Rebuilding sukkah on Chol HaMoed

Both Mishnah Berurah 637:1 and Arukh HaShulchan, Orach Chaim 637:1 rule that one who did not build a sukkah before the chag, whether inadvertently or intentionally, may build it during Chol HaMoed, even on the last day of the festival, since the verse is understood as permitting construction on whichever of the seven days one chooses.

The Gemara asks: Does the mishna cite an incident to contradict the preceding halakha that minors that are not independent are exempt from the mitzva of sukka? The Gemara answers: The mishna is incomplete, and it teaches the following: And Shammai is stringent even with very small children; and there was also an incident and the daughter-in-law of Shammai the Elder gave birth and Shammai removed the coat of plaster from the roof and left the beams and roofed with the beams over the bed for the newborn minor. MISHNA: All seven days of Sukkot, a person renders his sukka his permanent residence and his house his temporary residence. If rain fell, from when is it permitted to vacate the sukka? Ravina said: With regard to the stolen large beam of a sukka, the Sages instituted an ordinance that the robber need not return it intact, due to the general ordinance of a beam. By the letter of the law, one who stole a beam and incorporated it in the construction of a new house is required to dismantle the house and return the beam. The Sages instituted an ordinance requiring the robber to repay the monetary value of the beam instead. They instituted this ordinance to facilitate the repentance of the robber, who would be less likely to repent if doing so entailed destruction of the house. The Gemara asks: This is obvious. In what way is the beam different from other wood used in establishing the sukka? The Gemara answers: Lest you say: Wood is common, and therefore the owners are more likely to despair of recovering the wood and will suffice with receiving monetary restitution and replacing the wood, but, with regard to this large beam, which is not common, say that there is no despair, and the robber is required to return the actual beam, therefore, Ravina teaches us that the ordinance applies even to this beam, and the robber is required to return only its monetary value. The Gemara notes: This halakha that the robber need not dismantle the sukka and return the beam applies only within the seven days of the Festival. However, after the seven days, the beam returns to the owner intact. And if the robber attached it with mortar and it is affixed permanently to the sukka, then even after the seven days of the Festival, the ordinance remains in effect, and the robber gives the original owner the monetary value of the beam.

The Gemara asks: From where does Rabbi Eliezer derive this matter? If you say he derives it from the halakha with regard to the omer and the two loaves, this can be refuted by saying that the performance of facilitators is permitted on Shabbat in these cases as these are the necessities of Temple service to God on High. If you say he derives it from the halakha with regard to lulav, this too can be refuted, as lulav requires four species and therefore has special significance. Rather, he derived it through the following verbal analogy based upon the expression “seven days,” which is stated with regard to both the mitzva of sukka and the mitzva of lulav. Just as below, with regard to the mitzva of lulav, its facilitators override Shabbat, so too here, with regard to the mitzva of sukka, its facilitators override Shabbat.

MISHNA: With regard to the door to a rear court, i.e., a door that opens from a house to the courtyard situated behind it, which is typically not a proper door but merely a wooden board without hinges that closes off the doorway; and likewise bundles of thorns that seal a breach; and reed mats, one may not close an opening with them on Shabbat. This would be considered building or completing a building, unless they remain above the ground even when they are open. GEMARA: And the Gemara raises a contradiction from a baraita: With regard to a door, or a mat, or a lattice [kankan] that drag along the ground and are used for closing up openings, when they are tied and suspended in place one may close an opening with them on Shabbat; and needless to say this is permitted on a Festival. According to the baraita, the critical factor is apparently that they must be tied and suspended, not that they have to be held up above the ground. The Sages taught a baraita: With regard to branches of thorn bushes or bundles of wood that were arranged so that they sealed off a breach in a courtyard, when they are tied and suspended in place, one may close an opening with them on Shabbat; and needless to say, this is permitted on a Festival.

You must say it is the festival of Sukkot. When exactly? If we say it is on the Festival day itself, is labor permitted on a Festival? Rather, it is referring to the intermediate Festival days. But on the intermediate Festival days, too, is it permitted? One may perform only work that, if neglected, would result in irretrievable loss. Rather, you must explain that “the Festival of gathering” is referring to the season of the year, i.e., the Festival that occurs during the time of gathering. Here too: “The Festival of harvest” means a Festival that occurs during the time of harvest. § The Gemara comments: Since Reish Lakish does not dispute the accuracy of Rabbi Yoḥanan’s statement, it may be inferred from their statements that both of them hold that the performance of labor during the intermediate Festival days is prohibited by the Torah. The verse therefore states: “And on the seventh day there shall be a solemn assembly,” literally, pause. This indicates that the seventh day alone is precluded from the performance of all labor, but the other six days are not precluded from the performance of all labor but only from certain forms of work. Since the Bible does not specify which types of work are prohibited, the verse has therefore entrusted the matter to the Sages exclusively, to tell you on which day work is prohibited and on which day it is permitted, and similarly which labor is prohibited and which labor is permitted.

ד) מאי דשרי לעשות סוכה בחו"ה אע"ג דאסור לבנות אפי' בנין כל שהוא בחו"ה כבש"ע סי' תק"ם ואפי' בנין של מצוה דרבים כגון בהכ"נ וכן לשאר צרכי מצוה אסור כבש"ע סי' תקמ"ד. נ"ל משום דעשיית סוכה בחו"ה של חג כלצורך המועד חשיבא ולהכי שרי. ולפ"ז אפשר דאין לעשות הסוכה בחו"ה אלא בנין מעשה הדיוט אבל בנין דמעשה אומן אסור. כי כל דבר שא"צ אוכל נפש אעפ"י שהוא לצורך המועד אסור מעשה אומן כ"א בדבר האבד. אם לא שנאמר דגם עשיית הסוכה כצורך אוכל נפש היא כיון שאסור לאכול בחג חוץ לסוכה. אבל היותר נראה דלא חשיב הסוכה צורך אוכל נפש כיון דאם אין לו סוכה מותר לו לאכול ואינו מחויב להתענות. בית השואבה או' ג' ולא שת לבו כי א"צ לדבר בזה כי הדבר מפורש לעיל סי' תקמ"ה סעי' ב' וסעי' ג' ובדברינו לשם אות ט"ו כי לצירך מצוה השייכא לחו"ה אפי' מעשה אומן שרי יעו"ש וע"כ אם א"א במעשה הדיוט פשיטא דמותר במעשה אומן. וגם מ"ש המאמ"ר אות ב' כבר השיגו מ"ב בב"ה יעו"ש: ה) סכך שנפל ביו"ט ונשאר אהל טפח אין להוסיף ביו"ט. תשובת שואל ומשיב. פת"ע או' ב' ועיין א"א לעיל סי' תר"ל או' י"ט דמשמע דעל ידי עכו"ם שרי יעו"ש והיינו בא"א באחרת ואפ"ה נראה דקשה הדבר להתיר כיון שיש בו איסור משום עשיות אהל וכל דבר שאסור לישראל לעשותו אסור לומר לעכו"ם לעשותו כמ"ש לעיל סימן תצ"ה או' ב' יעו"ש. ועיין תשו' באר יצחק סי' י"ג מ"ש להקל בזה והב"ד הפת"ע או' א' ולא נתחוורו לי דבריו על כן לא העתקתים. וכן כל דבר שנראה לפענ"ד שאינו מחוור לענין דינא איני מעתיקו:

דברים האסורים משום אוהל בשבת. ובו יג סעיפים: אסור לעשות אהל בשבת ויו"ט אפי' הוא עראי ודוקא גג אבל מחיצות מותר ואין מחיצה אסורה אא"כ נעשית להתיר סוכה או להתיר טלטול: הגה אבל מחיצה הנעשית לצניעות בעלמא שרי (טור) ולכן מותר לתלות וילון לפני הפתח אף על גב שקבוע שם (א"ז וב"י) וכן פרוכת לפני ארון הקודש ובלבד שלא יעשה אהל בגג טפח (ב"י וכלבו) וכן מותר לעשות מחיצה לפני החמה או הצינה או בפני הנרות שלא יכבה אותן הרוח (מרדכי ריש פרק כירה) אבל אסור לעשות מחיצה בפני אור הנר כדי שישמש מטתו (ד"ע) וכן לפני ספרים כדי לשמש או לעשות צרכיו אם לא שהיה מבעוד יום טפח שאז מותר להוסיף עליה בשבת (מרדכי ריש פ' כירה):

Yosef Hayyim presents a case where a sukkah’s walls fell after the walls had been built before the s’khakh, and discusses the resulting dispute over whether the s’khakh remains valid after the walls are repaired, including whether one may eat there on Yom Tov or must repair it during Chol HaMoed.

שאלה. ראובן עשה סוכה כהלכתה בשלשה דפנות ועשה הדפנות תחלה ואח"כ הסכך, ובערב יו"ט אחר הצהרים נפלו הדפנות ונשאר הסכך כמו שהוא עומד על עמודים וחזר ראובן ותיקן הדפנות ובסכך לא עשה כלום, ונסתפקנו אם מותר בכך או"ד אסור משום תעשה ולא מן העשוי, שהיה צריך להסיר הסכך אחר עשיית הדפנות ולהחזירו, והנה זה ראובן לא ידע הדין וישב בסוכה ות"ח נכנס אצלו בשחרית ביום א' של סוכות וידע המעשה ונסתפק אם יכול לאכול בה ביו"ט אע"פ שיש לו סוכה אחרת בביתו בגג דחשיב דיעבד וטריחא ליה מלתא לעלות לגג ביום, או"ד אסור לאכול בה עד שיתקן בחוה"מ, ואת"ל כיון דיש לו סוכה אחרת בביתו לא יאכל בזו הנה אם אין לו סוכה בביתו כיצד יעשה ביו"ט יורינו המורה לצדקה, ושכמ"ה: תשובה. הנה בענין עושה טפח סמוך לסכך שדברו בו הט"ז והמש"ז בסי' תרל"ה ובכורי יעקב שם סק"ח אין אנחנו צריכים לדבר בנ"ד בזה כי השואל הוא ת"ח וא"ל בפירוש דלא הוה טפח סמוך לסכך כלל וכל הדפנות נפלו לגמרי והסכך נשאר עומד על עמודים והעצים השוכבים על העמודים שעליהם מונח הסכך הם דקים שאין בהם טפח. והנה בדין סכך שעשאו קודם הדפנות ס"ל להגאון הלבוש דפסול גם בדיעבד וכמ"ש בסי' תקכ"ו וכן הסכים הט"ז בסי' תרל"ה ואליה רבא ופרי מגדים ובכורי יעקב, אך הב"ח ז"ל מתיר בדיעבד וכן הסכים שיורי כנה"ג וברכי יוסף כהב"ח ובספר בית השואבה כתב דמהרי"ל ס"ל לפסול כנז' בדף נו"ן ע"ב ע"ש, נמצא דין זה מחלוקת בין גדולי האחרונים, יש פוסלים גם בדיעבד ויש מתירים בדיעבד ורבו האוסרים: מיהו בנ"ד יש לחלק דכל הפוסקים הנז"ל מדברים בהיכא שעשה מתחלה הסכך קודם הדפנות, אבל בנ"ד עשה הדפנות קודם ואח"כ הסכך אלא דאח"ז בצהרים נפלו הדפנות ונשאר הסכך לבדו בלי דפנות אך הוא מתחלה נעשה בכשרות כהלכה, וי"ל בזה גם האוסרים יודו דמהני ליה לעשות הדפנות אחר שנפלו וישאר הסכך במקומו כיון דנראה מקודם ולא דמי לנידון הפוסקים דלא נראה מעיקרא כלל בשום זמן. וראיתי להרב בית השואבה בדיני סוכת גנב"ך ורקב"ש אות י"א דף ע"ג ע"א שהקשה לסברת הפוסלים מגמרא ערוכה דמתיר לעשות אדם לחבירו דופן לסוכה אפילו ביו"ט להכשירה דמוכח אע"פ שעושה הדפנות אחר שסיכך הסוכה כשרה לית בה משום תולמ"ה ונתפלא בזה והניח בצ"ע, ובאמת החילוק הוא פשוט דהתם איירי שכבר נעשה הסכך בכשרות שעשהו אחר הדפנות, אלא שביו"ט נפל הדופן ורוצה להניח אדם לעשותו דופן ובכה"ג אמרינן אפשר דכולהו מודים דכשר וליכא משום תולמ"ה והם לא פסלו אלא בהיכא שהסכך מעיקרו נעשה בפיסול:
