Agunah in Talmud and Rishonim

The Talmud and Rishonim define an agunah as a woman unable to remarry due to her husband's absence or refusal to grant a divorce. The sources address both the classic case of a missing husband requiring testimony of death, and the case of a present husband who refuses to divorce, distinguishing between evidentiary standards and court-ordered coercion.

What the sources say

The term agunah originates in the Talmud's discussion of leniencies granted to a woman whose husband's fate is uncertain, where Yevamot 87b-88a states that the rabbis relied on a single witness's testimony of death specifically because of the concern of עיגונא, chaining a woman to an unresolved marriage.

The classic case generating agunah status is a husband lost without clear evidence of death, as in the mishnah of Yevamot 121a-122a regarding a man who fell into water with no visible end, and the related discussions in Yevamot 115b and Yevamot 117b over what testimony suffices to release such a wife, later codified in Mishneh Torah, Divorce 13:2, Tur, Even HaEzer 17, and Shulchan Arukh, Even HaEzer 17:2, with Shulchan Arukh, Even HaEzer 17:36 adding that a besieged city or sinking ship does not create a presumption of death sufficient to free her.

A second category, directly matching the user's request, is the wife whose husband refuses to divorce her despite being halachically obligated to do so. Mishneh Torah, Divorce 2:20 rules that beit din may strike such a husband until he says 'I want to' and gives the get, and this remains valid because a man under such coercion to fulfill an obligation is not considered legally coerced in his heart. Gittin 88b similarly establishes that a get given under lawful compulsion by a Jewish court is valid, while compulsion that departs from the halachic requirement invalidates it.

Several circumstances trigger this forced divorce: Ketubot 77a records that a husband who declares he will not support his wife must divorce her and pay her ketubah, Yevamot 64a obligates divorce after ten childless years, and Shulchan Arukh, Even HaEzer 154:1 lists physical conditions such as foul breath or boils that likewise compel a husband to grant a get. Arukh HaShulchan, Even HaEzer 154:15-18 extends this to a husband who mistreats his wife, feeds her forbidden food, or violates vows against her, reasoning a fortiori from the physical afflictions already enumerated.

Gray Matter I, Grappling With the Problem of Agunot, Coercing a Husband to Give a Get surveys this same list of grounds for coercing a get, while Gray Matter I, Grappling With the Problem of Agunot, Hafka'at Kiddushin; Annulment of Marriage explains that the rabbis do not annul a marriage absent an actual get, even in the water-loss scenario, underscoring why a recalcitrant husband's refusal leaves his wife formally agunah rather than freed by rabbinic fiat.

Rav Eliezer Melamed (Peninei Halakhah, Family 4:19) frames the agunah as including both the woman whose husband's fate is unknown and the woman whose husband refuses to release her despite her halachically justified claim, noting that beit din is empowered to strike him until he consents to give the get willingly.

Iggerot Moshe, Even HaEzer 1:79 addresses the practical case of a young wife whose husband lacks sexual capacity, refuses to give a get, and flees so that he cannot be located at all, and argues that because this condition undermines the essential purpose of the marriage and was unknown at the time of kiddushin, the kiddushin itself, and possibly the marriage, should be treated as a mistaken transaction and annulled.

The rishonim on Rashi on Yevamot 87b and Rashba on Yevamot 87b explain the mechanics of this leniency toward testimony of death, noting that a woman is believed to investigate carefully before remarrying, while Tosafot on Yevamot 87b and Maggid Mishneh on Mishneh Torah, Divorce 13:1 refine when such testimony, or a wife's own claim, is credited or rejected as a presumed falsehood, further mapping the boundaries of the agunah's uncertain status.

Yevamot 87b-88a

Yevamot 87b-88a

The Mishnah and Gemara define the classic agunah context as a woman whose husband is missing or whose death is uncertain, creating a prohibition against remarriage until testimony establishes that he died. The discussion focuses on the evidentiary rules and the exceptional leniencies developed for her.

Gittin 88b

Gittin 88b:2-3

The sugya discusses circumstances in which a husband is compelled by the court to give a get, clarifying the legal category of a recalcitrant husband and the relationship between refusal to divorce and valid coercion. It is relevant to distinguishing a classic missing-husband agunah from a chained wife whose husband is present but refuses a get.

MISHNA: With regard to a bill of divorce that the husband was compelled by the court to write and give his wife, if he was compelled by a Jewish court it is valid, but if he was compelled by gentiles it is invalid. But with regard to gentiles they may beat him at the request of the Jewish court and say to him: Do what the Jews are telling you, and it is a valid divorce. GEMARA: Rav Naḥman says that Shmuel says: With regard to a bill of divorce that the husband was compelled by a Jewish court to give his wife, if they did so lawfully, as the halakha obligated the husband to divorce his wife, it is valid. This is referring to cases where sexual intercourse is forbidden or specific cases where the Sages instituted that the husband is obligated to divorce his wife. If they did so unlawfully, the bill of divorce is invalid, but it is not considered entirely invalid, as it disqualifies the wife from marrying a priest after her husband’s death. § Abaye found Rav Yosef sitting in court as the judge and compelling husbands to give their wives bills of divorce. He said to him: But aren’t we ordinary people, not ordained judges? And it is taught in a baraita that Rabbi Tarfon would say: With regard to any place where you find gentile courts [agoriot], even if their laws are like Jewish laws, you may not attend them, as it is stated: “Now these are the ordinances which you shall set before them” (Exodus 21:1). It is derived from here that one may go to court only before them, i.e., Jewish judges, and not before gentiles. Alternatively, it is derived that one may go to court before them, i.e., ordained judges, and not before ordinary people. Since we are not ordained judges, how can you perform a distinctly judicial act?

Ketubot 77a

Ketubot 77a:14-15

The Gemara records cases in which a wife may seek judicial intervention against a husband whose conduct makes continued marriage intolerable, including circumstances involving coercive divorce. This is an important Talmudic bridge between agunah-like marital captivity and a husband’s refusal to release his wife.

§ As the mishna discusses situations in which the court forces the husband to divorce his wife, the Gemara mentions a similar case. Rav said: A husband who says: I will not sustain my wife and I will not provide a livelihood for her, must divorce her and give her the payment of her marriage contract. Rabbi Elazar went and recited this halakha before Shmuel. Shmuel said: Feed [akhsuha] barley, animal fodder, to Elazar. In other words, he has spoken nonsense, as rather than forcing him to divorce her, it would be better for them to force him to sustain his wife. The Gemara asks: And how does Rav respond to this argument? He bases his ruling on the principle that a person does not reside in a basket, i.e., in close quarters, with a snake. In other words, a woman cannot share her life with a man who provides for her needs only when compelled to do so by the court. The Gemara relates: When Rabbi Zeira ascended to Eretz Yisrael, he found Rabbi Binyamin bar Yefet sitting and reciting this halakha of Rav’s in the name of Rabbi Yoḥanan. He said to him: On account of this matter they fed Elazar with barley in Babylonia.

Yevamot 64a

Yevamot 64a:3-4

Chachmei Bavel state that after ten childless years a husband must not neglect the mitzvah to be fruitful and multiply, but must divorce his wife and pay her ketubah or marry another wife, since the childlessness may not be attributable to her; after divorce, she may remarry.

MISHNA: If a man married a woman and stayed with her for ten years and she did not give birth, he is no longer permitted to neglect the mitzva to be fruitful and multiply. Consequently, he must either divorce her and marry someone else, or take another wife while still married to her. If he divorced her she is permitted to marry another man, as it is not necessarily on her account that she and her first husband did not have children, and the second husband is permitted to stay with her for ten years. And if she had a miscarriage, he counts the ten years from the time of the miscarriage. GEMARA: The Sages taught: If a man married a woman and stayed with her for ten years and she did not give birth, he should divorce her and pay her marriage contract, because perhaps he did not merit to be built, i.e., to have children, from her. It is not certain that their failure to have children is due to her, as it is possible that they are not a suitable match for bearing children.

Yevamot 121a-122a

Yevamot 121a-122a

The concluding agunah sugya develops the rule that testimony from unusual or indirect witnesses may establish a husband’s death, because the woman’s ongoing marital captivity is taken seriously. These passages are among the clearest Talmudic sources for the category’s practical definition.

MISHNA: If a man fell into the water and did not come out, whether the body of water has a visible end or does not have a visible end, his wife is prohibited from remarrying. There is no absolute proof that the man died, as it is possible that he emerged from the water some distance away. Rabbi Meir said: An incident occurred involving a certain person who fell into the Great Cistern and emerged only after three days. This is evidence that sometimes one may survive a fall into water, even when everyone assumes he is dead. GEMARA: The Sages taught: If a man fell into the water, whether the body of water has a visible end or does not have a visible end, his wife is prohibited from marrying; this is the statement of Rabbi Meir. And the Rabbis say: If he fell into a body of water with a visible end, his wife is permitted to marry, but if he fell into a body of water with no end, his wife is prohibited from marrying. They sent him the following question: When a man disappears in an endless body of water, is his wife a forbidden or a permitted woman, i.e., may she remarry? He sent back to them: His wife is forbidden. They asked him further: Is the lake of Samkei a body of water with a visible end or an endless body of water? He sent a response to them: It is an endless body of water, since one cannot see the water’s edge on every side. They then asked him: If so, what is the reason that the Master, i.e., Rav Sheila, acted this way, allowing the wife to remarry?

Yevamot 117b

Yevamot 117b:13-14

The passage states that when co-wives give conflicting testimony about whether their husband died, the one who says he died may remarry and collect her ketubah while the other may do neither; if they differ only over whether he died naturally or was killed, Rabbi Meir prohibits remarriage, whereas Rabbi Yehuda and Rabbi Shimon permit it because both agree that he is no longer alive.

MISHNA: If two women who were married to the same man come forward, and one of them says that the husband died, and the other one says he did not die, the one who says he died may marry on the basis of her own testimony, and she takes the money of her marriage contract. And the one who said he did not die may not marry, and does not take the money of her marriage contract. If one wife says: He died in a normal manner, and the other one says: He was killed, Rabbi Meir says: Since they contradict one another, these women may not marry. Rabbi Yehuda and Rabbi Shimon say: Since they both agree that he is not alive they may marry, despite the fact that they dispute the circumstances of his demise. If a witness says: He died, and a witness says: He did not die,

Yevamot 115b

Yevamot 115b:8-9

Chachmei Bavel record a dispute between Abaye and Rava over whether one must suspect two men share the same name, illustrated by a found get whose validity required examining all of Neharde’a for another man named Androlinai.

§ The Gemara relates a story that deals with the permission of a woman to remarry. Yitzḥak the Exilarch, son of the sister of Rav Beivai, was walking from Cortva to Spain and died along the way. They sent this message from Spain: Yitzḥak the Exilarch, son of the sister of Rav Beivai, was walking from Cortva to Spain and died. The Gemara asks: Are we concerned about the possibility of two men named Yitzḥak or not? Perhaps there is someone else with the same name, and therefore the mention of his name is not a sufficiently distinguishing mark. Abaye said: We are concerned about this possibility. Rava said: We are not concerned. Abaye said: From where do I say my reasoning that there might be another man with the same name? As a certain bill of divorce was found in the city of Neharde’a, and this passage was written on it: On the colonial [kelonya] side of the city, I, Androlinai of Neharde’a, excused, sent away, and divorced my wife so-and-so. Androlinai’s wife requested permission to remarry based on this bill of divorce, but they did not know if he was the man who gave the divorce or if it was given by another man of the same name. And the father of Shmuel sent this question before Rabbi Yehuda Nesia in Eretz Yisrael. And Rabbi Yehuda Nesia sent a message to him: All of Neharde’a must be examined, to see whether there is another man by that name. This shows that one must be concerned that there might be two people with the same name.

Gittin 89b

Gittin 89b:8-10

Chachmei Bavel state that an unconfirmed rumor is disregarded, and even a rumor arising after marriage does not require the woman to leave her husband; they further discuss a woman rumored to be betrothed to one man who was then betrothed to another, ruling that she must leave the second man while the circumstances are clarified.

§ Rav Ashi said: Any rumor that was not confirmed in court is not regarded as a significant rumor. And Rav Ashi said: With regard to any rumor that was spread about a woman after her marriage, we are not concerned about it. She need not leave her husband, and he need not divorce her. The Gemara infers that if the rumor circulated after her betrothal we are concerned about it, and she must be divorced from her betrothed. Rav Ḥaviva said: Even if it circulated after her betrothal, we are still not concerned about it. The Gemara concludes: And the halakha is that we are not concerned about it. Rav Yirmeya bar Abba said that a group of students from the study hall of Rav sent the following question to Shmuel after Rav’s death: Teach us, our master: If a rumor circulated about a woman that she is betrothed to a first man, and another man came and betrothed her in a manner of betrothal that is recognized by Torah law, as there is clear testimony of it, what is the halakha? He sent them an answer: She must leave the second man, and you clarify the matter to figure out exactly what happened and inform me. The Gemara asks: What is meant by: And you clarify the matter? If we say that he said this so that if it is discovered that the betrothal of the first man was not a proper betrothal we should suppress the rumor, thereby permitting her to marry the second man, isn’t Neharde’a Shmuel’s locale? And as mentioned above, in Neharde’a they would not suppress a rumor. Rather, he must have instructed them in this manner because if it is discovered that the betrothal of the first man was a proper betrothal, she does not need a bill of divorce from the second man.

Gittin 21b

Gittin 21b:6-7

Chachmei Bavel explain that “a scroll of severance” teaches either that only a written document severs a woman from her husband or that a valid get must completely sever their relationship; thus, permanent conditions such as never drinking wine or visiting her father’s house invalidate the get, whereas a condition limited to thirty days does not.

The Gemara asks: And the other tanna, Rabbi Yosei HaGelili, from where does he derive this reasoning? He derives it from the phrase “scroll of severance,” which teaches that a scroll, i.e., a written document, severs her from her husband and nothing else severs her from him. The Gemara asks: And those who hold the other opinion, the Rabbis, how do they explain this phrase? For them, the phrase “scroll of severance” is required to teach that a bill of divorce must be a matter that severs all connection between him and her, as it is taught in a baraita: If a man says to his wife: This is your bill of divorce, on the condition that you will not ever drink wine, or on condition that you will never go to your father’s house, that is not severance, and the bill of divorce is not valid. If a bill of divorce imposes a condition upon the woman that permanently binds her to her husband, her relationship with her husband has not been completely severed, which is a prerequisite for divorce. If, however, he imposes a condition until thirty days have passed, or for any other limited period of time, that is severance. The bill of divorce is valid, as the relationship will be completely terminated at the end of the thirty-day period.

Yevamot 25a

Yevamot 25a:4-6

Chachmei Bavel discuss whether a man who divorced his wife because of a bad reputation or intolerable vow and then remarried her must divorce her again, comparing this case with one in which a suspected adulterer remarried the woman he had divorced.

§ We learned in a mishna there (Gittin 45b): A man who divorces his wife due to her bad reputation may not take her back again, even if it turns out that the rumor was untrue. Likewise, if he divorced his wife due to a vow of hers that is unbearable to him he may not take her back even if she is released from that vow. Rabba bar Rav Huna sent a question to Rabba bar Rav Naḥman: Our teacher, instruct us. If one of those men listed in that mishna divorced his wife due to her bad reputation or vow and it was therefore prohibited for him to take her back, yet he nevertheless remarried her, what is the halakha? Must he divorce her? Rabba bar Rav Naḥman said to him: We already learned in the mishna (24b): With regard to one who is suspected of committing adultery with a married woman, and he, her husband, divorced her, even if he subsequently remarried her he must divorce her. Rabba bar Rav Huna said to him: Is this comparable to the case I asked about? There, in the mishna, it says: They, the court, remove her from him, whereas here (Gittin 45b), the mishna states: He divorced her of his own accord. Perhaps if the court requires them to divorce, the halakha is different. The Gemara explains: And Rabba bar Rav Naḥman, who held that the two mishnayot were comparable, had a text of the mishna that also read: He divorced her, instead of: They remove her. Rabba bar Rav Huna asks: Still, is this comparable? Here, the question was raised in a case where the first husband remarried her, which will not strengthen the rumors of her bad reputation, but there, the mishna refers to the man with whom she committed adultery remarrying her, which strengthens those rumors. He said to him: They are certainly comparable to each other: Here, in the mishna discussing one who is suspected of committing adultery, the Sages said that he may not marry her and if he did marry her he must divorce her. So too, the Sages said in the case of one who divorced his wife due to her reputation or vow that he may not take her back, and if he does remarry her he must divorce her.

Ketubot 22a

Ketubot 22a:5

Chachmei Bavel’s passage states that a woman may establish both her prior marriage and subsequent divorce through her own testimony, but not if witnesses establish the marriage; similarly, a woman may testify that she was captive but remained pure, while such testimony is insufficient against witnesses, although she need not leave a husband whom she married before the witnesses arrived.

MISHNA: With regard to a woman who said: I was a married woman and now I am a divorcée, she is deemed credible and permitted to remarry, as the mouth that prohibited and established that she was married is the mouth that permitted, and established that she is divorced. However, if there are witnesses that she was a married woman, and she says: I am a divorcée, she is not deemed credible. Similarly, with regard to a woman who said: I was taken captive but I am pure, as I was not raped in captivity, she is deemed credible and permitted to marry a priest, as the mouth that prohibited and established that she was taken captive is the mouth that permitted and established that she was not defiled. But if there are witnesses that she was taken captive, and she says: I am pure, she is not deemed credible. And if witnesses came after she married, this woman need not leave her husband.

Mishneh Torah, Divorce 2:20

Rambam explains when a husband may be compelled to give a get and how legitimate coercion restores his willingness to fulfill the court’s ruling. This directly addresses the case of a husband who is present but refuses to divorce, a central form of modern agunah advocacy.

Mishneh Torah, Divorce 13:1-29

Mishneh Torah, Divorce 13:2

Rambam codifies the laws of a woman whose husband has disappeared, including the testimony required to permit her to remarry and the safeguards against both permitting a living man’s wife and leaving a widow unnecessarily constrained. This is the central Maimonidean treatment of the classical agunah.

Rashba on Yevamot 87b

Rashba on Yevamot 87b:7

Rashba discusses the evidentiary and legal reasoning behind permitting an agunah to remarry on testimony that would ordinarily be insufficient in other areas. The responsum and novellae tradition illuminate the boundaries of the category.

Shulchan Arukh, Even HaEzer 154:1

This siman codifies grounds for compelling a husband to divorce and the laws of a husband who refuses to give a get. It is the principal practical source for the recalcitrant-husband case, as distinct from the missing-husband agunah of Even HaEzer 17.

These are the [reasons] we force him to divorce her and to give her the ketubah: One who develops bad breath of the mouth or nose, or goes back to become a collector of dog feces, or a tanner, or to a scraper of copper from its source [i.e. a miner]. If she wants, she can stay with her husband. Rem"a: And if she knew [about this problem] before she was married, we do not force him to divorce her, for she understood and accepted it (Tur in the name of the Ramah). If the man becomes afflicted with boils, we force him to divorce her and to give her the ketubah. Even if she wants to stay with him ( Rem"a: Or [even] if she stipulated [that she knew about this] ) we don't listen to her, rather we make them separate against their will, for she exacerbates his condition [if they have sex]. And if she says, "I will stay with him with witnesses [about], so that he does not have sex with me [because they are around]," we listen to her. Rem"a: Some say that [if he becomes] an apostate, we force him to divorce her through non-Jews (Bet Yosef Siman 134 in the name of the O"Ch and the Mordechai Perek Hamegaresh), as long as he voids it at the time of the bill of divorce (ibid Mordechai). Some argue and say that we do not force an apostate [to divorce], or any transgressor against the faith (Teshuvat Mora"m), unless he makes her transgress, for example feeding her prohibited food (Mohry"V Siman 22), or he violates a promise that he made upon himself that he would not tease her or hit her, or he makes a promise and he does not fulfill it, for sons die [as a result] of sins of [violating] vows (Hagahot Maimoni end of Ishut). One who pimps prostitutes, and his wife complains about it, if there are witnesses, and they see him with adulterers or he admits, some say we force him to divorce her, but we do not suspect he caused the bringing of gentile children, for perhaps they are lying about him (Chiddushei Aggudah D'Yevamot). If someones says, "I will not give food nor provide for [my wife]," we force him to give food. And if the court cannot force him to give food, such as one who doesn't have anything to provide and doesn't want to make money to become profitable and provide food [that way], if she wants, we force him to divorce her immediately and giver her her ketubah. The law is such to someone who does not want have sex. Rem"a: Similarly, a man who gets angry often and consistently kicks out his wife from his house, we force him to divorce her, for because of this he will not provide food for her sometimes, and he will separate from her from sexual relations more times than her rights to conjugal relations, and that is like refusal to provide food and sex [which are grounds for divorce] (Teshuvat HaRashba Siman 693). And see earlier Siman 70 and Siman 77. A man who hits his wife, has a transgression in his hand as much as striking his fellow. If he does this often, the court had the right to cause him pain and to excommunicate him, to whip him, to use all types of force, and to make him swear he will not do it again. And if he does not obey the court, some say we force him to divorce her, as long as he is warned one or twice, for it is not the way of Jews to hit their wives, that is the actions of the gentiles. This only applies when he starts it, but if she curses him for no reason, or mocks his father and mother, and she contradicts what he says and he has no authority over her, some say it is permitted to hit her. And some say that a bad wife is [also] prohibited to strike. The first opinion is the essential one. If it is not known who started it, the husband is not believed to say that she started it, for all women are assumed kosher, and they place others among them to see who is the bad one. And if she curses him for no reason, she is divorced without her ketubah. And it seems to me that this is only when this happens often, and after warning, as was explained earlier siman 115. If she left his house and borrowed [money] and ate [food], if she left because of him hitting her so often, he must pay her back (all of this note can be found in the Mordechai Perek Naara in the name of the Mohar"am and the B"Z Siman 88), and as is explained earlier Siman 70. All of these (cases) in which they said he must divorce her, we force him, even with whips. And there are those that say that anyone about whom it was not mandated explicitly in the Talmud that we force him to divorce her, rather only that he should divorce her, we don't force him with whips, rather, we say to him: the sages obligated you to divorce and if you don't, it is permitted to call you a transgressor. Rem''a: And since there is a disagreement of many, it is fitting to be stringent and not force him with whips, in order that there won't be a bill of divorce given under duress. But if he has a wife through sexual immorality, according to everyone, we do force with whips. And in every situation where we do not force with whips, we also do not excommunicate him. And in any case, they can decree on any Jew to not do any kind deeds to him or do any business with him, to circumcise his sons or to bury them until he divorces (her). And any stringency which a Beit Din wants to enact, they can in this type of case, so long as they don't excommunicate him. But one who does not perform his marital duties, we can excommunicate him and banish him in order that he perform this duty or divorce her, because there is no forcing when it comes to marital relations, and so too in similar cases. And so too he who divorces with a kosher bill of divorce and he discredits it a bit, it is permissible to force him to give another bill of divorce. And any situation where we have a disagreement about whether or not to force him, despite the fact that we don't force him to divorce, in any case, we force him to give the value of the bill of marriage immediately, and so too the value of the wedding equipment that he provides for her.

Arukh HaShulchan, Even HaEzer 154

Arukh HaShulchan, Even HaEzer 154:15-18

Arukh HaShulchan explains the circumstances in which a court may require a husband to divorce and the complications created by his refusal. The discussion provides a later halakhic formulation of the agunah problem when the husband is present but withholding a get.

Beit Yosef, Even HaEzer 17

Beit Yosef, Even HaEzer 17:2-4

Beit Yosef surveys the Talmudic and medieval authorities on permitting an agunah to remarry and explains the principles governing testimony about a missing husband. It also helps distinguish this category from a husband who is alive but withholding a get.

Responsa of Rema 36

Responsa of Rema 36:1-2

Rema addresses the legal problem of a husband who refuses to divorce and the mechanisms available within halakhic procedure to compel or pressure the delivery of a get. This is a direct Rishonim-to-Acharonim source for the ‘present but refusing’ form of agunah.

The passage discusses whether a gift or get is effective when the giver is dying, mute, delirious, or mentally impaired, maintaining that lacking דעת at the moment of the act can invalidate it מן התורה, while distinguishing temporary conditions and cases where the person is later examined and found mentally competent.

Shulchan Arukh, Even HaEzer 17:36

Joseph Karo states that people in a besieged city, a ship in distress or a person taken for execution are presumed alive, so testimony cannot establish their deaths to permit their wives to remarry; such cases receive the stringencies of both the laws of the living and the dead.

Rav Eliezer Melamed (Peninei Halakhah, Family 4:19)

Peninei Halakhah, Family 4:19

The passage defines an agunah as a married woman whose husband has disappeared and whose status is unknown, and also discusses cases in which a husband refuses to give a divorce despite her justified demand, for which a court should compel him until he consents.

Iggerot Moshe, Even HaEzer 1:79

The passage discusses a young woman whose husband has no sexual capacity, refuses to divorce her, flees the city, and cannot be reached for a get, arguing that because this condition negates the essential purpose of marriage and was unknown at the time of kiddushin, the kiddushin and possibly the marriage should be annulled as a mistaken transaction.

Gray Matter I, Grappling With the Problem of Agunot, Coercing a Husband to Give a Get

The passage discusses when a beit din may coerce a husband to give a get, including cases involving severe occupational or physical blemishes and marriages that contravene Halachah, such as a kohein married to a divorcee.

Unfortunately, in the midst of a bitter divorce, a husband might sometimes withhold a get (Jewish bill of divorce) from his wife. This chapter discusses when a beit din (religious court) may coerce a husband to give his wife a get and defines what the Halachah considers coercion. And these are forced to divorce: one who is afflicted with boils, one afflicted with severe halitosis, one who gathers dog excrement, a copper miner, and a tanner, regardless of whether these blemishes developed before or after the marriage. The Gemara (ad. loc.) adds that a beit din coerces a husband to give a get when his marriage contravenes Halachah, such as the marriage of a kohein to a divorcee.

Gray Matter I, Grappling With the Problem of Agunot, Hafka'at Kiddushin; Annulment of Marriage

The passage explains that a woman whose husband was lost in waters without finite boundaries remains an agunah because the Rabbis annul a marriage only after the husband has given her an acceptable get.

One may ask why a woman should remain an agunah if her husband was lost in a body of water without finite boundaries (mayim she'ein lahem sof). Let the Rabbis annul the marriage! The answer is that the Rabbis do not annul a marriage unless the man has handed his wife a [rabbinically acceptable] get.
