וכתב שכן נראה לו ברור עיין שם ולענ"ד אין זה מוכרת להוציא לשון הרא"ש מפשוטו ומ"ש הש"ך דלא שייך בי' קני לך איהו וכל שעבודי' כיון דנמחל שעבודו בזה נ"ל דאינו קושיא דשטר שנמחל שעבודו לא נפקא השעבוד למפרע אלא כשנפרע או נמחל הרי הוא כפודה וכקונה שעבודו ממנו ואם כן שפיר שייך בו קני לך איהו וכל שעבודו כיון דהשעבוד שבחוכו שנעשה מתחלתו לעבוד לאפקע למפרע אלא דהוא עתה של הלוה יכול לחזור ולהקנותו ולא גרע מהא דקיימא לן שטר מכר נקנה בכתיבה ומסירה בפ' ג"פ דף קס"ט והתם שטר קנין הוא דשטר ראי' אינו נקנה בכתיבה ומסירה כמבואר בסימן ס"ו סעיף י"ד כיון דשטר קנין הוא הרי הוא כאלו נמחל שעבודו דהא שטר קנין בתר דעבד דידי' והוא הקנין תו לאו כלום הוא אלא צריך לומר דמקנה איהו וכל שעבודו דאית בי' לעשות ה"נ מקנה איהו וכל שעבודי' דאית בי' לעשות ודו"ק:
