Separating Waste from Waste: The Laws of Borer

When removing an inedible shell from food, the sources address whether this constitutes the prohibited labor of borer (selecting), and under what conditions separating waste-like material from desirable food is permitted on Shabbat. The sources examine the definitions of food and waste, the method and timing of selection, and the distinction between direct removal and other preparatory acts.

What the sources say

The core din of borer targets separating okhel from pesolet or distinguishing between two food types, as the Gemara (Shabbat 74a) and Mishneh Torah, Sabbath 8:12-13 and Shulchan Arukh, Orach Chayim 319:1-3 formulate it; the paradigm case discussed throughout is removing waste from food, not waste from waste, which is the scenario of an unopened nutshell.

Several sources explicitly address the case of a shell that still leaves pesolet behind, such as removing a nut or almond from its outer green husk, and here there is a real machlokes. Shulchan Arukh, Orach Chayim 319:4-6 records the Rema's stringency, citing the Maharil, that one should not remove nuts or almonds from their green shell, a position echoed by Kitzur Shulchan Arukh 80:11 and Mishnah Berurah 319:25, and by Kaf HaChayim on Shulchan Arukh, Orach Chayim 319:61-63, who extends it even to pods that already enclose legumes.

Against this, Arukh HaShulchan, Orach Chaim 319:20 distinguishes peeling a single garlic clove or onion, or cracking a nut and discarding its shell one at a time, from the Yerushalmi's case of crushing a large batch of garlic together — the former, he says, is simply the normal manner of eating and involves neither dash nor borer at all. Mishnah Berurah 319:25 similarly cites the Yam Shel Shlomo's view that peeling a shell off food is considered tikkun ochel, preparing the food, rather than an act of borer, though the Magen Avraham disputed this and it was only reconciled on the basis that one intends to eat immediately.

Shabbat 138a frames the general principle that the manner of a boreir is to take the food and leave the pesolet, which is why removing the outer, inedible shell (the pesolet) in order to reach the food inside can be classified as derekh borer when the case involves true okhel metoch pesolet, as in Shabbat 74b and Mishneh Torah, Sabbath 8:12-13's treatment of turmisin.

Modern poskim treat the nut-shell case concretely: Rav Eliezer Melamed (Peninei Halakhah, Shabbat 11:2) rules that removing peanuts from a mixture with their shells is permitted only when the shells (pesolet) are left and the peanuts (okhel) are taken by hand for immediate eating, while removing the shells themselves to prepare the peanuts is a Torah violation of borer; Rav Eliezer Melamed (Peninei Halakhah, Shabbat 11:3) further explains that where two components are each treated as pesolet relative to the other, separating them can still constitute borer.

Nishmat Shabbat vol 3:224 addresses a case closer to pesolet-mipesolet directly, permitting separation of waste from waste where the person derives no benefit or need from one of the discarded items, such as empty bottles, which bears on whether a true pesolet-mipesolet separation (as opposed to extracting a shell that still functions as food-adjacent) escapes the prohibition altogether.

Igros Moshe OC 1:125 takes up the use of a utensil, such as a fork or spoon, to remove refuse, ruling that doing so constitutes borer with a utensil and is forbidden when the utensil makes the separation meaningfully easier than separating by hand, but that it does not add to the halachic character of the sorting when it does not.

Tzitz Eliezer 16:12 examines the related question of separating only part of the pesolet from the food, bringing the Yerushalmi's ruling that one who leaves some food or pesolet mixed in is exempt from the Torah prohibition but may still transgress rabbinically, and he discusses differing interpretations of the Pri Megadim on how the relevant shiur is measured between the combined food and pesolet.

Shabbat 74a

Shabbat 74a:7

The Talmud identifies בורר as one of the forbidden labors and discusses the defining act of selecting and separating materials. This is the primary Chazal source underlying the later codes.

Ḥizkiya said: One who selects lupines from their waste after boiling them is liable for performing the prohibited labor of selecting. The Gemara asks: Let us say, based on this statement, that Ḥizkiya holds that even selecting food from waste is prohibited. The Gemara rejects this proof: Lupines are different,

Shabbat 138a

Shabbat 138a:8-10

Chachmei Bavel record a dispute over whether straining wine is forewarned as borer or meraked: Rabba emphasizes removing the food while leaving the refuse, whereas Rabbi Zeira emphasizes the refuse remaining above and the food below, as in sifting.

The Gemara asks: One is liable to bring a sin-offering for straining. Due to performance of what category of prohibited labor do we forewarn him? Rabba said: It is for the category of selecting, as one is selecting the wine from the sediment. Rabbi Zeira said: It is for the category of sifting, as straining is similar to sifting flour in a sifter, which is a form of selecting. Rabba said: According to my opinion, it is reasonable. What is the manner of one who selects? He takes the food and leaves the refuse; here too, when straining wine, one takes the food and leaves the refuse. Rabbi Zeira said: According to my opinion, that this is not typical selection but rather a specific type of selection, it is reasonable, as what is the manner of sifting? The refuse remains atop the sifter and the food is below. Here too, when straining wine, the refuse remains atop the strainer and the food is below.

Beitzah 12b

Beitzah 12b:14-16

Chachmei Bavel discuss crushing mustard stalks on a Festival and cite distinctions between permitted hand-to-hand winnowing or small-scale processing and prohibited use of specialized sorting vessels, though the passage ends with an objection that Festival-day crushing may not be permitted.

§ The Gemara relates: The host of Rava, son of Rav Ḥanan, had bundles of unprocessed mustard, whose seeds remained in their stems. He said to his guest, the Sage: What is the halakha with regard to crushing these mustard stalks and eating from them on a Festival? Rava, son of Rav Ḥanan, did not have an answer readily available, so he came before Rava to ask his opinion. Rava said to him that it was taught: One may husk kernels by rubbing them between one’s fingers, and one may likewise crush legumes on a Festival. This statement indicates that it is permitted to crush mustard stalks. Abaye raised an objection to Rava from a baraita: In the case of one who husks kernels of grain on Shabbat eve, on the following day, on Shabbat itself, he may winnow the chaff in an irregular manner by passing the kernels from hand to hand and then eat them. However, one may not do so, neither by means of a basket [kanon] that is occasionally used for sorting and separating the chaff nor with a large vessel. With regard to one who husks kernels of grain on a Festival eve, on the following day, he may winnow a little grain at a time and eat, even with a tray or a large vessel. However, he may not do so with a tablet, nor with a winnow, nor with a sieve. Since these vessels are designed for winnowing, they are used only for large quantities, and therefore it will appear as though he were preparing for after the Festival, which is certainly prohibited. In any case, the wording of the baraita indicates: On a Festival eve, yes, one may husk or crush legumes; on the Festival itself, no, it is prohibited to do so.

Shabbat 74b

Shabbat 74b:1

Chachmei Bavel state that lupines are boiled seven times and must be removed from their shells to prevent rotting, so removing the edible portion is treated as removing waste from food.

as they are boiled seven times. And, if one does not remove them from the shells, they rot. Therefore, it is considered like removing waste from food. The rotting edible portion of the lupine causes the shell to reek. Removing the edible portion, therefore, has the legal status of removing waste.

Shabbat 140b

Shabbat 140b:19

Chachmei Bavel explain that the mishna permits placing straw in a sieve into an animal’s trough, but Rabbi Eliezer ben Ya’akov prohibits looking at a sieve on Shabbat at all, lest one violate the labor of selecting.

We learned in the mishna: One may not soak vetches in water in order to separate them from their chaff. However, one may take the straw in a sieve and place it into the trough of an animal. The Gemara comments: The mishna is not in accordance with the opinion of this tanna, as it was taught in a baraita: Rabbi Eliezer ben Ya’akov says: One may not look at a sieve at all on Shabbat, lest one come to violate the prohibited labor of selecting.

Shabbat 140a

Shabbat 140a:11-12

Chachmei Bavel state that one may not soak or rub vetches to remove their chaff, nor sift straw or place it where wind will remove the chaff, but may put them in a sieve, basket, or animal trough even if the chaff is removed incidentally.

MISHNA: One may not soak asafoetida in lukewarm water to prepare a medicinal drink from it; however, one may place it into vinegar like a standard spice. And one may not soak vetches in water in order to separate them from their chaff, nor rub them by hand so as to remove their chaff. However, one may place them into a sieve or into a basket, and if the chaff gets removed, so be it. One may not sift straw in a sieve, and similarly, one may not place it on a high place so that that the chaff blows away in the wind; however, one may take the straw in a sieve and place it into the trough of an animal, and one need not be concerned if the chaff is removed in the process.

Mishneh Torah, Sabbath 8:12-13

Rambam's codification of the melakhah of borer: separating food from other material is liable when done in the prohibited manner, while selecting in the permitted manner is distinguished by purpose, timing, and method. This supplies the foundational halakhic framework.

Mishneh Torah, Sabbath 8:11

Mishneh Torah, Sabbath 8:11

Rambam's discussion of selecting food and waste within the laws of Shabbat, useful for clarifying the basic categories of אוכל and פסולת before applying them to shells and layered coverings.

A person who winnows or separates [an amount of food the size of] a dried fig is liable. Causing milk to curdle is a derivative [of the category] of separating. Similarly, a person who separates the dregs from liquids is liable for having performed a derivative of separating or a derivative of sifting. [The particular category of forbidden labor is not defined,] because the labors of winnowing, separating, and sifting resemble each other.

Chiddushei Ramban on Shabbat 74a:1

The passage discusses whether grinding (kichisha) is considered a primary labor (av melacha) or derivative labor (tolda), with various authorities debating whether separating (borer) and grinding are distinct categories, ultimately concluding that grinding is not counted as a primary labor because not all people grind their bread before eating it.

Arukh HaShulchan, Orach Chaim 319

Arukh HaShulchan, Orach Chaim 319:20

Analyzes the conceptual and practical parameters of borer, including cases where edible and inedible matter are attached or mixed and how removal of a shell relates to selecting אוכל from פסולת.

Shulchan Arukh, Orach Chayim 319:4-6

The governing laws of borer on Shabbat, including the prohibition of separating food from פסולת and the permitted manner of selecting food for immediate use. The siman is the essential practical starting point for whether removing a shell is borer.

4. One who separates waste from food even with one hand is liable. RAMA: Even if there is more food (than waste) and it is more arduous to remove the food, nevertheless one must not remove the waste even if eating is imminent. (Beis Yosef). 5. One who separates Lupine from within its waste is liable because its waste sweetens them when cooked together, and it appears as if one is removing the waste from the food. 6. It is forbidden to separate through rubbing, yet one may rub with a modification; a small quantity with the tips of one’s fingers. RAMA: Even though one is separating the food from the stalks; but since it is done in a backhanded manner in order to eat it, it is permitted. Yet there are those who are stringent [Mordechai; Ra"n] and therefore it is forbidden to shell almonds or big nuts from their green shells (Mahar"il). It is correct to be stringent because it is possible to eat without shelling.

Concerning legumes [peas] in their pods (which are called sharvitin), when their pods are fresh and edible, you may open them and remove [the peas] from the pod, (for this is considered separating food from food) [which is permitted]. But if the pods have become dry and are no longer edible, it is forbidden to remove the peas from them. Similarly, you must be careful not to remove nut (kernels) from their (soft) green (outer) shell or sesame seeds from their shells. When food is mixed with pesoles, you may separate [select] the food from the pesoles, but not the pesoles from the food. And even separating food from pesoles is forbidden when using a utensil. It is permitted only by hand, and only for the purpose of eating it immediately. Even foods which you select to eat now, from food which will be left for later use, care must be taken to select only what is to be eaten now, and not to select that which will be left over, because the part to be eaten now is considered food and the part to be left over is considered pesoles. Even peeling garlic or onions and putting them away is prohibited, because of boreir (selecting). You are permitted to peel only what you need for eating now. The outermost peel of the garlic, that surrounds the whole cluster must not be removed even to eat the garlic now, because it is considered mefareik, a toldah [offshoot melachah] of dosh (threshing). Even non-edible items are included in the prohibition of boreir (selection), such as utensils etc.; whatever you need for immediate use is considered food and the rest is considered waste.

Mishnah Berurah 319

Mishnah Berurah 319:25

Explains the Shulchan Arukh's laws of borer, including the distinctions between אוכל and פסולת, immediate use, and removal by hand rather than with a utensil. Its discussion is directly relevant to separating a nut from its shell and to whether material classified as פסולת remains mixed with it.

Arukh HaShulchan, Orach Chaim 319:10

Arukh HaShulchan, Orach Chaim 319:10-11

R. Yechiel Michel Epstein reworks the laws of borer, discussing which combinations count as mixtures and what qualifies as sorting for immediate use.

Shulchan Arukh, Orach Chayim 319:1-3

The governing laws of selecting on Shabbat appear here. The Shulchan Arukh rules that selecting food from among other food is permitted only under the relevant conditions—food rather than waste, by hand rather than the normal sorting utensil, and for immediate use—and that selecting for later use is prohibited.

Peninei Halakhah, Shabbat 11:3

A contemporary systematic treatment of borer that discusses peeling fruits and vegetables and distinguishes ordinary eating preparation from prohibited separation. It is useful for applying the framework to nuts and layered shells.

Let us return to the case of peanuts mixed together with shells. One may take the peanuts from the mixture and eat them only when all three conditions are met: 1) He removes the okhel (peanuts) from the psolet (shells); 2) he does so with his hands; 3) he does so for proximate consumption. However, if one removes the shells from the mixture to prepare the peanuts for eating, since he is removing the psolet from the okhel, this is considered derekh melakha, and he has transgressed a Torah prohibition. Similarly, if he removes the peanuts in order to eat them much later, this is considered derekh melakha since it is not for proximate consumption, and he has transgressed a Torah prohibition. Additionally, if a gadget were devised to help separate peanuts from their shells, it would be forbidden to use it on Shabbat even for the purpose of immediately eating the nuts.

Peninei Halakhah, Shabbat 11:7

The passage permits using a saltshaker containing rice to absorb moisture and prevent clumping, since it is considered a utensil for dispensing salt in measured amounts rather than for separating the salt from the rice.

Rav Eliezer Melamed (Peninei Halakhah, Shabbat 11:15)

Peninei Halakhah, Shabbat 11:15

The passage discusses removing insects from tea, soup, or food, permitting removal with some liquid or food, but requiring a larger amount of food when removing multiple insects so that the act is considered separating okhel from okhel rather than psolet from okhel.

If an insect falls into a cup of tea and is floating on top, some permit removing it on its own. Others are stringent and maintain that removing the bug on its own is Borer, because it is considered psolet that is being removed from okhel. It is proper to be stringent and remove the bug with a spoon in such a way that some liquid is removed with it. Alternatively, one can tilt the cup and pour off some tea together with the bug. This also applies if a bug fell into soup or food. One may remove it with some of the food using a spoon. However, if multiple bugs fell into the soup or food, one may not remove them with a bit of food. This is because it is clear that what one actually intends is to remove the psolet, and therefore the okhel in the spoon is secondary to the bug. Since one is separating psolet from okhel, he is transgressing the prohibition of Borer. The way to get around this problem is to remove a large amount of food together with each bug, such as by using a cup, so that the majority of what is being removed is okhel. Then it is considered separating okhel from okhel, which is permitted.

Maamar Mordechai Hilchot Shabbat, Chelek 4 94:6

Rabbi Mordechai Eliyahu states that removing waste from food when they are mixed is forbidden on Shabbat, whether done by hand or utensil and whether the separated item is intended for immediate or later use, because this is the normal manner of sorting.
