Tanakh Study Permitted on Tisha B'Av

Jewish law restricts the study of Torah and rabbinic texts on Tisha B'Av as an expression of mourning, but permits the reading of certain biblical and other texts. What the sources say

The Gemara (Taanit 30a) establishes the foundational rule: just as a mourner is forbidden to engage in Torah study, so too on Tisha B'Av one may not read from the Torah, the Prophets, or the Writings, nor study Mishnah, Gemara, midrash, halakhot, or aggadot — grounding the prohibition in the pasuk (Kitzur Shulchan Arukh 124:5) that Torah study gladdens the heart, which is incompatible with the day's spirit of grief.

The Gemara itself already carves out exceptions for texts that sadden rather than gladden: one may read Iyov, Eichah, and the ominous prophecies in Yirmiyahu — but passages of consolation must be skipped, as the Shulchan Arukh (Orach Chayim 554:1) and the Rambam (Mishneh Torah, Fasts 5) both rule explicitly.

The Tur (Orach Chayim 554) records that R. Yehuda goes further and forbids even reading from an unfamiliar place — a leniency R. Meir had permitted — and rules the halakhah follows R. Yehuda; the Tur also notes that Maharam of Rothenburg criticized the Ashkenazic practice of reading consolatory verses in Yirmiyahu as an outright violation.

Later authorities expand the permitted list in one direction: the Shulchan Arukh (Orach Chayim 554:1) permits the commentary on Eichah, the commentary on Iyov, and the chapter Eilu Megalchin (Moed Katan ch. 3), while the Arukh HaShulchan (Orach Chaim 554) adds that calamitous passages in other prophets may similarly be permitted, since the Gemara singled out Yirmiyahu only because it contains the greatest concentration of such material.

The Sages taught: All mitzvot practiced by a mourner are likewise practiced on the Ninth of Av: It is prohibited to engage in eating, and in drinking, and in smearing oil on one’s body, and in wearing shoes, and in conjugal relations. It is prohibited to read from the Torah, from the Prophets, and from the Writings, or to study from the Mishna, from the Gemara, and from midrash, and from collections of halakhot, and from collections of aggadot. However, one may read from a place in the Bible that he is unaccustomed to reading, as it will be difficult for him and he will not derive pleasure from it, and he may likewise study from a place of the Talmud that he is unaccustomed to studying. And one may read from the book of Lamentations; from the book of Job; and from the evil matters in Jeremiah, i.e., his prophecies of doom. And schoolchildren interrupt their studies for the day because it is stated: “The precepts of the Lord are right, rejoicing the heart” (Psalms 19:9).

Torah scholars should not exchange greetings on Tish'ah B'Av. Instead, they should sit in agony and frustration like mourners. If a common person greets them, they should reply to him weakly, in a somber tone. On Tish'ah B'Av, it is forbidden to read from the Torah, the Prophets, or the Sacred Writings [or to study] the Mishnah, Torah law, the Talmud, or the Aggadic works. One may study only Job, Eichah, and the prophecies of retribution in Jeremiah. Children should not study in school on this day. There are some sages who do not wear the head tefillin.

Tisha b'Av is forbidden for washing, anointing, wearing leather shoes, and marital relations. It is also forbidden to read from the Torah, Nevi'im, and Ksuvim and to learn mishna and midrash and gemara and halacha and aggada, because it says, "The precepts of God are right, gladdening the heart" (Tehillim 19:9). Schoolchildren are idle on it. One may read Iyov and the bad things which are in Yirmiyah, but if there are between them passages of consolation, one must skip them. The words of the Torah gladden the heart, as it is said, "The precepts of Hashem are upright, gladdening the heart" (Psalms 19:9). Therefore, it is forbidden to study Torah on Tishah beAv, except for subjects that sadden the heart, such as the chapters of the book of Jeremiah, regarding the ominous events he prophesied, omitting the verses of consolation. Also the verses foretelling the punishment to be meted out to the nations of the world that are written there, should be omitted. It is also permitted to study the Book of Job, as well as Midrash Eichah. [The following Talmudic selections may also be studied:] the Talmud, chapter Eilu megalchin, (Moed Katan, 3rd chapter), which deals with the laws of a mourner, and a person who was excommunicated, and the Aggadic portion of the chapter Hanizakin (Maseches Gittin 55b), and in the Jerusalem Talmud, the last part of the Maseches Ta'anis, which discusses the destruction of the Beis Hamikdash. But even the chapters you are permitted to study, you are forbidden to study in depth, to find an answer to a difficult question or a homiletic interpretation, for that would gladden the heart. Any subject you, yourself, are permitted to study, you are permitted to teach to children. You are permitted to read the entire order of daily prayers, even the Mishnah of Eizehu mekoman (What is the location [of the offerings?]). But you should not say Ma'amados, even if you are accustomed to saying it every day.
