The Halakha of a Stolen Sukkah

Sources examine whether a sukkah built from stolen materials or occupying another person's property is valid for fulfilling the mitzvah, and distinguish between theft of the sukkah's structure and theft of the land on which it stands. The sources present a foundational dispute over whether a mitzvah can be performed through wrongdoing and address practical remedies available to the owner.

Sukkah 31a

Sukkah 31a:2-4

The Mishnah and Gemara discuss a stolen sukkah and establish the halakhic problem of using a sukkah made from another person's materials. The sugya distinguishes between a sukkah that is literally stolen and one built on stolen land, and analyzes the principle that a mitzvah cannot be fulfilled through a transgression.

§ The Sages taught: With regard to a stolen sukka and with regard to one who roofs a sukka in the public domain, which is tantamount to robbing land from the public, Rabbi Eliezer deems these sukkot unfit for use in fulfillment of the mitzva, and the Rabbis deem them fit. Rav Naḥman said: This dispute is limited to a case where one assaults another and forcibly evicts him from his sukka, and takes his place in the sukka. In that case, Rabbi Eliezer deems the sukka unfit. And Rabbi Eliezer conforms to his own reasoning, as he said: A person does not fulfill his obligation with the sukka of another. Therefore, in any event, he does not fulfill his obligation with it. If land can be stolen and acquired by the robber, the sukka from which he evicted the owner is a stolen sukka. And if indeed land cannot be stolen, nevertheless, the robber does not fulfill his obligation according to Rabbi Eliezer, as it is a borrowed sukka. And the Rabbis conform to their reasoning, as they said: A person fulfills his obligation with the sukka of another. And since land cannot be stolen and the sukka is merely a borrowed sukka and not a stolen one, the robber fulfills his obligation, despite the fact that he committed a reprehensible act.

Sifra, Emor, Section 12:2

Sifra, Emor, Section 12:2

The passage derives from “this is the festival of Sukkot” that Sukkot requires a sukka, whereas Pesach does not, despite Pesach’s requirement of matzah.

2) "this is the festival of Succoth": This (festival) requires a succah, but the festival of matzoth (Pesach) does not require a succah. Now would it not follow a fortiori, viz.: If this (festival), which does not require matzoh, requires a succah, then the festival of matzoth, which does require matzoh, how much more so should it require a succah! It is, therefore, written "this is the festival of Succoth" — This, the festival of Succoth, requires a succah, but not the festival of matzoth.

Mishneh Torah, Shofar, Sukkah and Lulav 5:25

Mishneh Torah, Shofar, Sukkah and Lulav 5:25

Rambam states that a borrowed or stolen sukka is valid: one who takes another’s sukka and sits in it fulfills the mitzvah, as does one who builds a sukka from stolen wood, since the owner is entitled only to the wood’s monetary value; a sukka made in the public domain is also valid.

A borrowed sukkah is fit [to be used on the holiday]. Similarly, a stolen sukkah is also fit [for use]. What does the latter imply? If a person attacked a colleague, forced him to leave his sukkah, stole it, and dwelled in it, the attacker has fulfilled his obligation, because landed property cannot be stolen. [Similarly,] if he stole wood and made a sukkah from it, he has fulfilled his obligation, because the Sages ordained that the owner of the wood is entitled only to the monetary worth of the wood. Even if one stole boards and merely put them in place without attaching them or changing anything about them, he has fulfilled his obligation. If a person constructs his sukkah in the public domain, it is acceptable.

Tur, Orach Chayim 637

The Tur codifies the talmudic categories of a stolen sukkah and presents the principal dispute over whether the issue is the invalidity of a mitzvah performed through wrongdoing or the owner's ability to demand restitution.

Tosafot on Sukkah 30b

Shulchan Arukh, Orach Chayim 637:3

The governing practical law addresses a stolen sukkah, ruling on the status of a sukkah built from stolen materials or occupying another person's property, and when the owner may or may not reclaim the materials during the festival.

A stolen sukkah is valid. How? If one overpowered his friend, left his (own) sukkah and stole it and then dwelt in it, he has fulfilled his obligation, since land can never be stolen. Rema: However, initially, one should not sit in his friend's sukkah without his permission; all the more if he sat in it without his permission with the intent of stealing it. Therefore, we do not initially make a sukkah on someone else's property without their permission, and likewise for public property (Hagahos Ashiri). However, after the fact, he has fulfilled his obligation. Therefore, a Jew does not cut his own s'chach; rather he buys it from a gentile, and one does not initially make a sukkah out of anything that is stolen (Maharil). If one stole pieces of wood and made a sukkah with them (and used them as s’chach for his sukkah, the sukkah may be valid) even though he did not attach them to his sukkah but merely placed them on it and didn't change them at all, he has fulfilled his obligation. The Sages ordained that the person from whom the wood was stolen is owed only its value. However, if someone stole a sukkah that was built on top of a ship or on top of a wagon and dwells in it, he has not fulfilled his obligation. Rema: And this is the law if Reuven built a sukkah on Shimon's land, and Shimon overpowered Reuven and stole the sukkah that was built on his property, Shimon has not fulfilled his obligation with it. The Sages instituted such an ordinance only when one labored (to build a sukkah) for the sake of the mitzvah, and when one invested effort (Hagahos Ashiri

Likkutei Sichos 19

The passage distinguishes a borrowed Lulav, which is invalid on the first day of Sukkot, from a borrowed Sukkah, which is valid because all Israel can fulfill the mitzvah in one Sukkah, reflecting the Sukkah’s encompassing divine light and Jewish unity.

In this sichaThe Sichah explains the halachic and spiritual difference between why a borrowed Lulav is invalid on the first day of Sukkot, whereas a borrowed Sukkah is valid. Halachically, Sukkah permits borrowing because of the principle that 'all of Israel are fit to sit in a single Sukkah,' demonstrating an intrinsic, transcendent unity among Jewish souls. Spiritually, this reflects the encompassing divine light of the Sukkah which transcends all individual differences, whereas the Lulav represents individual light that requires personal ownership.

Shem MiShmuel, Sukkot

Shem MiShmuel, Sukkot 2:18

Shem Mishmuel explains that the Torah explicitly excludes theft in relation to sukka and lulav because they symbolize love and attachment to God, and directing that love toward external or improper objects necessarily steals it from its rightful place.
