Rav Chaim Brisker on Witnesses in Gittin

Rav Chaim Brisker addresses the apparent tension between the principle that one witness is believed in matters of prohibition and the requirement for witnesses or certification in the validity of a get. The sources explore the conceptual and procedural distinction between evidentiary trust in issurin and the formal role of witnesses in creating or validating documents of personal status.

What the sources say

The Gemara itself raises the tension the question points to: having established that one witness suffices to testify about a woman's marital status because of the principle that an ed echad is believed in matters of issur, Gittin 2b then asks why a get nonetheless requires two witnesses, and answers that where a prohibition is already established (like a married woman's status as an eshet ish), the matter becomes a 'davar sheb'erva,' which can never be established by fewer than two witnesses.

This distinction is rooted in the same principle discussed in Yevamot 88a, where the Gemara likewise contrasts an unestablished doubt (like a piece of meat that might be forbidden fat) with a case where the prohibition is already established, concluding that an established ervah status demands two witnesses even where an ordinary issur would be resolved by one.

Tosafos on Tosafot on Gittin 2b frames the entire difficulty by first explaining why one witness is believed even against an established chazakas issur in cases like shechitah and terumah, since the witness is one who could himself have remedied the matter — a point also drawn out by Rashi on Gittin 2b and by the halachic codification in Mishneh Torah, Testimony 11:7 and Shulchan Arukh, Yoreh De'ah 127:3, which likewise affirm that an ed echad is believed in issurim though disqualified for other testimony.

Chiddushei HaGrach (Jerusalem 1952) siman 11 directly addresses Tosafos's question and offers the resolution associated with Rav Chaim Brisker: a single witness can establish the factual matter of a shtar for evidentiary purposes, but cannot create the formal legal kinyan-status of the shtar itself, and it is this latter, constitutive function — not mere clarification of fact — that a get requires two witnesses for.

Chiddushei Rabbeinu Chaim HaLevi, Divorce 6:9 develops a parallel distinction regarding shelichus for divorce, arguing that where the act of shelichus is treated as equivalent to the divorce itself, mere evidentiary proof (such as the husband's handwriting) does not suffice, and the law requires actual witnesses or a mechanism carrying Biblical neemanus, rather than just evidentiary 'birur'; this generalizes the same conceptual divide between birur (clarification) and constitutive legal creation found in siman 11.

Chiddushei Rabbeinu Chaim HaLevi, Testimony 3:4 extends this framework to shtaros generally, explaining that the special din of 'eidim hachasumin al hashtar na'aseh k'mi shenechkera eduseihen b'beis din' removes shtaros from the ordinary halachos of kabbalas eidus, which supports treating the two-witness requirement for a get's shtar-function as structurally distinct from ordinary testimonial neemanus of one witness in issurim.

Ketzot HaChoshen on Shulchan Arukh, Choshen Mishpat 241:1 similarly distinguishes the function of witnesses as establishing matters 'publicly,' and discusses how, once there are witnesses to the essential matter, the mesirah itself can be the operative act of kinyan — a distinction in the role of witnesses analogous to the birur/constitutive divide invoked in resolving Tosafos's question.

Other Rishonim and Acharonim sharpen and apply the same contrast: Ketubot 22a establishes the parallel principle that 'the mouth that forbade is the mouth that permitted' only where there are no contradicting witnesses, Pnei Yehoshua on Gittin 2b records Rabbeinu Tam's own formulation of the difficulty that the essential get-requirement of two witnesses should itself prove the point, and Bach, Even HaEzer 141:23, Beit Yosef, Even HaEzer 141:9, and Arukh HaShulchan, Even HaEzer 141:144 work through the practical two-witness requirements for various stages of get transmission and cancellation.

Chiddushei Rabbeinu Chaim HaLevi, Divorce 12:21 further grounds the two-witness requirement in the independent Biblical din of eidus derived from 'al pi shenayim eidim,' teaching that once a matter is subject to the formal category of eidus, the rule that two witnesses outweigh even a hundred disqualified witnesses applies, and that this status is categorically distinct from the rules of rov and birur that govern ordinary neemanus in issurim.

Shoel uMeshiv Mahadura V 30:2 and Shoel uMeshiv Mahadura IV 3:70 both wrestle with related questions of whether testimony about a person's status or about the mechanics of transmission requires one witness or two, reflecting the same underlying distinction between testimony that merely clarifies a fact and testimony that functions as formal eidus.

Shevet HaLevi 2:55 takes up the very dispute underlying Tosafos's question, examining whether an ed echad is believed when an issur already has an established status, and setting out how the Ramban, Rashba, and others distinguish between permitting what is prohibited and prohibiting what is permitted, and how this bears on testimony in matters of ervah.

Igros Moshe YD 2:127 holds that a get requires witnesses for its formal validation as understood by Tosafos and Rashi, and further suggests that even where witnesses are physically present, their testimony may not satisfy this formal requirement if the relevant party is unaware of them, a point he applies to both gittin and kiddushin.

Teshuvos V'hanhagos 3:393 surveys the broader question of whether witnesses are required in such cases, citing the Or Sameach's unresolved doubt and the Marcheshes's position that the matter turns on a dispute between the Rambam and the Raavad, alongside related treatments by Tosafos Ri HaZaken, the Haflaah, and the Avnei Nezer.

Igros Moshe YD 1:65 draws essentially the same line as the Brisker resolution, distinguishing testimony that merely clarifies an already-existing status, for which one witness suffices in matters of issur, from testimony that creates a new obligation or compels the court to act, which requires two witnesses, applying this to cases including circumcision, the korban tamid, and testimony concerning a get.

Responsa on this question

Shevet HaLevi (Shevet HaLevi 4:163) — Shevet HaLevi addresses whether a get requires two witnesses when one witness is believed regarding prohibitions, examining this question through the lens of whether one witness can be trusted to testify about a woman's marital status and the conditions required for a get's validity, but does not provide a definitive resolution to the Tosafos question cited.

GEMARA: The Sages taught in a baraita (Tosefta, Terumot 2:2): If one was preparing ritually pure food with another, and he said to him: The ritually pure food that I prepared with you became ritually impure, or if he was preparing sacrifices with another person, and he said to him: The sacrifices that I prepared with you became disqualified due to improper intention, he is deemed credible with regard to these claims. But if he said to the other: The ritually pure food that I prepared with you on such and such a day became ritually impure, or the sacrifices that I prepared with you on such and such a day became disqualified due to improper intention, he is not deemed credible. The Gemara asks: What is different in the first clause of the baraita and what is different in the latter clause, that in the first clause he is deemed credible, whereas in the latter clause he is not? Abaye says that the principle is as follows: As long as it is still in his power to do what he said he had done, he is deemed credible. Therefore, while he is involved in the preparation of the ritually pure food or the sacrifices, and consequently he is still able to disqualify them, he is deemed credible when he says that they already became disqualified. But once he makes a statement about actions he performed in the past and he is no longer able to disqualify the objects of those actions, he is not deemed credible.

Ketubot 22b

Ketubot 22b:5-7

The Gemara applies the principle of one witness's reliability in a woman's personal-status claim and distinguishes ordinary claims of prohibition from cases requiring two witnesses or stronger proof.

The Gemara asks: What is different in the first clause of Rabbi Yoḥanan’s statement, where, if she remarried, she need not leave her husband, and what is the different in the second clause, where, if she remarried, she must leave her husband? Abaye said: Interpret Rabbi Yoḥanan’s statement in a case where each testimony was given by one witness. If one witness says: The husband died, the Sages instituted an ordinance and accorded him credibility like that of two witnesses in order to enable his wife to remarry. And that is in accordance with the opinion of Ulla, as Ulla said: Wherever the Torah deemed one witness credible, his legal status there is that of two witnesses. And the legal status of that second witness who says: He did not die, is that of one witness, and the statement of one witness has no validity in a place where there is the testimony of two witnesses. Therefore, she need not leave her husband. The Gemara asks: If so, that this is a case of the testimony of two witnesses against the testimony of one witness, it should be permitted for her to remarry even ab initio. The Gemara answers that she may not remarry ab initio due to the opinion of Rav Asi, as Rav Asi said that in any case of uncertainty, the verse “Remove from you a crooked mouth, and perverse lips put far from you” (Proverbs 4:24) applies. Although it is not a strictly prohibited action, it is, nevertheless, inappropriate. In the latter clause of Rabbi Yoḥanan’s statement, where one witness says: This woman was divorced, and one witness says: She was not divorced, both of them are testifying that she was a married woman, and that witness who says: She was divorced, is one witness, and the statement of one witness has no validity in a place where there is the testimony of two witnesses. Therefore, even if she remarried she must leave her husband.

Kiddushin 80a

Kiddushin 80a:2-3

The sugya addresses reliance on a single person's testimony concerning prohibited relationships and personal status, distinguishing ordinary presumptions and prohibitions from matters that require formal testimony.

The Gemara comments: And Rabbi Yoḥanan follows his standard line of reasoning, as Rabbi Ḥiyya bar Abba says that Rabbi Yoḥanan says: The court flogs one about whom witnesses testify that he violated a prohibition on the basis of presumptive status, even if there is no testimony to definitively establish that the person violated a prohibition, as will be explained. Similarly, the court stones or burns one about whom witnesses testify that he violated a prohibition resulting in court-imposed capital punishment on the basis of presumptive status. But one does not burn teruma on the basis of presumptive status unless there is testimony that it became ritually impure. How so? The court flogs one about whom witnesses testify that he violated a prohibition on the basis of presumptive status, in accordance with the opinion of Rav Yehuda. As Rav Yehuda says: If a woman had among her neighbors the presumptive status of a menstruating woman, and witnesses testified that her husband engaged in sexual intercourse with her, he is flogged due to her status as a menstruating woman, and there is no need for testimony that she was a menstruating woman.

Bava Metzia 28:1

Rava begins his statement and says: If you say that identification of an item on the basis of distinguishing marks is by Torah law. The Gemara interjects: If you say? Didn’t he already resolve the dilemma and conclude that identification of an item on the basis of distinguishing marks is by Torah law? The Gemara answers: Rava phrased his statement conditionally due to the fact that although he holds that identification of an item on the basis of distinguishing marks is by Torah law, one could reject his conclusion and say as we explained previously (27b), that when the mishna states that the finder scrutinizes whether he is a swindler, he does so on the basis of witnesses and not on the basis of distinguishing marks. The Gemara resumes Rava’s interrupted statement: If you say that identification of an item on the basis of distinguishing marks is by Torah law, then in a case where an item is found and two people claim it as theirs, and one describes distinguishing marks on the item and the other describes distinguishing marks on the item, the finder shall leave it in his possession and not give it to either claimant. In a case where one person describes distinguishing marks on the item and the other brings two witnesses to support his claim of ownership, the item shall be given to the claimant with witnesses. In a case where one person describes distinguishing marks on the item and the other describes distinguishing marks on the item and brings one witness to support his claim of ownership, the one witness is as one who is not there, and the finder shall leave it in his possession. The testimony of a single witness has no legal standing in this case.

These three bills are: A bill of divorce that the husband wrote in his handwriting but has no signatures of witnesses on the document at all, a case where there are signatures of witnesses on the document but there is no date written on it, and a case where there is a date written on it, but it contains only one witness. These are the three invalid bills of divorce with regard to which the Sages said: And if she marries, the lineage of the offspring is unflawed. Rabbi Eliezer says: Even though there are no signatures of witnesses on the document, but he handed it to her in the presence of two witnesses, it is a valid bill of divorce. And on the basis of this bill of divorce the woman can collect the amount written for her in her marriage contract even from liened property, as Rabbi Eliezer maintains that the witnesses sign the bill of divorce only for the betterment of the world. If no witnesses sign a bill of divorce the husband can contest its validity at any time by denying that he wrote it. Nevertheless, the witnesses’ signatures are not an essential part of a bill of divorce.

And if there are those who contest it, i.e., if the husband objects by saying that the bill of divorce is a forgery, it should be ratified through its signatories. The court must authenticate the signatures of the witnesses in order to ratify the document. GEMARA: The mishna teaches that one who brings a bill of divorce from a country overseas to Eretz Yisrael must say: It was written in my presence and it was signed in my presence. Gittin 21b-22a

Gittin 21b-22a

The Talmud analyzes the requirement that a get be written for the sake of the woman and discusses the relationship between writing, signing, and the get's validity.

And so Rabbi Elazar says that Rabbi Oshaya says: And this is a case where he left a place for the essential part of the document. And so Rabba bar bar Ḥana says that Rabbi Yoḥanan says: And this is when he left a place for the essential part of the document. And all these Sages hold that the mishna is in accordance with the opinion of Rabbi Elazar, who says: Witnesses of the transmission of the bill of divorce effect the divorce. It is not the signatures of the witnesses on a bill of divorce that validate it. Rather, the divorce is effected by the transmission of the document in the presence of witnesses. Therefore, the phrase: “And he writes” (Deuteronomy 24:1), must be referring to the writing of the bill of divorce and not to the signing of the witnesses, and the restrictions derived from this verse will apply to the writing of the bill of divorce, so the essential part may not be written on something that is attached to the ground. And Reish Lakish says: The mishna should not be understood in that way, where the phrase: And signed it, is referring to the writing of the essential part, since we learned that they signed it, which is referring to the signatures of the witnesses. And it is taught in accordance with the opinion of Rabbi Meir, who says that the signatory witnesses on the bill of divorce effect the divorce. And this is what the mishna is saying: One may not write the essential part on something that is attached to the ground due to a rabbinic decree, lest he also have the witnesses sign while it is attached. However, even if he wrote the essential part while it was attached, then detached it, had it signed, and gave it to her, it is valid. According to Rabbi Meir, when the verse states: “And he writes her,” it is referring to when he has the bill of divorce signed. Therefore, by Torah law, the limitation that it not be attached while he writes applies only to the signing but not to the writing. The Sages decreed that the essential part of the bill of divorce also not be written while it is attached to the ground, but if he violated this decree, it is still valid after the fact.

§ Rabbi Zeira says that Rabba bar She’eilta says that Rav Hamnuna the Elder says that Rav Adda bar Ahava says: The dispute between ben Nannas and Rabbi Akiva with regard to a bare bill of divorce that has more tied folds than witnesses is only in a case where its ties total seven and its witnesses total six, or its ties total six and its witnesses total five, or its ties total five and its witnesses total four, or its ties total four and its witnesses total three. But if its ties total three and its witnesses total two, everyone, even ben Nannas, agrees that not all disqualified witnesses can complete it. Rather, only a relative can complete it. Rabbi Zeira said to Rabba bar She’eilta: After all, all three witnesses in a folded and tied bill of divorce are like the two witnesses in an ordinary bill of divorce, since the Sages said that a folded and tied bill of divorce requires at least three witnesses. Therefore, just as there, in the case of an ordinary bill of divorce, a relative cannot serve as one of the two witnesses, so too here, a relative should not serve as one of the primary witnesses. Rabba bar She’eilta said to him: To me as well this was difficult, and I asked that question to Rav Hamnuna, and Rav Hamnuna asked it to Rav Adda bar Ahava, who had transmitted this statement, and he said to him: Leave the case of three witnesses in a folded and tied bill of divorce, as the requirement is not by Torah law. While the requirement to have a minimum of two witnesses in an ordinary bill of divorce is by Torah law, the requirement to have a minimum of three witnesses for a folded and tied bill of divorce is by rabbinic law. Consequently, it is of no concern if the third witness is not fit to bear witness.

How can there be a divorce whose status is uncertain? It is in the cases of invalid bills of divorce mentioned in the mishna here: A bill of divorce that the husband wrote in his handwriting but has no signatures of witnesses on the document at all, a case where there are signatures of witnesses on the document but there is no date written on it, and a case where there is a date written on it but it contains only one witness. In each of the three cases, this is considered a divorce whose status is uncertain. § It is stated in the mishna that Rabbi Elazar says: Even if there are no signatures of witnesses on the document, but rather he handed it to her in the presence of two witnesses, it is a valid bill of divorce. Rav Yehuda said that Rav said that the halakha is in accordance with the opinion of Rabbi Elazar with regard to bills of divorce. But when I said this halakha before Shmuel, he said that the halakha is in accordance with Rabbi Elazar with regard to monetary documents as well.

This dispute pertains to the halakhot of Shabbat. With regard to the signing of documents, Reish Lakish raised a dilemma before Rabbi Yoḥanan: If there are witnesses who do not know how to sign their names, what is the halakha: May their names be written for them with red dye, and afterward they will sign on top of it in ink? The question is: Is the upper writing, which was not directly on the document but on top of other ink, considered to be writing, or is it not writing? He said to him: It is not writing. Consequently, this may not be done for witnesses who do not know how to sign. Reish Lakish said to him: Didn’t our master, i.e., Rabbi Yoḥanan, teach us that the upper writing is considered to be writing with regard to the halakhot of Shabbat? Rabbi Yoḥanan said to him: And because we compare the halakhot pertaining to bills of divorce to the halakhot of Shabbat, shall we perform an action and teach that a bill of divorce may be written in this manner? § It was stated that there was a dispute with regard to the following question: What should be done for witnesses who do not know how to sign? Rav says: One tears blank paper for them, meaning that a stencil of their names is fashioned from blank paper and placed on the bill of divorce. The witnesses then fill in the gaps with ink so that their names appear on the document. And Shmuel says: One first writes their names on the document with lead, and the witnesses write over those letters.

Arachin 31b

Arakhin 31b:6-7

This sugya addresses the redemption of houses in walled cities and the significance of the final day, the basis of Rav Chaim's chiddush in Chiddushei HaGrach siman 1.

Rabbi Abba bar Memel says: If one sold two houses of walled cities, one on the fifteenth day of the first month of Adar in a leap year, and the other one on the first day of the second Adar, then the halakha is as follows: With regard to this house that he sold to him on the first day of the second Adar, once the first day of Adar of the next year arrives, it is counted as though a full year has elapsed. With regard to this house that he sold to him on the fifteenth day of the first Adar, it is not counted as though a full year has elapsed until the fifteenth day of Adar of the next year. Ravina objects to this: But let the first buyer say to the second: I preceded you and kindled a fire before you, i.e., I bought my house before you acquired yours. How, then, can you gain possession in perpetuity before me? The Gemara responds: This is due to the fact that the second buyer can say to him: You descended to the house during the intercalated month, i.e., the first Adar, and as it is taught in the mishna, the seller has the right to redeem the house for an entire year, including the intercalated month.

The discussion of validating documents supplies the Talmudic background for Rav Chaim's treatment of document authentication in Chiddushei HaGrach siman 5.

§ Rav Yehuda said that Shmuel said: If a document came before a court and the court ratified it, and then the document was produced in order to collect the debt, at which time the borrower contested its validity and claimed that it was forged, one witness who was a signatory on the document and a judge who ratified the document join together to testify that the document is valid. Rami bar Ḥama said: How excellent is this halakha. Rava said: In what way is that excellence manifested? That which the witness testifies, i.e., authenticating his signature and confirming the incident that he witnessed, the judge does not testify, as the judge testifies that the document was ratified. And that which the judge testifies, the witness does not testify. There are not two witnesses testifying to either matter.

Bava Kamma 13a:15

The sugya considers liability for damage caused by a shelamim and collection from sacrificial meat, corresponding to Rav Chaim's analysis in Chiddushei HaGrach siman 6.

§ Rabbi Abba says: With regard to the case of an innocuous animal that was consecrated as a peace-offering and that caused damage, the injured party collects damages from its meat, i.e., from the portion of the offering that would have been eaten by its owners. This is in accordance with the general halakha that the payment for damage caused by an innocuous ox is collected exclusively from the proceeds of the sale of the body of the ox and not from any other property of its owner. But he does not collect the damages from the sacrificial portions. The Gemara answers: No, it is necessary for Rabbi Abba to teach that there is no collection from the owner’s meat portions corresponding to the sacrificial portions. Payment for damage caused by an innocuous animal is half the amount of the damages, and can be no more than the value of the animal itself. Rabbi Abba is teaching that when assessing the damage to determine the amount to be paid, one deems the owner responsible only according to his share of the animal, i.e., the meat portions, in relation to the animal as a whole. The Gemara explains: If you wish, say Rabbi Abba’s ruling is in accordance with the Rabbis, as one might have thought that this matter, the ruling of the Rabbis, applies only where the damage is caused by two bodies, such as an ox and a pit. But where the damage is caused by one body, as in the case of damage caused by an animal consecrated as a peace-offering, the injured party can say to the owner of the animal: From anywhere that I want to, I will recover my losses, and accordingly, the injured party could collect the full cost of the damage from the meat portions of the one who brought the offering. Therefore, it is necessary for Rabbi Abba to teach that this is not the halakha.

Bava Metzia 61a

Bava Metzia 61a:7-9

The Talmud compares the prohibitions of theft, interest, and overcharging, a passage connected to Rav Chaim's analysis of their distinct legal structures in Chiddushei HaGrach siman 9.

§ Rava said: Why do I need it to be that the Merciful One writes a prohibition with regard to interest, a prohibition with regard to robbery (see Leviticus 19:13), and a prohibition with regard to exploitation (see Leviticus 25:14), a transaction where one of the parties overcharged or underpaid? There appears to be one principle underlying all three prohibitions: One must not take possession of another’s money in illegitimate ways. The Gemara explains: They are necessary. As, had the Merciful One written the prohibition only with regard to interest, one could not have derived the other prohibitions from it because it is a prohibition with a novel element that does not appear in other halakhot. This novel element is that the Merciful One prohibited a loan with interest even for the borrower. With regard to the two other prohibitions, there is a prohibition against taking another’s money, but there is no prohibition for the victim, who has his money taken. And had the Merciful One written the prohibition only with regard to robbery, one could not have derived the other prohibitions from it, as perhaps robbery is prohibited only due to the fact that it is an action taken against the will of the victim. But in the cases of exploitation and interest, where there is an element of consent, one would say they are not prohibited.

The Gemara asks: With regard to reading, who mentioned anything about it? Why does Rabban Shimon ben Gamliel mention the need for witnesses to be able to read when the discussion is about a witness who does not know how to sign? The Gemara answers: The baraita is incomplete, and this is what it is teaching: In the case of witnesses who do not know how to read, one reads the document in their presence and they sign. And in the case where they do not know how to sign, then one tears paper in the form of a stencil and they fill in the gaps with ink. With regard to this, Rabban Shimon ben Gamliel said: In what case is this statement said? For bills of divorce. However, for bills of manumission and for all other documents, if the witnesses know how to read and how to sign, then they sign, and if not they do not sign. Rabbi Elazar says: What is the reason of Rabban Shimon ben Gamliel, who permitted this only for bills of divorce? He holds that there is reason to be lenient with bills of divorce, so that the daughters of Israel should not be deserted. Requiring literate witnesses for bills of divorce could lead to a scenario in which a husband wishes to travel and wants to give his wife a bill of divorce in case he shall not return, but if he does not find literate witnesses he may leave without divorcing her, leaving her unable to remarry.

Rather, Abaye retracted his objection to Rabbi Yoḥanan’s proof from the mishna, not because of the case of a widow from betrothal, but due to an indication from within the mishna itself. Because if it enters your mind that we are dealing with a place where they do not write a marriage contract, where a woman’s bill of divorce is effectively her marriage contract, and therefore she can use her bill of divorce to collect payment of her marriage contract, that does not make sense; is it written in a bill of divorce that the husband is liable to pay the wife the one hundred or two hundred dinars she is owed? In fact, this is not written in a bill of divorce. And even if you would say that since the Sages instituted that she use the bill of divorce to collect her marriage contract, it is considered as though the liability of the husband to pay one hundred or two hundred dinars is written in it, and it would still be problematic to say that the bill of divorce is sufficient for her to collect payment. The husband should still be able to claim that he is exempt, and say: I already paid it. And if you would say that if the husband would state such a claim, we would say to him: If, in fact, you paid her, you should have torn up the bill of divorce, and he could respond and say to us: She did not allow me to tear it up, because she said: I need the bill of divorce to remarry, by using it as proof that I am divorced.

Gittin 2b

Gittin 2b:5-7

The sugya presents the requirement that a messenger bringing a get say that it was written and signed before him, and Tosafot discusses why the ordinary principle of one witness being believed in prohibitions does not simply suffice for a get.

The Gemara asks: And according to the opinion of Rabba, who said that the reason is because they are not experts in writing a bill of divorce for her sake, let us require two witnesses to testify about this, just as is the case with regard to all testimonies in the Torah. The Gemara answers: One witness is deemed credible with regard to prohibitions. In other words, if there is uncertainty as to whether a matter is prohibited or permitted, in the case of the heretofore married woman, the testimony of one witness is sufficient. The Gemara asks: One can say that we say one witness is deemed credible with regard to prohibitions in a case such as where there is a piece of fat, and it is uncertain if it is forbidden fat [ḥelev] and uncertain if it is permitted fat. In this situation the piece can be rendered permitted by a single witness, as there is no presumption that it is forbidden. Therefore, as there is an uncertainty, and one witness said it is permitted fat, he is deemed credible. However, here, where there is a presumption that this woman is forbidden, as she is a married woman, a status she retains until it is established that she has received a bill of divorce, if so, this is a matter of forbidden sexual relations, and the general principle is that there is no matter of testimony for forbidden sexual relations that can be attested to by fewer than two witnesses.

Yevamot 88a

Yevamot 88a:2-4

The sugya is a central source for ed echad ne'eman be-issurin and discusses when one witness can establish a prohibited or permitted status without the full structure of monetary testimony.

Rather, this is evidently based on logical reasoning: Just as it is in the case of a piece of meat about which it is uncertain if it is forbidden fat and uncertain if it is of permitted fat, and there is no way of clarifying which it is, and one witness comes and says: It is clear to me that it is permitted fat, the halakha is that he is deemed credible. Here too, the testimony of a single witness can resolve the uncertainty. The Gemara raises a difficulty: Is it comparable? There, the presumption of a prohibition has not been established, as there is no proof that the piece was ever forbidden, and one can therefore rely on the witness who permits it, whereas here, the presumption of the prohibition with regard to a married woman is established, and there is a principle that nothing involving those with whom relations are forbidden can be determined by fewer than two witnesses. In fact, this is comparable only to a case involving a piece of meat that is definitely forbidden fat, and one witness comes and says: It is clear to me that it is permitted fat, as the halakha is that he is not deemed credible. The Gemara refutes this claim: Is it comparable? There, when it is established as forbidden fat, even if one hundred witnesses come they are not deemed credible. Here, since if two witnesses come and say the husband is dead they would be deemed credible, let us also deem one witness credible. This is just as it is in the case of untithed produce, i.e., produce from which neither teruma nor tithe has been separated, consecrated property, and konamot, an alternative term for offerings [korbanot] used in vows creating prohibitions. Such vows are called by the generic term: Konamot.

Ketubot 22a:5-6

The Talmud analyzes the principle that one witness is believed in matters of prohibition, including its limits and the relationship between issurin testimony and matters affecting marital status.

MISHNA: With regard to a woman who said: I was a married woman and now I am a divorcée, she is deemed credible and permitted to remarry, as the mouth that prohibited and established that she was married is the mouth that permitted, and established that she is divorced. However, if there are witnesses that she was a married woman, and she says: I am a divorcée, she is not deemed credible. Similarly, with regard to a woman who said: I was taken captive but I am pure, as I was not raped in captivity, she is deemed credible and permitted to marry a priest, as the mouth that prohibited and established that she was taken captive is the mouth that permitted and established that she was not defiled. But if there are witnesses that she was taken captive, and she says: I am pure, she is not deemed credible. And if witnesses came after she married, this woman need not leave her husband. GEMARA: Rav Asi said: From where in the Torah is the principle: The mouth that prohibited is the mouth that permitted, derived? It is derived as it is stated: “I gave my daughter to this man [la’ish hazeh] as a wife” (Deuteronomy 22:16). When the father said that he married her off “to the man [la’ish]” without revealing his identity, he rendered her forbidden to all men. When he then says “this [hazeh],” thereby identifying the man to whom he married her off, he renders her permitted to her husband.

לפי שאין בקיאין לשמה‎—Since they are not well versed in the requirement of לשמה OVERVIEW רבה states that the reason the חכמים require a שליח ממדה"י to say בפ"נ is because the people of מדה"י are not בקי in the requirement of לשמה‎. There are many requirements in הלכות גיטין, and תוספות wonders why is it that they are not בקי (only) in לשמה, but are בקי in all other הלכות גיטין‎. It is also necessary to understand how saying בפ"נ assures us that it was written לשמה‎. -------------------- תוספות asks: ואם תאמר מאי שנא לשמה דאין בקיאין משאר הלכות גיטין‎ – And if you will say; why is the requirement of לשמה different (from all other requirements of writing a גט) that the people are not well versed in this requirement more than the other laws of גיטין, that people are aware of – כגון מחובר ושינה שמו ושמה ונכתב ביום ונחתם בלילה‎ – for instance; the הלכות that these following גיטין are פסול: if the גט was written while it was attached to the ground; i.e. it was written on a leaf of a tree, or if he changed the husband’s name or the wife’s name in the גט and did not write the correct names, or if the גט was written in the daytime, and the witnesses signed it the following night. In all these cases the גט is פסול‎. However we do not mention that the reason the שליח says בפ"נ is to assure us that none of the above happened. Seemingly because we assume that whoever is involved in the writing of the גט is aware of all these פסולים‎. Why would they not be aware of the פסול of שלא לשמה as well? תוספות will now present a possible resolution to this question and refute it: ואין לומר דנקט לשמה דשכיח טפי‎ – And one cannot say that the reason רבה mentions that we are concerned that it was not written לשמה is because it is more common than the other פסולים mentioned above, for it may be likely – דמשכח גט ששמו כשמו ושמה כשמה ומשדר לה‎ – that a husband who wishes to divorce his wife may find a written גט that a stranger wrote to divorce his wife whose name of the husband in the גט is the same as his name, and the woman’s name is the same as his wife’s name and he will send this גט to his wife, without even going to a scribe, who would be aware that this גט is פסול‎ – וגם הסופר שרגיל לכתוב טופסי גיטין אגב שיטפיה מישתלי וכתב שמו ושמה‎ – And in addition even if the husband will go to a scribe for the גט, it is possible that the סופר who is accustomed to write the blank forms of גיטין; On account of his routine he may inadvertently forget and he will write this particulars husband’s and wife’s names filling in their names in the form (for practice). When the husband will come to this סופר to write a גט for him, the סופר may give him this finished גט, not realizing that he wrote it שלא לשמה‎. Therefore this problem of שלא לשמה is more likely than those that תוספות mentioned previously, and therefore that is why רבה mentioned just his problem. However in truth – והוא הדין שאר הלכות גיטין‎ – The same holds true for all the rest of the laws of גיטין, that the people of חו"ל are not בקי in them as well. Therefore, when the שליח states בפני נכתב ובפני נחתם, he is testifying the גט is כשר in all respects, not only was it written לשמה, but also all the הלכות of גיטין, including those mentioned by תוספות previously, were strictly adhered to. This would seem to answer תוספות question; that there is no difference in the knowledge of the laws between לשמה and the other הלכות גיטין, it is just that it is more likely that a גט may written שלא לשמה, than other violations; therefore רבה mentioned שאין בקיאין לשמה‎. תוספות refutes this answer: זה אינו דהא אמר לקמן (דף ט,ב) בג' דרכים שוו גיטי נשים לשחרורי עבדים – This is not so, we cannot say that רבה was concerned about all הלכות גיטין and the testimony of בפ"נ ובפ"נ validates that all הלכות were adhered to, because later the גמרא quotes a ברייתא which says: that גיטי נשים are similar to the שטרות that are used to set free עבדים כנענים, in three ways – ופריך והא איכא לשמה‎ – And the גמרא asks on the ברייתא: but there is the requirement that both these שטרות have to be written לשמה‎. There is a fourth similarity between גיטי נשים and שחרורי עבדים, why does the ברייתא state only three?! The גמרא continues: בשלמא לרבה היינו מוליך ומביא‎ – It is understood, according to רבה, why the ברייתא did not mention לשמה, because לשמה is the same as מוליך ומביא which the ברייתא did mention. מוליך ומביא is the requirement to say בפ"נ ובפ"נ both by גיטי נשים ושחרורי עבדים, when they are sent from either חו"ל לא"י or from א"י לחו"ל. Therefore according to רבה the ברייתא could not have said both לשמה and מוליך ומביא, since the whole חיוב to say בפ"נ by מוליך ומביא is on account of לשמה, therefore לשמה and מוליך ומביא are identical. אלא לרבא קשיא‎ – However according to רבא it is not understood why the ברייתא did not mention לשמה, since, according to רבא the saying of בפ"נ by מוליך ומביא is on account of קיום, and has no connection to לשמה‎. The גמרא continues with another question on the ברייתא: ותו בין לרבה ובין לרבא הא איכא מחובר‎ – And furthermore according to both רבה and רבא there is the פסול of writing the שטר while it is attached to the ground, which applies both to גיטי נשים ושחרורי עבדים, so why does not the ברייתא mention it. This concludes the quote from the גמרא‎. From this dialogue we see that the previous contention that saying בפ"נ validates all הלכות גיטין including לשמה and מחובר etc. is incorrect, as תוספות continues – אלמא לרבה דוקא נקט לשמה בכלל מוליך ומביא ולא נקט מחובר‎ – It is evident that according to רבה, only the requirement of לשמה is mentioned in the גמרא as being included in מוליך ומביא, and therefore the ברייתא could not mention לשמה as an additional similarity because the requirement of לשמה and the saying of בפ"נ by מוליך ומביא are identical, however מחובר is not mentioned to be included in מוליך ומביא as לשמה is, as is evidenced by the fact that according to רבה there is no question why the ברייתא does not mention לשמה (because it is included in מוליך ומביא) but there is a question why the ברייתא does not mention מחובר, so obviously it is not included in מוליך ומביא‎. This proves conclusively that the בפ"נ only comes to validate that the גט was written לשמה and not the other הלכות גיטין‎. Therefore תוספות original question remains; why is it that they are בקי in all other דינים, but they are not בקי in the דין of לשמה‎. תוספות answers: ומפרש רבינו תם דבכל הלכות גיטין בקיאין‎ – The ר"ת explains that the people of חוץ לארץ are בקי in all of הלכות גיטין, including the הלכות of לשמה‎ – אלא דהך דרשא דוכתב לה לשמה אינה נראית להם עיקר דרשה‎ – however this דרשא that the חכמים derive from what the תורה writes וכתב לה ‘He should write for her’ which the חכמים interpret the word 'לה' to mean לשמה ‘for her sake’ that the גט must be written – specifically for her sake; this דרשא does not appear to the people of חו"ל as being the substantive דרשה of the word 'לה'. This interpretation that the people of חו"ל know the דין of לשמה, it is just that they somehow feel that it is not a correct דרשה, seems to contradict that which the גמרא says, namely; that the people of חו"ל are אין בקיאין לשמה, they are not aware of the דין of לשמה‎. תוספות therefore continues: ואין בקיאין פירוש אין חוששין לדרשה דלשמה‎ – And the phrase 'אין בקיאין' – ‘they are not 'well versed’, is to be understood to mean that ‘they dismiss the דרשה of לשמה’. תוספות anticipates another question on this interpretation that אין בקיאין means אין חוששין: ולאחר שלמדו דלקמן‎ – And concerning that which the גמרא says later, that we are discussing a time period after the people of חו"ל learnt the דין of לשמה; this would seemingly indicate that prior to this time of 'לאחר שלמדו'; the people did not yet learn or know the דין of לשמה‎. This is in contradiction to the פירוש ר"ת. תוספות answers: פירוש לאחר שקיבלוה‎ – The meaning of לאחר שלמדו is not to be understood in its literal sense, but rather after they accepted the דרשה of 'לה לשמה'. Now that we know what the meaning of אין בקיאין לשמה is, תוספות will now discuss how the statement of בפ"נ ובפ"נ resolves this concern, for seemingly the שליח makes no mention of לשמה in his statement. והא דפירש הקונטרס דממילא שיילינן ליה אי הוי לשמה ואמר אין‎ – And that which רש"י explains concerning this question; how do we know that it was written לשמה; that inevitably we ask the שליח, once he says בפ"נ that he was present at the writing of the גט, whether it was written לשמה and the שליח says ‘yes’, that it was written לשמה‎. תוספות argues that this interpretation is – אין נראה דלא משתמיט בשום דוכתא שיהא צריך לישאל‎ – not plausible for we do not find it mentioned anywhere that בי"ד is required to ask the שליח if it was written לשמה‎ – תוספות asks an additional question on פירש"י: ועוד דאם כן לימא איכא בינייהו אם צריך לישאל‎ – And furthermore, that if this is so as רש"י claims that we ask the שליח if it was written לשמה, let the גמרא say ‘that there is another difference between רבה and רבה’, namely if it is required to ask anything additional of the שליח, after he testifies that בפ"נ ובפ"נ. According to רבא this is sufficient to be מקיים the גט; according to רבה however, we are required to ask the שליח if it was written לשמה‎. Since the גמרא does not mention this difference, that proves that there is no difference, and even according to רבה, saying בפ"נ is sufficient. The question remains how through his testimony of בפ"נ do we know that it was written לשמה‎? תוספות answers: ואומר רבינו יצחק דסתמא לשמה קא מסהיד – The ר"י says that it is assumable that his testimony of בפ"נ is regarding that it was written לשמה‎. כדפירש בקונטרס נמי בסמוך (דף ג,א ד"ה לא גייז)- as רש"י also explains it in this manner further in the גמרא. תוספות continues to ask: והא דאמר לקמן מי קתני בפני נכתב ובפני נחתם לשמה‎ – And concerning that which the גמרא says later on why רבא does not agree with רבה that the reason for saying בפ"נ is on account of אין בקיאין לשמה, for that cannot be the reason, for does the משנה teach us that the שליח is requires to say: בפני נכתב ובפני נחתם לשמה, and since there is no requirement to add the word לשמה that proves that לשמה is not the reason for saying בפ"נ. This is sרבא' refutation of רבה‎. If however we understand that סתמא לשמה קא מסהיד, as תוספות just told us, how are we to understand sרבא' refutation. There seemingly is no need to add the word לשמה since סתמא לשמה קא מסהיד‎. תוספות replies, that the refutation of רבא should be understood as follows: נהי דסתמא לשמה משמע- Granted that it is assumable that he is testifying that the גט was done לשמה מכל מקום כיון דעיקר תקנה משום לשמה הוא הוה ליה למימר בהדיא‎ – Nevertheless it is not sufficient to assume that לשמה קא מסהיד, because since (according to רבה) the main תקנה for saying בפ"נ is on account of לשמה, the שליח should be required to say it outright, so everyone will know without a doubt that it was done לשמה, and not to merely assume that it was done לשמה‎. SUMMARY The meaning of אין בקיאין לשמה is that the בני חו"ל in spite of knowing that there is a requirement that a גט be written לשמה, as derived from the פסוק וכתב לה‎ – לשמה, nevertheless they did not take it seriously. The חכמים were therefore מתקן that one who brings a גט ממדה"י must testify בפ"נ ובפ"נ, which is assumed to mean that it was נכתב ונחתם לשמה‎. THINKING IT OVER 1. According to the מסקנא is the פסול of שלא לשמה more apt to happen than the other פסולי גיטין‎? 2. Are all the סופרים in חו"ל בקי in לשמה‎? 3. How are לשמה and מוליך ומביא ‘identical’ according to רבה, and how are they ‘different’? 4. תוספות initially proposed to answer that the בני חו"ל are not בקי in all the דינים, and the reason he mentions לשמה is because לשמה is more שכיח than the others, but בפ"נ really is removing all the concerns. Why does not תוספות merely say that the פסול of לשמה is more שכיח, therefore the רבנן were concerned to prevent it, however the other פסולים happen so infrequently, that the רבנן saw no need to address them?! This would also resolve the difficulty from the ברייתא of מוליך ומביא which תוספות cites. 5. תוספות proves that the חשש is only on account of לשמה from the גמרא later (on ט,ב); indicating that we are assuming that which the גמרא concludes (here) that סתם ספרי דדייני מיגמר גמירי‎. If we assume that ספרי דדייני are גמירי, then what is תוספות question that why are we not concerned about מחובר, etc., since the ספרי are גמירי, the only concern is for לשמה that perhaps he found a גט which was שמו כשמו וכו', but there can be no concern of מחובר,etc.!

Mishneh Torah, Divorce 1:1-15

Maimonides lays out the basic legal requirements of a get, including its writing, designation, delivery, and the role of witnesses in the act of divorce.

What is the source that teaches that [a get] must be given in the presence of witnesses? [Deuteronomy 19:15] states: "According to the words of two witnesses or those of three witnesses will the matter be established." It is impossible that on one day a woman will be considered to be forbidden and sexual relations with her punishable by execution, and on the next day she should be permitted [to any man] unless [the divorce is observed by] witnesses. Therefore, if [a husband] gives [his wife] a get in private, or even if the exchange is observed by one witness, the divorce is utterly void. When does the above apply? When the get is written by a scribe. When, however, the husband writes the get himself, one witness signs it, and [the husband] gives it to her, the get is unacceptable [only by Rabbinic decree,] {and the woman is forbidden to marry a priest}. It is an ordinance [enacted] by our Sages that witnesses should sign a get, lest a [husband] give [his wife] a get in the presence of two [witnesses], and they die. [In such an instance,] the get she possesses is no more than a shard, for there are no witnesses [to testify to its authenticity]. [To prevent such a situation, our Sages] ordained that the testimony [regarding the authenticity of the get should be contained] within it. Although witnesses [have signed] within, [the husband] must give [the get] to [his wife] in the presence of two [witnesses] - whether the same witnesses who signed it or two others. For in essence, divorce is established by virtue of the witnesses [who observe] the transfer [of the get].

Tosafot on Gittin 2b

Tosafot on Gittin 2b:5

Tosafot explicitly raises the tension between ed echad ne'eman be-issurin and the get's need for witnesses or certification, developing the foundational distinction for this question.

עד אחד נאמן באיסורין‎—One witness is believed concerning prohibitive acts. OVERVIEW An עד אחד is believed to testify on matters of איסור והיתר‎. He can testify that this piece of meat is כשר and not נבילה, or whether this מקוה has the proper שיעור or not, etc. There is a qualification to this rule. If there is a חזקת איסור, then (it is questionable if) an ע"א is [not] believed to contradict the חזקת איסור‎. Were he to testify regarding a woman, whom we know that she was married, that she is now divorced, we may not accept his testimony. This qualification itself is subsequently qualified. An ע"א can be believed even when he contradicts a חזקת איסור, if he is capable of rectifying and removing the איסור‎. He can say that he was מפריש תרומה from this grain, even though there is a חזקת איסור טבל on it, nevertheless he is believed to say that he was מפריש תרומה since it is בידו to be מפריש תרומה‎. In regards to a שליח הגט who says בפ"נ that it was written לשמה, this seems to be the regular case of ע"א נאמן באיסורין, where there is no איתחזק איסורא‎ – we do not assume the גט was written שלא לשמה, and it is not בידו of the שליח\עד to write the גט לשמה‎. ----------------------- פירוש הקונטרס שהרי האמינה התורה כל אחד ואחד‎ – רש"י explains; where do we see that ע"א נאמן באיסורין for the תורה believes every individual – על הפרשת תרומה ושחיטה וניקור הגיד וחלב‎ – Concerning separating תרומה, ritual slaughtering of an animal, removal of forbidden sinews (גיד הנשה) and veins, and forbidden fats of an animal. A person, who is invited to a friend’s house to eat, may do so on the say so of the host that the food is kosher, and none of the abovementioned items presents any problem. Even though there are no two witnesses that the host was מפריש תרומה or the meat was נשחט properly etc. We believe the testimony of the single host. This proves that ע"א נאמן באיסורין‎. תוספות comments on sרש"י' explanation: ולא היה לו להזכיר הפרשת תרומה ושחיטה דבהנהו נאמן אף על גב דאיתחזק איסורא‎ – However, רש"י should not have mentioned תרומה ושחיטה among the items he listed to prove ע"א נאמן באיסורין, for in these two items he is believed even though there is a חזקת איסור originally on the food. This is highly unusual that an ע"א should be believed when איתחזק איסורא‎. Therefore we must say the reason why an ע"א is נאמן by תרומה ושחיטה even though that it is איתחזק איסורא, is – משום דבידו לתקנם‎ – Because the ע"א has the capability to correct this איסור, by being מפריש תרומה and being שוחט the בהמה‎ – כמו שפירש הקונטרס בסמוך והכי אמר בהאשה רבה (יבמות פח,א) – as רש"י will shortly comment. And similarly this is said in פרק האשה רבה‎. Therefore, this type of ע"א נאמן באיסורין where it is בידו לתקנם has no bearing on our case of the שליח testifying that it was written לשמה, where he does not have any capability at all to change the לשמה status of the גט‎. תוספות challenges his own assumption that שחיטה is בידו לתקן: ושחיטה אף על גב דהשתא אין בידו לתקנו‎ – and concerning שחיטה, which תוספות claimed that רש"י should not have included it since it is בידו, תוספות asks, even though that presently, when he is serving the meat, he is no longer capable to correct the problem of נבילה, so why is he נאמן, since it is איתחזק איסורא‎? תוספות answers, that nevertheless since – מעיקרא היה בידו לשחוט‎ – Originally he was capable of שחיטה (either by himself or arranging for someone else to be שוחט), that is sufficient to be considered בידו לתקנו‎. תוספות offers proof for his contention – דאם לא כן אמאי מהימן כיון דאיתחזק איסורא‎ – For if you will not agree that this is considered בידו, but rather insist that it must be בידו now, then why indeed is anyone solely believed that this is בשר שחוטה, since it was איתחזק איסורא. One cannot say that indeed the only way that one is permitted to eat meat is only if two people will testify that it was נשחט properly – דלא מצינו בשום מקום שיצטרך בגדול אחד עומד על גביו‎ – For we do not find it mentioned anywhere that there is a requirement that another adult should be standing together with the שוחט, so that we can have two witnesses testifying that it is בשר שחוטה‎. Therefore that proves that we do not require that it be בידו now, rather it is sufficient that originally it was בידו‎. תוספות continues to prove his point, indicating a possible rebuttal to this logic: One may challenge תוספות proof by saying that the נאמנות of בידו is only if it is בידו now, and not if it was only previously בידו, and the reason why we may eat on the testimony of the שוחט, is because there is a רוב (a ‘majority) that tells us it was נשחט properly, namely that the רוב people that are שוחט are competent שוחטים‎. Therefore it has nothing to do with the נאמנות of an ע"א, but rather on account of רוב‎. תוספות responds that this is not so, for there is a נאמנות of an ע"א by שחיטה even when we cannot utilize this רוב‎ – ומעשים בכל יום דמהימן‎ – And it is an everyday occurrence that the שוחט alone is believed (on account that it was previously בידו). ואף על גב דלא שייך רוב מצויין אצל שחיטה מומחין הן‎ – Even in a situation where this rule that ‘most people who frequent at places of שחיטה are competent שוחטים’ does not apply – כגון שנחתך כל הראש ואין בית השחיטה ניכר‎ – If for instance the entire head was cut off and the place of שחיטה cannot be discerned, nevertheless if someone claims that he was שוחט it properly, he is believed. In this case we cannot say that the reason he is believed is because רוב מצויין אצל שחיטה מומחין הן; for we do not know that this animal was נשחט, since its head was severed and we cannot tell if it was נשחט or not. This proves that the only נאמנות is because he is an ע"א, and regardless that there was a חזקת איסור מחיים on this animal nevertheless he is now נאמן to say that it was נשחט properly, since previously it was בידו that he could be שוחט the animal properly. תוספות asks an additional question: ומה שאנו סומכין על הנשים בשחיטה אף על פי שאין יודעות הלכות שחיטה‎ – And the reason why we depend on women concerning שחיטה, i.e. if a woman serves meat we trust her that it is בשר שחוטה, even though they do not know the laws of שחיטה, therefore seemingly it is not בידה, not now and not previously, for they do not know how to be שוחט‎. The question is how can we depend on them, for they are only an ע"א, and it is איתחזק איסורא‎? תוספות replies: כיון שבידה ללמוד לשחוט או להשכיר אחרים שישחטו לה כבידה דמי‎ – Since she is capable of learning how to be שוחט (the שחיטה of a woman is a שחיטה כשרה) or she is capable of hiring others (valid שוחטים) that they do the שחיטה for her, this is considered as if it is בידה‎. It is not necessary that the persons themselves do the שחיטה‎. If, for instance, (s)he can see to it that the food is prepared in a כשר manner it is considered בידו‎. תוספות asks: ואם תאמר ומנלן דעד אחד נאמן באיסורין‎ – And if you will say; from where do we derive this דין that ע"א נאמן באיסורין‎. We have proof that ע"א נאמן באיסורין from ניקור הגיד וחלב, however what is the source מן התורה that ע"א נאמן באיסורין‎. תוספות answers: ויש לומר דגמרינן מנדה דדרשינן בפרק המדיר (כתובות עב,א) וספרה לה לעצמה‎ – And one can say; that we derive it from הלכות נדה, for we have a דרשה in פרק המדיר that when the תורה states, concerning a זבה; ‘and she shall count for her(self)’ the דרשה of the word לה is to be understood, that she may count it by herself, and she will be believed to say that the required seven days have passed and she was טובלת and is טהורה‎. We see that we believe an ע"א, that she is טהורה‎. תוספות poses a question: ואם תאמר אם כן אפילו איתחזק איסורא‎ – And if you will say; if we are deriving the דין of ע"א נאמן באיסורין from נדה, then an ע"א should be believed even in a case where it is איתחזק איסורא‎. When the אשה sees דם she becomes a נדה (or זבה), and is בחזקת איסור, and nevertheless she is believed to say that she is טהורה against a חזקת איסור‎. תוספות responds: ויש לומר דאינה בחזקת שתהא רואה כל שעה‎ – And one can say; that there is no חזקה by this woman that she will continually see דם, on the contrary, she will see דם naturally only for a limited period and then cease seeing דם‎ – וכשעברה שבעה טהורה ממילא ולא איתחזק איסורא‎ – And once the seven days pass and she is not seeing דם, as is the natural state of affairs, that דם נדה does not last seven days, she becomes טהורה automatically and therefore there is no real חזקת איסור, as opposed to טבל for instance, where the איסור טבל will not go away on its own, only if you are מפריש תרו"מ, here however the איסור will automatically disappear in the allotted time when she will not see דם‎. Therefore when she says that her seven days of נדה have passed, she is not testifying against any חזקת איסור, for we expect the seven days to pass at one point or another; she is merely informing us that the time is now. There is still a question remaining: After the seven days passed she is still בחזקת איסור נדה, since she was not טובלת‎. How can we believe her that she is completelyטהורה, against this חזקת איסור‎?! To which תוספות responds in his conclusion: וגם בידה לטבול‎ – And concerning the completion of her טהרה‎ – she is certainly capable of being טובלת in a מקוה, and as was stated earlier, that when it is בידו, then an ע"א is believed even against a חזקת איסור‎. SUMMARY The proof that ע"א נאמן באיסורין, in a situation similar to a שליח הגט who is testifying that it was written לשמה, can be derived from the fact that people are נאמן on ניקור הגיד and חלב‎. For in those two instances there is no חזקת איסור on this meat that it is either גיד הנשה or חלב‎. The fact that people are believed for הפרשת תרומה and שחיטה is irrelevant to our discussion here, since in both those cases there is a חזקת איסור, and the reason the ע"א is נאמן, is only because it is בידו‎. This cannot apply to our case of שליח הגט, where it is definitely not בידו to write the גט לשמה‎. The נאמנות of בידו is not limited to a situation where it is only presently בידו; it applies even if it was בידו in the past. This explains why people are נאמן to state that this meat is שחוטה, since in the past they were capable of either themselves being שוחט the animal properly or hiring others to be שוחט properly. We derive the rule of ע"א נאמן באיסורין, from the פסוק concerning a [זבה] (נדה), which says וספרה לה, that the woman can count by herself and tell us when she is a טהורה, we see from here that even one person is believed to testify that there is no איסור‎. We cannot assume that since by a נדה she was בחזקת איסור once she saw דם, therefore the fact that she is believed to say she is a טהורה, proves that an ע"א is נאמן even against a חזקת איסור‎. This is incorrect for the חזקת איסור by a נדה is a חזקה that will automatically become nullified as soon as she ceases to see דם, which is the natural state of affairs, therefore her testimony that she is no longer seeing דם, is not contradicting any חזקה; and we subsequently believe her that she was טובל, even though she is still בחזקת איסור נדה (even after seven days), because in regards to טבילה, it is obviously בידה‎. THINKING IT OVER 1. Why is בידו believed even if איתחזק איסורא‎? Is it because בידו removes the איתחזק איסורא, or because בידו is a special נאמנות‎? 2. How shall we explain the difference between the בידו of a שוחט in the past, to the בידה of a woman concerning שחיטה‎? 3. How can we derive ע"א נאמן באיסורין from נדה, perhaps by נדה she is believed because it is הפה שאסר הפה שהתיר (she had the option of not informing anyone that she is a נדה)? עד אחד נאמן באיסורין‎—One witness is believed concerning prohibitive acts. OVERVIEW The גמרא originally asked that two עדים should be required to testify that the גט was written לשמה as is the case whenever witnesses are required. One may assume that this מקשן maintained that here by גט we also require two עדים, since it is a דבר שבערוה, one of the categories where two עדים are required. The subsequent answer that since ע"א נאמן באיסורין, therefore the שליח alone is believed, may leave us perplexed. We are discussing a גט, which is a דבר שבערוה, how can the גמרא compare this to איסור‎. Our תוספות discusses this issue. ------------------ תוספות asks: הקשה רבינו תם מה תשובה היא זאת‎ – The ר"ת has a difficulty; what is this answer that the גמרא gave; that the שליח is נאמן, because ע"א נאמן באיסורין‎. This seemingly does not address the question at all. We cannot use the rule of ע"א נאמן באיסורין, in this case. This is not a case of איסור והיתר; this is a case of עריות, which requires two עדים‎. To prove that this is not a case of איסור והיתר where one עד is נאמן; תוספות continues – עיקר הגט יוכיח שצריך לחותמו בשנים‎ – The main execution of this very same גט will prove that this is not a case of איסור והיתר, for it is necessary that the גט be signed by two witnesses. If it were merely איסור והיתר, we would not require two עדים‎. We require two עדים because by a גט we are dealing with a דבר שבערוה; therefore how did the גמרא state that this is merely a matter of איסור and the שליח alone is נאמן on the כשרות of this גט‎?! תוספות answers: ותירץ דהכי קאמר דעד אחד נאמן באיסורין בכהאי גוונא‎ – And the ר"ת answered; this is what the גמרא is saying: that an ע"א is נאמן by איסורין even by a דבר שבערוה, provided that it is in such a manner – שעיקר הגט נעשה כבר ושוב אין צריך אלא גילוי מילתא לידע אם לשמה נכתב: Where the main execution of the גט was already completed properly with two עדים, as is required for a דבר שבערוה and subsequently all that is required is merely information to notify us whether it was written לשמה‎. SUMMARY The תרצן who explains that the reason why one שליח alone is נאמן to testify that the גט was written לשמה, is on account of the rule of ע"א נאמן באיסורין; it is his contention that merely testifying on the status of a גט, that it was properly drawn up, this testimony is not to be considered as a דבר שבערוה‎. Rather this should be considered as all other testimonies of איסור והיתר, where one עד is sufficient. It is only when creating a גט originally that the rules of דבר שבערוה apply, necessitating two witnesses to sign the גט, but not however to merely testifying as to its validity. THINKING IT OVER 1. How should we understand תוספות question as opposed to his answer? 2. Is a דבר שבערוה considered איסורין‎? הוי דבר שבערוה‎—It is a matter concerning illicit relationships OVERVIEW The גמרא states that we cannot use the rule of ע"א נאמן באיסורין, to allow one עד to be believed that the גט was written לשמה, because an ע"א is נאמן when לא איתחזק איסורא; here however ‘since it was איתחזק איסורא דאשת איש (therefore), it is a דבר שבערוה etc’. Once the גמרא says that an ע"א is not נאמן by regular איסורין (even if it is not a דבר שבערוה) if it is איתחזק איסורא, all the גמרא needed to say was that here there is a חזקת איסור, without adding that it is a דבר שבערוה (in which case seemingly the ע"א will not be believed even if לא איתחזק איסורא). Our תוספות discusses this issue. -------------------------- תוספות anticipates the following question: הא דנקט דבר שבערוה‎ – The reason the גמרא specifies that we are discussing a דבר שבערוה, when seemingly it would have been sufficient to state only what the גמרא said initially, namely that in this case of אמירת בפ"נ it is איתחזק איסורא, for we wish to change her present marital status, and as the גמרא began saying that we only know that an ע"א is נאמן when לא איתחזק איסורא‎. Why therefore did the גמרא find it necessary to strengthen its question by claiming that in addition to איתחזק איסורא, it is also a דבר שבערוה‎? תוספות responds: אומר רבינו יצחק משום דבהאשה רבה (יבמות דף פח,א) – The ר"י says, because in פרק האשה רבה‎ – the גמרא there when discussing – בשאר איסורי כגון טבל והקדש וקונמות‎ – various איסורים, for instance טבל and הקדש and vows, where there is (a possibility of) איתחזק איסורא; the גמרא there – מספקא ליה אי מהימן אפילו איתחזק איסורא ולאו בידו או לא‎ – is unsure whether an ע"א would be believed even in a case of איתחזק איסורא, and it was not בידו to remove the איסור; or he would not be believed. Therefore the גמרא could not have said here merely that it is איתחזק איסורא, because it may be that even by איתחזק איסורא ולאו בידו an ע"א is still נאמן, therefore the גמרא added that it is also a דבר שבערוה, and in such a case where it is (איתחזק איסורא and) a דבר שבערוה, everyone agrees that an ע"א is not נאמן‎. תוספות questions the view that an ע"א will be נאמן by איתחזק איסורא ולאו בידו: ואם תאמר אי עד אחד נאמן בשאר איסורין אפילו איתחזק איסורא ולאו בידו‎ – And if you will say; if an ע"א is נאמן by other איסורין, even in cases where it is איתחזק איסורא ולאו בידו‎ – אמאי איצטריך וספרה לה לעצמה- Why do we need the תורה to write the פסוק וספרה לה, from which we derive from the word לה, that she is believed to count by herself? We already know, according to this view, that even by איתחזק איסורא ולאו בידו an ע"א is נאמן, so seemingly certainly in this case of וספרה לה by a נדה\זבה, which תוספות already explained previously that it is not איתחזק איסורא ולאו בידה, she will surely be believed. And one can say; that we may think that the case of a נדה declaring that she is טהורה, is considered like a דבר שבערוה, and therefore even though an ע"א may be נאמן by איתחזק איסורא ולאו בידו, that does not prove that he will be נאמן even by a דבר שבערוה, therefore we need the פסוק וספרה לה, according to this view, to teach us that נדה is not a דבר שבערוה, and therefore she is נאמנת‎. SUMMARY The גמרא in יבמות did not decide if an ע"א is נאמן in cases of איתחזק איסורא ולאו בידו, therefore our גמרא, needed to add that in our case of בפ"נ, not only is it איתחזק איסורא, but it is also a דבר שבערוה, and everyone agrees that an ע"א is not נאמן by a דבר שבערוה ואיתחזק איסורא‎. Even according to the viewpoint that an ע"א is נאמן even if איתחזק איסורא ולאו בידו, it still would not be proof that a נדה is believed that she is already טהורה, for we may consider this איסור נדה as a דבר שבערוה, which requires two עדים‎. The פסוק וספרה לה teaches us that she is נאמן, for this is not considered a דבר שבערוה‎. THINKING IT OVER 1. Are we to understand the גמרא to be asking one question: דאיתחזק איסורא דאשת איש והוי דברי שבערוה, or two questions: a) איתחזק איסורא and b) דבר שבערוה‎? 2. What can we infer from this תוספות as to the דין in a case of a דבר שבערוה ולא איתחזק איסורא, according to תוספות‎? 3. Why should or should not a נדה be considered a דבר שבערוה‎? 4. תוספות explains that if not for וספרה לה we might assume that a נדה is a דבר שבערוה and therefore she will not be believed. However, since a נדה is not איתחזק איסורא, and תוספות is assuming here that only by איתחזק איסורא and דבר שבערוה an ע"א is not believed, but not by a דבר שבערוה where it is not איתחזק איסורא, why should I think that a נדה will not be believed?!

The Rambam discusses the special evidentiary rules governing testimony in matters of personal status and prohibited relationships, relevant to why the ordinary issurin rule is not a complete model for gittin.

Chiddushei Rabbeinu Chaim HaLevi, Divorce 6:9

Rav Chaim analyzes the requirement for witnesses in gittin and the distinction between the evidentiary trust of one witness in prohibitions and the formal role of witnesses in creating or validating a get. This is the central Rav Chaim source for the conceptual question.

Chiddushei Rabbeinu Chaim HaLevi, Testimony 3:4

Chaim HaLevi Soloveitchik explains that documents of divorce, emancipation, and acquisition do not require the procedural laws of testimony—such as a court, examination, or daytime testimony—because the signed witnesses’ testimony is treated as already examined in court; documentary proof of a loan is different, since it retains the status of written testimony and therefore requires examination.

Chiddushei Rabbeinu Chaim HaLevi, Divorce 12:21

Chaim HaLevi Soloveitchik explains that the greater force of two or many women or disqualified witnesses derives only from the rule of majority, which does not apply against a valid witness whose testimony has the status of formal testimony; thus one valid witness is equivalent to many unless the latter constitute two valid witnesses, while two witnesses are required because complete testimony is established by two under the rule of “על פי שנים עדים יקום דבר.

Levush, Yoreh De'ah 127:4

Levush, Yoreh De'ah 127:4

Beit Yosef, Yoreh De'ah 127

Beit Yosef, Yoreh De'ah 127:1-2

The Beit Yosef analyzes the sources and reasoning behind the Tur's laws of one witness in prohibitions, including the relationship between נאמנות, presumption, and the requirement of testimony.

Ketzot HaChoshen on Shulchan Arukh, Choshen Mishpat 38:2

The Ketzot discusses the conceptual boundary between testimony required for monetary law and reliance on a single witness in areas of prohibition, clarifying why the evidentiary categories cannot simply be merged.

Shulchan Arukh, Even HaEzer 130:1-21

Shulchan Arukh, Even HaEzer 130:1-21

The governing code presents the practical laws of writing, signing, and delivering a get, including the halakhic function of witnesses.

One needs to sign [get] in front of two kosher witnesses, and they should sign one signature under the other (Mordechai Halachos Gitin), both under the last line of the get. But don't leave space that is two lines worth of space between the last line [of the get] and their signature. If they place it so [see statement above], the get is void (Tur). There are those who disagree, and say that it is still made kosher by the witnesses [those who see that the man gave the get] (Rambam). If the second witness signs first, and the first witness signs after, it is still kosher, even though from the beginning, there were two signatures, two lines away from the get (Gittin). Nevertheless, initially, you shouldn't do so. If you say that initially, one should not sign the get if they have been related and now distanced, or if you were the matchmaker (Seder HaGet Bisheim Maharil). It's good to praise the scribe, so the scribe will not come close to the man and his wife, but when this is impossible, you need not be stringent (Maharik 106). And none of the witnesses may be suspects of adultery. There are those that are stringent that he [the witness] cannot have a blemish, and he should not be related to the scribe, and none of the witnesses may be related to the Rabbi officiating the get , and it's also good to be suspicious of all this from the beginning. Also, it is customary to take signers and the witnesses to see that the husband commanding the scribe to write [the get ], so all this will be in the presence of one group of witnesses (Mordechai Halachos Gittin and in the Smag). And the witnesses shouldn't sign unless it is [they are signing] with the quill and ink of the husband, like the scribe, as was explained earlier in the beginning of the siman . The witnesses must both sign in front of the other. If each signed separately, it is invalid. Rama: Some authorities validate a get in which the first two witnesses signed in front of each other and the third witness signed separately (Tur in the name of Rabbenu Tam). If a man gave his wife a writ privately, or even in the presence of one witness, it is not considered a writ. This is the case if the writ is in the scribes handwriting. If the husband wrote the writ in his hand and one witness signed and he gave it to her, it is a invalid writ, and it disqualifies her from marrying a Kohen.

Arukh HaShulchan, Even HaEzer 130:1-27

This practical commentary explains the functions of witnesses to the signing and delivery of a get and the safeguards surrounding its execution.

Shulchan Arukh, Even HaEzer 131:6-8

Even if it were written in his name, if the witnesses did not sign in his name, if he gave it to her without witnesses of transfer, it is not a divorce document. And if he gave it to her with witnesses of transfer, behold it is unfit. And there are those that say it is not even a divorce document(as opposed to just being unfit). Therefore, one needs to be cautious when the husband commands the scribe to write that he say before witnesses that they should sign the divorce document: "Write this divorce document in the name of so and so, my wife. And so too the scribe should vocalize when he begins to write that he is writing for such an such a person, the wife of so and so, in the name of so and so. Ramah-gloss: And he should say this before the signing witnesses of the document, and they should write it with consistency and not in intervals, in order that they write his and her name like it was from the beginning. However, after the fact, if he wrote in intervals, it is kosher. (an opinion on its own). There are those that say emending the parchment, outline of the quill and all the more so, tracing, all need to be done with intention. However, if he did all these without intention, it is not invalid. The two signatory witnesses should be there at the time in which he starts to write the divorce document, in order that they know it was written with intention and they identify the timing of the signing.

Shoel uMeshiv Mahadura V 30

Shoel uMeshiv Mahadura V 30:2

Yosef Shaul Nathanson distinguishes between testifying about a matter, where ed echad may suffice in areas of prohibition, and testifying that a person is trustworthy, which seemingly requires two witnesses; he explores a difficulty from Rosh Hashanah where one witness appears sufficient and resolves it by distinguishing cases requiring one witness from those requiring two.

Arukh HaShulchan, Even HaEzer

Arukh HaShulchan, Even HaEzer 141:144

The passage explains that when the husband himself annuls a get, he doesn't need witnesses, but when his agent comes to annul it, two witnesses are required because we cannot believe a single person claiming the husband annulled it, and the get becomes void based on the testimony of two witnesses.

Bach, Even HaEzer 141

Bach, Even HaEzer 141:23

Yoel ben Shmuel Sirkes explains that validating a get must take place before three judges, each of whose signatures should be recognized; recognizing only two is sufficient בדיעבד in monetary matters, but greater stringency is appropriate for a get.

Shulchan Arukh, Yoreh De'ah 127:3

Joseph Karo’s passage states that one witness is generally trusted regarding prohibitions to permit but not to prohibit, with qualifications concerning established or ascertainable status, personal ownership, women’s and minors’ testimony, and certain rabbinic prohibitions.

Shoel uMeshiv Mahadura IV 3:70

Shoel uMeshiv Mahadura IV 3:70

Yosef Shaul Nathanson explains that although Rabbi Ḥisda does not generally suspect a lost document, a get may require witnesses because the woman’s existing status as an eshet ish combines with the minority possibility of loss, while distinguishing this from monetary cases and discussing the views of the Penei Yehoshua, the Shach, the Tumim, and the Maggid Mishneh.

Teshuvos V'hanhagos 3:393

The passage cites sources that discuss whether witnesses are required, including the Or Sameach’s unresolved doubt, the Marcheshes’s view that the issue depends on a dispute between the Rambam and Raavad, and related discussions by Tosafos Ri HaZaken, the Haflaah, and Avnei Nezer.

Igros Moshe YD 2:127

The passage cites Tosafos and Rashi as holding that a get requires witnesses for its formal validation, and suggests that even when witnesses are present, their testimony may not count for this purpose if the relevant party is unaware of them, as in gittin and kiddushin.

Shevet HaLevi 2:55

The passage examines whether an ed echad is believed when an issur has an established status, contrasting Tosafos’s view that the matter remains doubtful with interpretations of the Ramban, Rashba, and others that distinguish between permitting what is prohibited and prohibiting what is permitted, and it further discusses how this issue relates to testimony in matters of ervah.

Shevet HaLevi 4:163

The passage analyzes the disagreement over whether one witness is biblically trusted in prohibitions and in permitting a woman based on testimony of her husband’s death, discussing the implications of established prohibitions, “there is no matter of ervah with fewer than two witnesses,” and the approaches of Tosafos, Rashba, Rambam, and other commentators.

Igros Moshe YD 1:65

Igros Moshe YD 1:65

The passage distinguishes between testimony that merely clarifies an existing status, for which one witness can be believed in matters of issur, and testimony that creates a new obligation or compels a court to act, which requires two witnesses; it applies this distinction to cases such as circumcision, offering the tamid, and testimony about a get.

The Captive Woman as Moral Regulation

Sources examine the law of eishes yefas toar (the captive woman) as a halachic response to human impulse in wartime, emphasizing the Torah's regulatory framework—including waiting periods, conversion requirements, and protections against exploitation—rather than as permission for unrestrained conduct. Commentators across traditions interpret the law as a constrained concession that channels desire within ethical and legal boundaries.

Parental Honor and Torah Violations

Jewish law establishes that the obligation to honor one's parents does not extend to obeying commands that violate Torah law. The Talmud, Rishonim, and Acharonim consistently teach that both parent and child are bound by divine commandment, and parental authority is therefore limited by the higher obligation to God.

Identifying Marks in Returning Lost Property

The sources establish the halakhic principle that a lost object must bear a recognizable identifying mark (siman) for a finder to be obligated to announce and return it to its owner. The Talmud and Maimonides discuss what constitutes a valid siman, how a claimant must prove ownership without being prompted, and the procedures for announcing found objects.
