Pikuach Nefesh and Security Equipment on Shabbat

Sources address the fundamental principle that danger to life overrides Shabbat restrictions, establishing the halakhic foundation for carrying communication devices when genuine security risks exist. The texts present the classical framework for determining when emergency response justifies Shabbat violation.

What the sources say

This question actually raises three separate halachic issues: the permissibility of carrying a weapon or communication device on Shabbat for security purposes, the separate question of using or benefiting from an operating radio (an electrical/sound-producing device) on Shabbat, and whether Ashkenazi and Sephardi poskim differ in how they resolve these carrying and listening questions.

Carrying on Shabbat

The classic sugya of a besieged city establishes that Shabbat is desecrated to go out with weapons when there is danger to life, as codified in Shulchan Arukh, Orach Chayim 329:6, Mishneh Torah, Sabbath 2:23, Tur, Orach Chayim 329, Arukh HaShulchan, Orach Chayim 329:9, Kaf HaChayim on Shulchan Arukh, Orach Chayim 329:21, and Beit Yosef, Orach Chayim 329:7, with Shulchan Arukh HaRav, Orach Chayim 329:1 and Mishnah Berurah 329:5 further grounding this in the principle that pikuach nefesh overrides Shabbat.

This principle traces back to Chazal, who permit acting swiftly to save a life on Shabbat without seeking prior permission (Yoma 84b-85b), who list crying out even on Shabbat for a besieged city or endangered ship (Taanit 19a:5), who permit healing with prohibited substances where life is at risk (Pesachim 25a:10), and who permit desecrating Shabbat for childbirth (Mishnah Shabbat 18:3).

Building on this, Peninei Halakhah, Shabbat 27:17 rules that one who habitually carries a pistol, rifle, or two-way radio for security or rescue purposes may carry it on Shabbat within an eruv, since such items qualify as a kli she-melakhto le-heter, while Maamar Mordechai Hilchot Shabbat, Chelek 3 58:60 similarly permits carrying a permitted hearing or speaking device into a carmelit or reshut harabim on Shabbat because such devices function like worn garments.

Peninei Halakhah, Shabbat 17:3 permits a hard-of-hearing person to wear an electric hearing aid activated before Shabbat, provided the current is not adjusted during Shabbat, treating this as analogous to permitted carrying of a device attached to the body.

Igros Moshe OC 4:81 similarly treats a small radio worn by emergency personnel as a garment or item of importance whose carrying is justified by the need for immediate lifesaving response and by the concern that forbidding it would discourage participation in rescue work.

Electricity and Shabbat

Multiple sections of Kitzur Shulchan Arukh Yalkut Yosef rule that one may not turn on or listen to a radio, tape player, or phonograph on Shabbat or Yom Tov even when it was set by a timer before Shabbat, due to benefiting from melachah done on Shabbat and zilzul (degradation) of Shabbat's honor, as stated in Kitzur Shulchan Arukh Yalkut Yosef, Orach Chaim 318:43, Kitzur Shulchan Arukh Yalkut Yosef, Orach Chaim 252:9, Kitzur Shulchan Arukh Yalkut Yosef, Orach Chaim 502:20, and Kitzur Shulchan Arukh Yalkut Yosef, Orach Chaim,

Related rulings extend this prohibition to merely listening in to a radio a neighbor or fellow soldier is playing, even from a non-Jewish station, as found in Kitzur Shulchan Arukh Yalkut Yosef, Orach Chaim 318:45, Kitzur Shulchan Arukh Yalkut Yosef, Orach Chaim 318:46, Kitzur Shulchan Arukh Yalkut Yosef, Orach Chaim 318:44, and Kitzur Shulchan Arukh Yalkut Yosef, Orach Chaim 318:48.

Maamar Mordechai Hilchot Shabbat, Chelek 5 118:9 forbids presetting a Shabbat clock to activate a radio or television on Shabbat, but permits leaving a radio running in wartime, citing concerns of zilzul kavod Shabbat and hashmaat kol (raising the volume/tuning) even with non-Jewish stations.

Ashkenazi vs. Sephardi practice

The Sephardi-oriented Kitzur Shulchan Arukh Yalkut Yosef sources consistently forbid any listening to or activation of a radio on Shabbat even by timer, as seen across Kitzur Shulchan Arukh Yalkut Yosef, Orach Chaim 318:43, Kitzur Shulchan Arukh Yalkut Yosef, Orach Chaim 252:9, Kitzur Shulchan Arukh Yalkut Yosef, Orach Chaim 502:20, Kitzur Shulchan Arukh Yalkut Yosef, Orach Chaim 318:45, and Kitzur Shulchan Arukh Yalkut Yosef, Orach Chaim 318:46, a strictness echoed by Ma'ayan Omer (Maayan Omer 2:5:12) and by Maamar Mordechai Hilchot Shabbat, Chelek 5 118:9.

By contrast, Iggerot Moshe (Iggerot Moshe, Orach Chayim 4:81) and Igros Moshe OC 4:81, representing an Ashkenazi Acharon, permit rescue personnel to wear and carry a small radio on Shabbat as a garment needed for prompt lifesaving response.

Similarly, the Religious Zionist-oriented Peninei Halakhah, Shabbat 27:17 permits carrying a pistol, rifle, or two-way radio habitually used for security or rescue purposes within an eruv, and Maamar Mordechai Hilchot Shabbat, Chelek 3 58:60 permits carrying a permitted communication or hearing device into a carmelit or reshut harabim, showing greater leniency toward carrying such devices for security than the Yalkut Yosef sources show toward merely listening to a radio.

Responsa on this question

Minchas Shlomo (Minchas Shlomo 1:9)Minchas Shlomo addresses whether one may use a microphone and loudspeaker for speech in the synagogue on Shabbat, and does not state a position on carrying a radio for security purposes.

Az Nidberu (Az Nidberu 14:34)Az Nidberu addresses the permissibility of using a radio to hear news broadcasts on Shabbat in the diaspora when the broadcast originates from Israel, and rules that it is forbidden because one derives benefit on Shabbat, but does not address differences between Ashkenazi and Sephardi practice regarding carrying a radio for security purposes.

Yoma 84b-85b

Yoma 84b-85b

The classic sugya teaches that saving life overrides Shabbat and that one should violate Shabbat decisively rather than delay. It is directly relevant to security personnel carrying and operating communications equipment.

§ The Sages taught in a baraita: One engages in saving a life on Shabbat, and one who is vigilant to do so is praiseworthy. And one need not take permission from a court but hurries to act on his own. How so? If one sees a child who fell into the sea, he spreads a fisherman’s net and raises him from the water. And one who is vigilant and acts quickly is praiseworthy, and one need not seek permission from a court, although in doing so he catches fish in the net as well. Similarly, if one sees a child fall into a pit and the child cannot get out, he digs part of the ground out around the edge of the pit to create a makeshift step and raises him out. And one who is vigilant and acts quickly is praiseworthy, and one need not seek permission from a court, although in doing so he fashions a step. Similarly, if one sees that a door is locked before a child and the child is scared and crying, he breaks the door and takes the child out. And one who is vigilant and acts quickly is praiseworthy, and one need not seek permission from a court, although he intends to break it into boards to be used later. Similarly, one may extinguish a fire by placing a barrier of metal or clay vessels filled with water in front of it on Shabbat when life is endangered. And one who is vigilant and acts quickly is praiseworthy, and one need not seek permission from a court, although he leaves the coals, which can be used for cooking after Shabbat.

Taanit 19a

Taanit 19a:5

Chachmei Bavel state that one may sound an alarm on Shabbat for a city surrounded by gentile forces, a swollen river threatening a place, or a ship in peril; Rabbi Yosei limits this to summoning help rather than prayer, while Shimon the Timnite extends it to pestilence, a view the Rabbis reject.

For the following calamities they cry out even on Shabbat: For a city that is surrounded by gentile troops, or for a place in danger of being flooded by a river that has swelled its banks, or for a ship tossed about at sea. Rabbi Yosei said: One may cry out on Shabbat to summon help, but it may not be sounded for crying out to God. Shimon the Timnite says: One may cry out on Shabbat even for pestilence, but the Rabbis did not agree with him.

Pesachim 25a

Pesachim 25a:10

Establishes the principle that danger to life overrides prohibitions, forming part of the Talmudic foundation for pikuach nefesh on Shabbat.

The Gemara discusses another matter pertaining to deriving benefit. Rabbi Ya’akov said that Rabbi Yoḥanan said with regard to objects from which it is prohibited to derive benefit: One may heal oneself with any substance except for wood of a tree designated for idolatry [asheira]. The Gemara asks: What are the circumstances? If we say it is a case in which there is danger to a person’s life, then it is permitted to use even the wood of an asheira. And if it is a situation where there is no danger, then all the prohibited substances in the Torah also may not be used, as one may not derive benefit from them. The Gemara answers: Actually, it is referring to a case where there is danger, and even so, one my not derive benefit from the wood of an asheira. As it was taught in a baraita that Rabbi Eliezer says: If it is stated: “And you shall love the Lord your God with all your heart, and with all your soul,” why is it stated: “And with all your might” (Deuteronomy 6:5)? And if it is stated: “With all your might,” why is it stated: “With all your soul”? One of these statements appears to be superfluous. Rather, it is to tell you that if there is a person whose body is more beloved to him than his property, therefore it is stated: “With all your soul.” The verse teaches that one must be willing to sacrifice his life to sanctify God’s name. And there is a person whose property is more beloved to him than his body, therefore it is stated: “With all your might.” Rabbi Eliezer understands the phrase: “With all your might,” to mean: With all your possessions. Apparently, there are circumstances in which a person must be prepared to die rather than be healed with a prohibited substance.

Shulchan Arukh, Orach Chayim 329:6

Governs Shabbat rescue and security situations: danger to life overrides Shabbat restrictions, and one must act decisively to provide necessary rescue. This is the central framework for carrying or using communications equipment when a genuine danger exists.

Regarding non-Jews who besiege Jewish cities: if they come for money, we do not desecrate the Shabbat [to protect ourselves], but if they came to kill or come with no presented reason, we go out with weapons and desecrate the Shabbat. In a city that is near the border, even if they just come for straw or hay, we desecrate the Shabbat. Rem"a: Even if they haven't come but they want to come (Or Zarua). There is one who says that in our times, even if they come for money, we desecrate the Shabbat, because if we do not allow them to plunder the money, they will kill, and so it becomes a case of saving life. Arukh HaShulchan, Orach Chaim 329

Arukh HaShulchan, Orach Chaim 329:9

Discusses the practical parameters of pikuach nefesh on Shabbat and the broad obligation to respond to possible danger. It is relevant to evaluating whether carrying a radio is justified by an actual security risk.

recovered from “Peninei Halakhah, Shabbat Saving Lives”

Rav Eliezer Melamed (Peninei Halakhah, Shabbat, Saving Lives)

Peninei Halakhah, Shabbat 27:17

Provides a contemporary practical overview of pikuach nefesh on Shabbat, including security situations and the rule that one should not be stringent when life may be at risk. It is useful for comparing contemporary Ashkenazi and Sephardi applications, though local rulings may differ.

In an area enclosed by an eruv, emergency medical professionals and volunteers who always carry beepers or cell phones may carry these devices on Shabbat. Similarly, one who always carries a pistol or rifle may carry it on Shabbat. Muktzeh is not an issue, because many maintain that a pistol is a kli she-melakhto le-heter, since its purpose is defense and deterrence. Similarly, since a two-way radio is designed to help save lives, it is also a kli she-melakhto le-heter. A cell phone is used primarily for calls that are unrelated to saving lives, so it is a kli she-melakhto le-isur. Nevertheless, one may carry such an object to use it le-tzorekh gufo, and therefore it may be carried to save lives. However, in an area without an eruv, one should not carry these items. When there are life-saving reasons for people to remain close to weapons and communication devices in case of emergency, they may carry these items to places where one normally goes on Shabbat, such as to prayers and celebrations. If we do not allow this, no one will volunteer to undertake security and rescue efforts. In general, this consideration is used to permit rabbinic transgressions. Only under very pressing circumstances is it permitted for one to transgress Torah prohibitions (see above, n. 12). Therefore, one should carry the two-way radio with a shinui (for example, under one’s shirt), which makes the transgression rabbinic. However, one should carry the gun normally, because it would be dangerous to carry it with a shinui. Additionally, some maintain that for security personnel, a weapon is not considered something that is carried, but an article of clothing that is worn.

Kitzur Shulchan Arukh Yalkut Yosef, Orach Chaim 318:45

Rav Yitzchak Yosef rules that a religious soldier may not deliberately listen to news or music from a radio turned on by another soldier, but may remain in the room and hear it incidentally without intending to listen.

Rav Mordechai Eliyahu (Maamar Mordechai Hilchot Shabbat, Chelek 5 118:9)

Maamar Mordechai Hilchot Shabbat, Chelek 5 118:9

Rabbi Mordechai Eliyahu rules that one may leave a radio on during wartime, preferably using a “silent wave” activated only by an alarm, but may not set a Shabbat clock to activate a radio or television, even for non-Jewish stations, because of Shabbat desecration, noise, and the risk of adjusting the volume or frequency.

Kitzur Shulchan Arukh Yalkut Yosef, Orach Chaim 318:43

Rav Yitzchak Yosef rules stringently against listening to radio, or preparing a tape recorder or record player to operate automatically on Shabbat, even when activated by a Shabbat timer or operated by non-Jewish broadcasters, and says a notice at the door does not permit it.

Kitzur Shulchan Arukh Yalkut Yosef, Orach Chaim 318:46

Rav Yitzchak Yosef rules that although there may be grounds to permit listening to news from a non-Jewish neighbor who turned on the radio for his own needs, one should nevertheless act stringently, including regarding broadcasts operated by non-Jews for the general non-Jewish public.

Rav Yitzchak Yosef rules that one may not listen to radio music or news, or use a timer to operate a tape recorder, on Shabbat, even when prepared before Shabbat or operated by non-Jews, because this demeans Shabbat; in Israel, listening also benefits from Jews’ Shabbat labor.

Rav Yitzchak Yosef states that operating a gramophone or turning on a radio is prohibited on Shabbat and Yom Tov, even when the radio is set to activate through a timer, and that lenient local practice reflects an ignorant custom.

Rav Eliezer Melamed (Peninei Halakhah, Shabbat 17:3)

Peninei Halakhah, Shabbat 17:3

A contemporary practical treatment of carrying on Shabbat and the laws of public domains, with discussion of permitted wearables and emergency situations. It provides accessible synthesis but should not replace case-specific rabbinic guidance.
