Leaving Eretz Yisrael: Halachic Conditions and Exceptions

Sources discuss the fundamental prohibition against departing Eretz Yisrael to the Diaspora, along with recognized exceptions such as Torah study, marriage, earning a livelihood, and circumstances of hardship. The sources also address spousal rights to compel relocation to the Land and the consequences of refusing to immigrate.

What the sources say

The core ruling is that of Rambam (Hilchot Melachim 5:9), who states that it is forbidden to leave Eretz Yisrael for the Diaspora permanently, but permits departure for three purposes — to study Torah, to marry, or to engage in commerce — provided one intends to return, and Rav Eliezer Melamed (Peninei Halakhah, The Nation and the Land 3:9) affirms this same threefold formulation while adding that during a severe famine extended departure is also permitted, though remaining is still considered a higher level of piety.

This limitation to study, marriage, and (per the Rambam) commerce is already found in the Gemara at Avodah Zarah 13a, which discusses when a kohen may contract impurity outside the land for Torah study or marriage, and Tosafot on Avodah Zarah 13a clarifies that this leniency applies specifically to these weighty mitzvot and only when one intends to return, not to lesser mitzvot generally.

The Gemara at Kiddushin 31b records that Rabbi Yochanan ruled it is flatly forbidden to leave Eretz Yisrael for the Diaspora, even in the case of Rav Asi wishing to greet his elderly mother, underscoring the severity of the prohibition apart from the specific exceptions.

The severity of departure is further reflected in Ketubot 110b and Ketubot 111a, which teach that a spouse may be compelled to ascend to Eretz Yisrael or forced not to leave it, on pain of divorce, and Rashi (Shmuel I 26:19) states that one who leaves Eretz Yisrael for the Diaspora in the time of the Temple is considered as though he worshipped idolatry, a theme echoed by Sefer Charedim, Commandments Dependent on the Land of Israel 1:14 regarding the fate of Elimelech, Machlon, and Chilyon, and by Rav Mordechai Eliyahu (Maamar Mordechai Hilchot Shabbat, Chelek 1 4:6) who likewise cites the Rambam's formulation that one who descends from the land is considered as though he served idolatry.

The spousal-compulsion halacha itself is codified in Shulchan Arukh, Even HaEzer 75:3-5 and detailed by Tur, Even HaEzer 75, Beit Yosef, Even HaEzer 75:4-5, and Bach, Even HaEzer 75:4-6, all of whom work out the financial consequences and territorial distinctions of a spouse who refuses to ascend or insists on leaving, while Pitchei Teshuva on Shulchan Arukh, Even HaEzer 75:6 and Responsa Chatam Sofer, Yoreh De'ah 234:7 debate whether the obligation to dwell in the land today rests on the dependent mitzvot or on the inherent sanctity of the land itself, a distinction bearing on how seriously the prohibition on leaving is to be weighed in practice.

Sdei Chemed, Maarechet Alef 246 raises a significant qualification, citing the Semag and Hagahot Maimoniyot in the name of Rabbeinu Elchanan of Mitz, that the Torah prohibition against leaving the land applies strictly to returning to Egypt, while leaving Eretz Yisrael for other Diaspora lands is only rabbinically restricted, a distinction that narrows the scope of the Torah-level prohibition discussed by the other sources.

Gray Matter III, Israel, Must Diaspora Jews Make Aliyah? reports that Rav Moshe Feinstein reasoned from the Rambam's formulation — which forbids leaving but does not forbid residing outside the land — that there is no absolute obligation to move to Eretz Yisrael, so that Rabbeinu Chaim Cohen's concern about failing to properly fulfill the mitzvot dependent on the land must be weighed case by case.

B'Mareh HaBazak Volume IV 140:7-9 rules practically, citing Rav Shaul Yisraeli, that leaving the land without intent to return is forbidden, while leaving with intent to return is permitted for any purpose, even discretionary ones such as business, educational travel, or a family vacation where no comparable vacation is available in Israel.

Teshuvos V'hanhagos (Teshuvos V'hanhagos 2:565) addresses whether a kohen may travel to Eretz Yisrael intending to return abroad, concluding on the basis of the Yerushalmi that a kohen who reaches the land, even temporarily, may not then leave it.

Ma'ayan Omer (Maayan Omer 11:5:17) holds that one may leave Eretz Yisrael for the Diaspora only to study Torah or to marry, following Tosafot's restriction of the leniency to these two mitzvot, and discusses this in the context of a case of leaving to perform yibbum for a childless deceased brother.

Tzitz Eliezer (Tzitz Eliezer 13:22) clarifies that the restrictions on leaving apply specifically to departing Eretz Yisrael for the Diaspora, not to travel from Jerusalem to another place within Eretz Yisrael, since only the former may involve a Torah-level prohibition.

Minchas Yitzchak (Minchas Yitzchak 10:108) discusses the relative sanctity of Eretz Yisrael and other lands, concluding that leaving Eretz Yisrael involves both forfeiting its mitzvot and departing from its greater holiness, that leaving Bavel may be similarly restricted due to its own Torah sanctity, and that the rule permitting movement to Eretz Yisrael still applies today.

Mishneh Halachos (Mishneh Halachos 11:431) rules that leaving Eretz Yisrael for ordinary touring is forbidden, whether on Chol HaMoed or during the rest of the year, but permits departure for a mitzvah purpose such as visiting parents, a rav, or a friend, or for earning a livelihood.

Ketubot 110b

Ketubot 110b:14-15

The central Talmudic passage on the Land of Israel: it discusses the obligation to live there, the ability of spouses to compel one another to immigrate, and the prohibition or restriction on leaving the Land.

§ The Sages taught: If the husband says that he wishes to ascend, i.e., to immigrate to Eretz Yisrael, and his wife says that she does not wish to ascend, one forces her to ascend. And if she will not do so, as she resists all attempts to force her to make the move, she is divorced without receiving her marriage contract, i.e., she forfeits her rights to the benefits outlined in the marriage contract. If she says that she wishes to ascend to Eretz Yisrael and he says that he does not wish to ascend, one forces him to ascend. And if he does not wish to immigrate, he must divorce her and give her the marriage contract. If she says that she wishes to leave Eretz Yisrael, and he says that he does not wish to leave, one forces her not to leave. And if she does not wish to stay in Eretz Yisrael and resists all attempts to force her to stay, she is divorced without receiving her marriage contract. If he says that he wishes to leave Eretz Yisrael and she says that she does not wish to leave, one forces him not to leave. And if he does not wish to stay in Eretz Yisrael, he must divorce her and give her the marriage contract. § In relation to the basic point raised by the mishna concerning living in Eretz Yisrael, the Sages taught: A person should always reside in Eretz Yisrael, even in a city that is mostly populated by gentiles, and he should not reside outside of Eretz Yisrael, even in a city that is mostly populated by Jews. The reason is that anyone who resides in Eretz Yisrael is considered as one who has a God, and anyone who resides outside of Eretz Yisrael is considered as one who does not have a God. As it is stated: “To give to you the land of Canaan, to be your God” (Leviticus 25:38).

Ketubot 111a

Ketubot 111a:3-4

Continues the discussion of residence in Eretz Yisrael, including the famous oaths associated with the exile and statements concerning dwelling in the Land.

And Rabbi Zeira maintains that the oath mentioned in that verse means that the Jews should not ascend to Eretz Yisrael as a wall, i.e., en masse, whereas individuals may immigrate as they wish. The Gemara asks: And what does Rav Yehuda reply to this? The Gemara answers that this command is derived from another verse in which “I adjure you” (Song of Songs 3:5) is written. The Gemara asks: And how does Rabbi Zeira explain the repetition of this oath in these verses? The Gemara explains: That verse is necessary for that which was taught by Rabbi Yosei, son of Rabbi Ḥanina, who said: Why are these three oaths (Song of Songs 2:7, 3:5, 8:4) needed? One, so that the Jews should not ascend to Eretz Yisrael as a wall, but little by little. And another one, that the Holy One, Blessed be He, adjured the Jews that they should not rebel against the rule of the nations of the world. And the last one is that the Holy One, Blessed be He, adjured the nations of the world that they should not subjugate the Jews excessively. § Rav Yehuda said that Shmuel said: Just as it is prohibited to leave Eretz Yisrael and go to Babylonia, so too, is it prohibited to leave Babylonia for any of the other lands. Rabba and Rav Yosef both say: Even to go from Pumbedita to Bei Kuvei, which is located beyond the border of Babylonia proper, is not permitted. The Gemara relates: A certain man left Pumbedita to live in Bei Kuvei, and Rav Yosef excommunicated him. A certain man left Pumbedita to live in Astonia, which also lay beyond the borders of Babylonia proper, and he died. Abaye said: Had this Torah scholar wanted, he would still be alive, as he could have stayed in Babylonia.

Avodah Zarah 13a

Avodah Zarah 13a:7-8

Discusses leaving Eretz Yisrael in connection with prohibited commercial activity and the movement of people, distinguishing temporary travel and other circumstances from permanent departure.

The Gemara asks: And is it so that they do not disagree? But isn’t it taught in a baraita: One may go to a fair of gentiles, whose purpose is to honor idol worship, and buy from the gentiles animals, and slaves, and maidservants, as the purchase raises the items to a more sanctified state; and he may buy houses, fields, and vineyards from them, due to the mitzva to settle Eretz Yisrael. And one may write the necessary deeds and confirm them in their gentile courts [be’arkaot], although this involves an acknowledgement of their authority, because it is as though he is rescuing his property from their hands, as the court’s confirmation and stamp of approval prevents the seller from denying the sale and claiming that the property still belongs to him. And if he is a priest, he may become ritually impure by going outside Eretz Yisrael, even though a priest is usually prohibited from leaving Eretz Yisrael to the impure land outside, in order to litigate with them and to contest their claims. And just as a priest may become ritually impure by going outside Eretz Yisrael, so may he become ritually impure for this purpose by entering a cemetery. The baraita continues: And a priest may likewise become ritually impure and leave Eretz Yisrael in order to study Torah or in order to marry a woman. Rabbi Yehuda says: When does this allowance apply? It applies when he cannot find a place to study in Eretz Yisrael. But when the priest can find a place to study in Eretz Yisrael, he may not become ritually impure by leaving the country.

Kiddushin 31b

Kiddushin 31b:7-9

Chachmei Bavel recount that Rav Asi left for Eretz Yisrael after realizing he could not satisfy his senile mother’s requests, and Rabbi Yoḥanan initially ruled that leaving Eretz Yisrael was prohibited but ultimately permitted Rav Asi to leave to meet her.

Rav Asi had an elderly mother. She said to him: I want jewelry, and he made jewelry for her. She said to him: I want a man whom I can marry, and he said to her: I will seek one for you. She said to him: I want a husband who is as handsome as you. At this point, he realized that she was senile, and that he would be unable to fulfill all her requests. Therefore, he left her and went to Eretz Yisrael. Rav Asi heard that she was following him to Eretz Yisrael. He came before Rabbi Yoḥanan and said to him: What is the halakha with regard to leaving Eretz Yisrael to go outside of Eretz Yisrael? Rabbi Yoḥanan said to him: It is prohibited. Rav Asi further asked: If one is going to greet his mother, what is the halakha? Rabbi Yoḥanan said to him: I do not know. Rav Asi waited a little while, and then came back to him. Rabbi Yoḥanan said to him: Asi, you are evidently determined to leave. May the Omnipresent return you in peace, and he said no more. Rav Asi came before Rabbi Elazar, because he did not know how to interpret Rabbi Yoḥanan’s statement. He said to Rabbi Elazar: God forbid, perhaps he is angry with me that I wished to leave? Rabbi Elazar said to him: What exactly did he say to you? Rav Asi said to him: May the Omnipresent return you in peace. Rabbi Elazar said to him: If it is so that he was angry, he would not have blessed you. Rabbi Yoḥanan certainly gave you permission to leave. In the meantime, while he was traveling to meet her, Rav Asi heard that her coffin was coming, i.e., his mother had died and her coffin was being brought to Eretz Yisrael. He said: Had I known I would not have left, as after his mother’s death he was not obligated to leave Eretz Yisrael to honor her.

Mekhilta DeRabbi Yishmael, Tractate Pischa 1:9

The passage states that before Eretz Yisrael was chosen, all lands were valid for the Divine declarations, and before Jerusalem was chosen, all of Eretz Yisrael was valid for altars; once Eretz Yisrael and then Jerusalem were chosen, these permissions ceased, as indicated by Devarim 12:13.

Rashi on I Samuel 26:19

Rashi states that one who leaves Eretz Yisrael for chutz la’aretz during the time of the Temple is considered as though he worships avodah zarah.

Shulchan Arukh, Even HaEzer 75

Shulchan Arukh, Even HaEzer 75:3-5

Rules that a spouse may compel the other to immigrate to Eretz Yisrael, and that one may not leave Eretz Yisrael for the Diaspora; it also discusses exceptions and the consequences of refusing to relocate.

What is this talking about? When going from outside the land to outside the land, or from the land of Israel to the land of Israel. But from outside the land to the land of Israel, they force her to go up even if it is from a nice lodging to poor lodgings, even if it is to a place that has mostly Jews to a place that has mostly non-Jews. They do not take her from the land of Israel to outside the land even if it is from poor lodgings to nice lodgings and even if it is from a place that has mostly non-Jews to a place that has mostly Jews. If he proposes to ascend to Eretz Yisrael and she does not want to, he must divorce her without her dower. Rem"a: But she keeps her milog assets, and takes extant tzon barzel assets; if they are no longer extant, then if he ruined them, he need not repay the tzon barzel assets, but must pay the milog assets. If they were stolen or lost, she has no claim on the milog assets, but he must repay the tzon barzel assets (Mordechai at the end of Ketubot, citing Maharam). Her forfeiture of the dower applies only as long ashe remains in Eretz Yisrael. However, if he returns to settle in the Diaspora after a a few years, he must pay the dower to her or her inheritors (ibid.). If she proposes ascending [to Eretz Yisrael] and he does not want to, he must divorce her and give her dower. The same applies for anyplace in Eretz Yisrael to Jerusalem. Anyone may initiate ascent to Eretz Yisrael, and no one may compel departure; anyone may initiate ascent to Jerusalem, and no one may compel departure. There is one who says, that which we compel to go up to the land of Israel, that's when it's possible without danger. Therefore, from the end of the West until Noe Amon we don't compel to go up, and from Noe Amon and upwards, we compel to go up by the way of the dry land, and also the way of the sea during the "days of sun" (summer), if there are no robbers.

Azikri states that dwelling in Eretz Yisrael is a Torah commandment comparable to all the mitzvos, and that those who leave for the Diaspora are likened to idolaters; he cites the punishment of Elimelech, Machlon, and Chilyon for leaving and says they were culpable for failing to seek mercy for their generation.

Likkutei Sichos 18

The passage states that just as leaving Eretz Yisrael for other lands is prohibited, leaving Bavel for other countries is also prohibited, based on the verse “בבלה יובאו ושמה יהיו.

In this sichaThe sicha analyzes the Rambam's ruling that prohibits leaving Babylonia (Bavel) for other countries, drawing a parallel to the prohibition of leaving Eretz Yisrael. Unlike Rashi, who views the Babylonian restriction as dependent on the presence of active Torah academies, the Rambam holds it is a permanent law. The Rebbe explains that this is because Bavel was divinely chosen as the designated place of exile, establishing a unique spiritual status that mirrors the chosenness of Eretz Yisrael.

Rav Eliezer Melamed (Peninei Halakhah, The Nation and the Land 3:9)

Peninei Halakhah, The Nation and the Land 3:9

The passage states that leaving Eretz Yisrael is generally prohibited, though temporary departure is permitted for Torah study, marriage, or commerce with plans to return, and prolonged departure may be allowed during severe famine; permanent residence abroad is forbidden except under extreme conditions, while public figures should exercise greater caution.

Gray Matter III, Israel, Must Diaspora Jews Make Aliyah?

Gray Matter III, Israel, Must Diaspora Jews Make Aliyah?

The passage cites the Rambam’s prohibition against leaving Israel, Rav Feinstein’s inference that there is no absolute obligation to move there, and the need to assess each case individually, including the concern that one may fail to observe mitzvot hateluyot ba’aretz properly amid the powerful yeitzer hara in the Holy Land.

The Rambam (Hilchot Melachim 5:9) writes that it is prohibited to leave Israel but does not state that one is prohibited to reside outside Israel. If an absolute obligation to move to Israel exists, writes Rav Feinstein, the Rambam would have recorded a prohibition to live outside of Israel. Rav Feinstein concludes that since there is no absolute obligation to move to Israel, one must "certainly" consider Rabbeinu Chaim Cohen's concern that one might not fulfill the mitzvot hateluyot ba’aretz properly. We must weigh each case individually to see if it is appropriate for him to move to Israel, since the impact of the yeitzer hara (evil inclination) in the Holy Land, whose holiness is exceedingly great, is immense and very seductive.

Maamar Mordechai Hilchot Shabbat, Chelek 1 4:6

Rabbi Mordechai Eliyahu cites the view that traveling four cubits in Eretz Yisrael is a mitzvah even without intending to settle there, and notes that leaving Eretz Yisrael for abroad is forbidden except under special conditions, with one who descends from the land described as “as though he worships idols.

Rav Yitzchak Yosef rules that emissaries temporarily residing abroad with their families for a known period of a year or more, intending to return to Eretz Yisrael, must conduct themselves fully as residents of the Diaspora regarding the second day of Yom Tov, publicly and privately, including prayer, refraining from tefillin, Torah reading, and the second-night Pesach seder, and may not desecrate it by driving or similar acts.

Kitzur Shulchan Arukh Yalkut Yosef, Orach Chaim 668:42

Rav Yitzchak Yosef states that a visitor from outside Israel who plans to return abroad may observe Shemini Atzeret like his Israeli hosts and eat indoors when eating alone in the sukkah would be difficult or burdensome, but if staying independently, such as in a hotel, he should follow his customary practice from abroad of eating and sleeping in the sukkah.
