Once a chazzan has been established in his position, the fundamental rule, as stated by Shulchan Arukh, Orach Chayim 53:25, is that he may not be removed unless a specific disqualification is found — with the Rema adding that mere rumor does not suffice, but confirmed testimony of serious misconduct, persistent foul speech, or refusal to present himself respectably does justify removal.

Shulchan Arukh HaRav, Orach Chayim 53:23 extends this principle further, ruling that even after acceptance the majority may retract, and that if a chazzan has been removed and the position stood vacant with communal agreement for a period of time, any subsequent reappointment is treated as an entirely fresh acceptance — meaning even a minority may then object; the Magen Avraham (53:7) and the Mishnah Berurah (53:15) both confirm this rule, adding that if those objecting are the communal leadership, their objection carries the weight of the entire congregation.

The Arukh HaShulchan (Orach Chaim 53:21) draws a significant practical distinction for the modern era: since the contemporary chazzan is a paid communal official performing a broad set of ceremonial functions rather than simply leading the congregation in its daily prayers, the older rule permitting even an individual to block an appointment no longer applies — when the majority of the community wishes to engage a particular chazzan, the minority cannot obstruct them, though the minority retain the right to demonstrate that the candidate is genuinely unfit.

MISHNA: This mishna and the next one deal with the communal prayer leader. (If one says: “May the good bless You,” this is a path of heresy.) One who is passing before the ark, as prayer leader, and erred, another should immediately pass in his place, and at that moment, this replacement should not refuse in the interest of courtesy. The Amida prayer was interrupted and he should replace him as quickly as possible. From where does the replacement commence? From the beginning of the blessing in which the former had erred. GEMARA: The mishna teaches that one who replaces a communal prayer leader who erred in the middle of the Amida prayer should not refuse when approached. The Gemara cites the general halakha with regard to proper conduct when one is approached to serve as prayer leader. The Sages taught in a baraita: One who is approached to pass before the ark to serve as prayer leader, for the sake of propriety should refuse, to avoid creating the impression that he is too eager. And if he does not refuse, but jumps at the opportunity, he is like cooked food without salt, which is to say that he acts in bad taste. However, if he refuses too much this is similarly inappropriate, as he is like cooked food that was ruined by too much salt. So how should he act? The appropriate conduct when approached to serve as communal prayer leader is as follows: When approached the first time, one should refuse; the second time, one should vacillate like a wick that has just begun to catch a flame but is not yet burning; and the third time, he should stretch his legs and descend before the ark.

The Gemara asks a question concerning the explanation of Rabbi Yehuda: One who has dependent children and does not have anything with which to support them is apparently the same as one whose house is empty. Why does Rabbi Yehuda list both descriptions? Rav Ḥisda said: This expression means that his house is empty of transgression. And Rabbi Yehuda further said that the prayer leader must be one whose youth was becoming. In explanation of this phrase, Abaye said: This is one who did not have a bad reputation at any time during his youth. The Gemara cites a verse in relation to the prayer leader: “My heritage has become to me as a lion in the forest. She has uttered her voice against me; therefore I have hated her” (Jeremiah 12:8). What is the meaning of the phrase: “She has uttered her voice against me”? Mar Zutra bar Toviyya said that Rav said, and some say Rabbi Ḥama said that Rabbi Elazar said: This is an unworthy prayer leader who descends before the ark. When this person calls out to God, He thinks, so to speak: I hate the sound of his prayer.

The Sages taught in a baraita: They stood for prayer, and even if there is a man there who is elderly and a scholar, they appoint to descend before the ark as prayer leader only a person who is accustomed to lead in prayer. Who is considered an accustomed prayer leader in this sense? Rabbi Yehuda says: One who has financially dependent children but he does not have the means to support them, and he has no choice but to toil in the field, and whose house is empty, and who will therefore pray for rain with great devotion. Rabbi Yehuda continues with his depiction of the worthy prayer leader. And his youth was becoming, and he is humble and accepted by the people, as he is likable. And furthermore, he must be familiar with songs and his voice pleasant, and he is expert in reading the Torah, the Prophets, and the Writings, and he knows how to study midrash, halakha, and aggada. And finally, he must be expert in all of the blessings. Clearly, it is hard to find someone with all these qualities. And the Gemara relates that when this worthy person was described, those Sages present turned their eyes toward Rav Yitzḥak bar Ami, who possessed all of these virtues.

When those assisting an unsuitable chazzan support him, the passage teaches that the Holy One withholds good from the community and holds these assistants accountable as if they stole benefit from the congregation; therefore, if a man is wicked in his deeds or causes disputes, even if he knows how to lead prayers pleasantly and wants to serve as chazzan to discharge the public's obligation or knows how to sound the shofar, the righteous should not permit him to do so, because no accuser should become a defender, and thus if a more righteous person is available to serve as chazzan, that worthier person should be chosen instead.

We do not remove a chazzan from his job, unless we find in him some disqualification. Rem"a: And we do not remove him just because of slander - for example, that word went out about him that he was caught with a non-Jewish woman or that he informed [to the authorities] against a person. When a chazzan has already been appointed and established in that role with communal consent, he cannot be removed merely because the congregation is now dissatisfied with him, unless a clear defect (such as a persistent flaw in his voice) emerges that even a single dissenter may object to; however, if he committed a transgression and repented, the congregation cannot remove him according to all opinions, and if someone previously removed from the position is later proposed for reappointment after years have passed, even a minority may object as if to a new appointment. A chazzan involved in dispute or enmity with a member of the congregation should bring the matter before the rabbi or community for resolution rather than engaging in quarrel.

If the majority of the community does not consent to someone serving as their rabbi or holding office, he has no authority over them by virtue of inherited right, and anyone who opposes this appointment acts wrongfully and causes the community distress; conversely, if the community has consented to someone—even if their reason is to honor their deceased rabbi or because of ancestral merit—one who contradicts this acts unjustly, and in every city the appointed leader need not be the greatest scholar, since sometimes someone acceptable to the community is preferable to scholars who are greater in Torah, so that the community should not suffer loss for the sake of one or two individuals.

[כי גירסת הספרים יכול יהיו אסורים במלאכת עבודה אין לו ביאור כמו שהאריך הרמב"ן ז"ל]. אולם, מה שפי' המפ' בדברי ר' יוסי הגלילי שדרש "כל מלאכת עבודה לא תעשו שבעת ימים תקריבו אשה" מקרא נדרש לאחריו – מלאכת עבודה לא תעשו שבעת ימים, לא יעלה כפי המסילה אשר בה נלך להוציא הדרשות ממקור הכתוב ויסודי הלשון. ולפי דעתי דברי ר' יוסי הגלילי מוצקים על אבן פינה כי בשבת ויום הכפורים כתוב תמיד "כל מלאכה לא תעשו", וביום טוב כתוב תמיד "כל מלאכת עבודה לא תעשו". וכבר בארנו זה למעלה מפני שמלאכת אוכל נפש הותרה ביום טוב, שינה וכתב "מלאכת עבודה" שהיא מלאכה שיש יגיעה ועבודה רבה. וידוע שדעת כמה פוסקים שמלאכה שדרך לעשות על ידי עבדים אסורה ביום טוב מן התורה, אף לצורך אוכל נפש, דזה נקרא "מלאכת עבודה". ובשבת ויום הכפורים שכל עסק אסור אף לצורך אוכל נפש כתוב "כל מלאכה לא תעשו". אף שיש גם מלאכות קלות שאסורות ביום טוב כל שאינם לצורך אוכל נפש, לא יכול לכתוב "כל מלאכה לא תעשו" כיון שיש מלאכות מותרות. אבל כתב "כל מלאכת עבודה לא תעשו" שהם כולם אסורים וגילה דבר זה בפר' בא שכתב "כל מלאכה לא יעשה בהם אך אשר יאכל לכל נפש הוא לבדו יעשה לכם" שכיון שאמר "כל מלאכה" הוצרך להוציא מלאכת אוכל נפש שהיא מלאכה, מה שאין כן בכל מקום שכתוב "מלאכת עבודה" אין אוכל נפש בכלל. אולם פעם אחד מצאנו שאמר ביום טוב "מלאכה", מה שכתוב בפ' ראה (טז ח) "ששת ימים תאכל מצות וביום השביעי עצרת לה' אלקיך לא תעשה מלאכה". אולם דייק ולא כתב "לא תעשה כל מלאכה", שזה אינו, דיש מלאכות מותרות והם מלאכת אוכל נפש, רק אמר "לא תעשה מלאכה" היינו שיש מלאכות אסורות, מה שאינם אוכל נפש. אולם יקשה למה לא אמר כמו בכל מקום "לא תעשה כל מלאכת עבודה"? על זה הוסד הדרוש המובא בחגיגה שם "ששת ימים תאכל מצות וביום השביעי עצרת" מה שביעי עצור וכולי שתפס "מלאכה" לתת הבדל בין שביעי לששת הימים, שבששת הימים מלאכה מותרת ובשביעי נאסר גם מלאכה. ולכן לא יכול לאמר "מלאכת עבודה" שזה אסור גם בששת הימים. ומזה הוכיח מה שביעי עצור וכולי אי מה שביעי עצור בכל מלאכה ר"ל אף מלאכת דבר האבד ת"ל "וביום השביעי עצרת", ועיקר הדיוק מסוף הפסוק "לא תעשה מלאכה", הרי לא הבדיל ביניהם רק בעשיית מלאכה, שלענין זה רק שביעי לבד עצור אבל לענין "מלאכת עבודה" גם ששת ימים עצורים. ופירוש הכתוב ביום השביעי עצרת לענין שלא תעשה מלאכה אבל לענין מלאכת עבודה כל הימים עצורים. ור' יוסי הגלילי דייק זה הדיוק עצמו ממה שכתוב תמיד גבי יום טוב "ביום הראשון מקרא קדש כל מלאכת עבודה לא תעשו" וכן אמר בשביעי ובשמיני, ודייק מלת "כל", שמלת "כל" הבא בשלילה הוא שלילה כללית. וזה המבדיל בין יום טוב ובין חולו של מועד במה שביום טוב נאמר "כל מלאכת עבודה" מבלי הבדל, ובחולו של מועד לא נאסרו כולם, ויסד הדרוש על מה שכתוב "עצרת היא כל מלאכת עבודה לא תעשו" שפירושו עצרת היא, שיעצרו את עצמם מלעשות מלאכה. ואם כן מה שהוסיף "כל מלאכת עבודה לא תעשו" היא כפל לשון ומבואר שבא לפרש לענין מה נקרא השמיני לבדו "עצרת" נגד הימים שלפניו, שימי חולו של מועד גם כן אסורים בעבודה ונעצרים בהם מעסקיהם, רק שיום זה "עצרת" נגד ימים שלפניו במה ש"כל מלאכת עבודה לא תעשו", ובימי חולו של מועד מקצת עבודות מותרות. ולפי זה פסוק זה מתאחד עם מה שכתוב בפ' ראה "ויום השביעי עצרת", כי יפלא למה קרא לשביעי של פסח ולשמיני של חג בשם "עצרת" ולא קרא כן לימי החג הראשונים ולחג השבועות, וגם הם עצורים בעשיית מלאכה? רק כי "עצרת" נתיחד לימים אלה על שהם אחר ימי חולו של מועד, שגם הוא אסור במקצת מלאכות, אמר כי ביום החג האחרון "עצרת", שהיא המניעה לגמרי, אף ממקצת מלאכה שהיו מותרים בחולו של מועד. ובאר זה בשמיני של סוכות במה שכתב "כל מלאכת עבודה לא תעשו" ובשביעי של פסח במה שכתב "לא תעשה מלאכה". ור' עקיבא הוכיח זה ממה שכתב "אלה מועדי ה' אשר תקראו אותם מקראי קדש להקריב אשה לה' " שקאי על כל ימי מועד שמקריבים בהם "אשה", וקורא אותם "מקראי קדש", הרי מיוחדים לקדושה ולהבדל בהם מקצת מלאכות. שאין לומר שמוסב רק על יום ראשון ויום שמיני ופירושו שמקצתם תקראו קדש ומקצתם להריב אשה, שאז היה לו לומר "אשר תקראו מקראי קדש ותקריבו אשה לה' ". וכן אין לומר שהכל קאי רק על ימי החג לבד דהא אמר "מלבד שבתות ה' " הרי שכבר כלל ימי חולו של מועד מדלא אמר "מלבד שבתות ה' וימי המועד" שגם כן מקריבים אשה. וז"ש שנאמר "מלבד שבתות ה' " גם יש לפרש ראיית ר' עקיבא על פי ההבדל שיש לי בין מלת "מלבד" ובין מלת "על" שמשמש כטעם מלבד. שמלת "על" מורה שהדבר שהוציא ושרמז עליו במלת "על" היא עיקר, אם בכמות, אם בחשיבות. ולא כן מלת "מלבד", אינו מציין דבר עיקרי או מרובה בכמות. ואם הפירוש של מה שכתוב "אלה מועדי ה' " רק על יום טוב היה לו לומר "על שבתות ה' " כיון שהכבשים של השבתות מרובים מן הכבשים של היום טוב. ומוכח שמ"ש "אלה מועדי ה' " קאי על כל ימי המועדות, וכבשיהם מרובים מן כבשי השבתות, לכן אמר "מלבד". ובגמ' לא גריס ונאמר "מלבד שבתות ה' ". וכן שאם תאמר כן למה חזר לאמר "ביום הראשון שבתון וביום השמיני שבתון"? שכבר אמר זה למעלה "ביום הראשון מקרא קדש וכולי". ומבואר שמה שכתב "אלה מועדי ה' " כלל כל ימי המועד והורה שכולם נקראים מקראי קדש לאסור בקצת מלאכות ולכן הוכרח לומר שנית "ביום הראשון שבתון", ר"ל הגם שימי המועד דומים ליום ראשון ושמיני בשם "מקרא קדש", יום הא' והח' נבדל מהם שנקרא "שבתון" שהוא הביטול מכל עסק, אף ממלאכת דבר האבד.
