon] the reasons for the Law - [such a one who has failed to do this clarification by appreticing to a scholar] is called a commoner [am haaretz] inasmuch as he did not acquire an intellect.

לזאת הרי כי ודאי עיקר ענין הקדש והמקדש ושריית שכינתו ית' הוא האדם שאם יתקדש עצמו כראוי בקיום המצות כולן שהם תלויין ג״כ בשורשן העליון בפרקי אברי השיעור קומה כביכול של כלל כל העולמות כולם. (וע' זוהר תרומה קס״ב ב' ואת המשכן תעשה גו'. הא הכא רזא דיחודא כו' עש״ה) אז הוא עצמו המקדש ממש ובתוכו ה' ית״ש. כמ״ש (ירמיה ז') היכל ה' היכל ה' המה. וכמאמרם ז״ל. ושכנתי בתוכם בתוכו לא נאמר אלא בתוכם כו' וזה שארז״ל (כתובות ה' ע״א) גדולים מעשי צדיקים יותר ממעשה שמים וארץ דאלו במעשה שמים וארץ כתיב אף ידי יסדה ארץ וימיני טפחה שמים. ואלו במעשה צדיקים כתיב מקדש אדני כוננו ידיך. פתחו במעשי צדיקים וסיימו ראייתם ממקדש. כי כן באמת שהצדיקים ע״י מעשיהם הרצויים לפניו יתברך. הן הם מקדש ה' ממש.

For this reason, definitely the focal point of holiness and the Holy Temple, and the appearance in a particular place of the Sh’kheena, is man. For if he makes himself as holy as is possible by fulfilling all of the commandments (for they are also dependent on their upper roots, in the components of the organs/limbs of the Stature, so to speak, of the entirety of all the worlds taken together, and refer to Zohar T’rooma 162b “and you shall make the Tabernacle… this is the secret of the unity…”,—refer there in depth), then he becomes the actual Holy Temple, and within him is YHV”H (blessed be He), as is written (Yirmiya 7:4):” They [emphatic—three times] are the abode of YHV”H. And as they (OBM) said: “and I will dwell within them”—it does not say “among them” but rather “within them.” And this is what they (OBM) stated (K’toobote 5a): “The handiwork of the righteous is greater than the creation of the heaven and the earth. For about the handiwork of the heaven and the earth it is written (Yeshayahu 48:13) ‘Also, My hand has laid the foundation of the earth, and My right hand has measured out the heavens’, while regarding the righteous is written (Sh’mote 15:17): ‘With your hands You set up God’s-ADN”Y Holy Temple’.” They began with the actions of the righteous and concluded their proof with the Holy Temple, for in truth it is the righteous, as a result of their desirable actions before Him (blessed be He), that they [emphatic] are, in actuality, God’s Holy Temple.

אך במקום אחר ביארתי שג' אנשים הנ"ל הם ג' עמודי העולם, תורה ועבודה וגמילות חסדים, שהם אברהם יצחק ויעקב. והנה קודם שהי' בעולם יצחק ויעקב עמד העולם על עמוד אחד של גמילות חסדים שהוא בחינת אברהם, וז"ש וישא עיניו וירא והנה שלשה אנשים, שהם ג' עמודי העולם, נצבים ועומדים עליו, על גמילות חסדים לבד, לכך נתאמץ להחזיק עמוד גמילות חסדים, וירץ לקראתם, להכניס אורחים שהוא עמוד גמילות חסדים, והבן, וק"ל.
