Critically, the Shulchan Arukh (Orach Chayim 124:4) adds a further dimension: even once the repetition has begun, if fewer than nine of the ten men present are attentively listening to the chazzan's blessings, his blessings are nearly in vain — meaning that having ten present who are actively focused is not merely a formal threshold for starting but an ongoing condition for the repetition to be meaningful.

The Chayei Adam (30) emphasizes that even in a pressing situation it is forbidden to include a minor to complete the ten, and the Kitzur Shulchan Arukh (15:1) rules that the congregation should wait up to close to half an hour for a tenth man to arrive before proceeding without one, since Kaddish and Kedushah cannot be said at all without ten adult men.

The connotation of ten associated with the word among written in the portion of Korah is, in turn, derived by means of another verbal analogy between the word congregation written there and the word congregation written in reference to the ten spies who slandered Eretz Yisrael: “How long shall I bear with this evil congregation?” (Numbers 14:27). Likewise, with regard to communal prayer, if the congregation was in the large courtyard, and the prayer leader was in the small one, they fulfill their obligation through his prayer, as the congregation is considered to be in the small one as well. However, if the congregation was in the small courtyard, and the prayer leader was in the large one, they do not fulfill their obligation. The same principle applies to a prayer quorum: If there were nine men in the large courtyard and one man in the small one, they join together to form the necessary quorum of ten, as the small courtyard is subsumed within the large one, and the individual is considered to be in the large courtyard. However, if there were nine men in the small courtyard and one in the large one, they do not join together.

After [completing] Yishtabach the chazzan says half-Kaddish. Kaddish, Barechu and Kedushah cannot be said and the Torah cannot be read unless there are ten adult men present. If ten men were not present when Yishtabach was said but, the minyan was completed afterwards, then, the chazzan may not say Kaddish, because Kaddish is said only following something that was said by ten men. They should, therefore, wait to say Yishtabach until ten [men] arrive. They may wait until almost a half-hour. They should not wait longer, but, rather, they should say Yishtabach and then wait. When ten [men] arrive they should first say a few verses, and afterwards the chazzan says half-Kaddish. If there are not nine [men] listening to the chazzan he should not say Kaddish at all because a sacred prayer should not be said with less than ten; that is one reciting and nine listening. Nevertheless, if one of the ten is in the middle of his Shemoneh Esrei although he cannot respond with them he may be counted [in the ten]. The same applies to two, three or four, [who are in mid Shemoneh Esrei] as long as there is a majority responding, then the response of the minority is not a necessity. However, if one of them is asleep, he should be wakened because one who is sleeping cannot be counted in the ten.
