Rava said to him: With regard to a case where the blemishes were found to have been present from a point in time after she was betrothed, there is a reason why one does not assume that they were there beforehand: Because it can be said that there is a presumption that a person does not drink from a cup unless he first examines it. In other words, one does not betroth a woman unless he first investigates her to determine if she is acceptable to him. And consequently this man has undoubtedly seen her blemishes and been appeased about them. Therefore, in the event that the blemishes did exist at the time of betrothal, it can be assumed that the husband knew about them and accepted the situation. The Gemara raises a difficulty: If that is so, then even if he brought proof that the blemishes existed before she was betrothed, we should also rely on the above presumption and say that he must have been aware of them and betrothed her regardless. But this is not the halakha. Rather, it must be that we say there is an opposing presumption that a person does not become appeased with regard to blemishes. Therefore, it must be proven that he saw these blemishes and did not object. Here too, we should say there is a presumption that a person does not become appeased with regard to blemishes. Rather, the mishna must be explained differently: If he brought proof that she had these blemishes from a point in time after she was betrothed, his claim of a mistaken betrothal is not accepted because there are two presumptions opposing it. The Sages taught in a baraita: In the case of a woman who wore three robes, one on top of the other, that had been examined by her for blood stains, and she subsequently found a stain on one of the robes, if she can attribute the blood on the robe to an external source, she may attribute it to that source, and she is pure. And this is the halakha even if the stain was on the lower robe, closest to her skin. But if she cannot reasonably attribute the blood to an external factor she may not attribute it to an external factor, and she is impure, and this is the halakha even if the stain was on the upper robe. The baraita elaborates: How so? If she passed through a marketplace of butchers, where blood could have sprayed on her clothes, she may attribute a stain on her garment to the butchers and she is pure, even if the stain was on the lower robe. If she did not pass through a marketplace of butchers or anywhere else with a lot of blood, then even if the stain was on the upper robe she may not attribute the blood to an external source and she is impure.

חכמים גזרו על כתמים שכל אשה שמצאה כתם מדם טמאה בין שמצאה על בשרה ובין שמצאה על חלוקה או על הסדין ששוכבת עליה או מתכסה בה כפי פרטי דינים שיתבארו בסי' זה ואפילו לא הרגישה ואפילו בדקה עצמה ומצאה טהורה הרי היא טמאה ואסורה לבעלה כבראיית דם ממש וצריכה שבעה נקיים וטבילה והפסקת טהרה ואע"ג דבזמן התלמוד כשהיו מונין ימי נדה וימי זיבה היה נ"מ במציאת הכתם כשמצאה בימי נדה היתה טמאה ז' ימים כנדה ואחר תטהר בלא ז' נקיים ואם היתה מוצאת בימי זיבה ג"כ לא היתה צריכה ז' נקיים אלא כשמצאה כדי ג' גריסין שנוכל לומר שראתה בג' ימים דנעשה זבה גדולה אבל אם אין בו כדי ג' כתמין ובדקה עצמה כל בין השמשות של יום א' וטהורה היתה ולא בדקה חלוקה וביום הג' מצאה זה הכתם אינה אלא שומרת יום כזבה קטנה כפי הדינים שבארנו בסי' קפ"ג אבל האידנא שוה כתם לראייה ובכל כתם צריכה הפסק טהרה ויום מציאתה אינו מן החשבון של ז' נקיים וסופרת ז' נקיים וטובלת בברכה דגם על מצות דרבנן מברכים כמו נר חנוכה ומגילה וכיוצא בהם: וז"ל הרמב"ם שם [פ"ט הל' ב'] ומדברי סופרים שכל הרואה כתם דם וכו' אע"פ שבדקה עצמה ולא מצאה דם ה"ז טמאה וכאלו מצאה דם לפנים בבשרה וטומאה זו בספק שמא כתם זה מדם החדר בא עכ"ל ויש להבין כיון דמסיים שמא כתם זה בא מהחדר למה ליה לומר וכאלו מצאה דם לפנים בבשרה ונ"ל דדבר גדול השמיענו בזה דהנה יש ששאלו למה גזרו על הכתמים הא הוה ספק ספיקא שמא שלא מגופה ואת"ל מגופה שמא מן העלייה ותירצו דאעפ"כ החמירו חכמים משום דאיסור חמור הוא ועוד כיון שאין לה דבר לתלות בו כתם זה הוה כאלו וודאי יצא מגופה [כ"מ] ויש שתירץ כיון שרוב דמים באים מהמקור אין לעשות ספק שמא מן העלייה [ט"ז סק"ב והשיבו על זה שהרי כנגד זה יש שרוב דמים באים בהרגשה ובזו לא היתה הרגשה [כרו"פ ומנ"י] ויש שתרצו דהכל הוה ספק אחד דמה לי אם הדם הוא מעלייה או מעלמא [שם] ויש לפקפק בזה: ולענ"ד נראה דזהו כוונת הרמב"ם ז"ל שכתב כאלו מצאה לפנים בבשרה דהנה תמיהני על מה שהקשו רק על ספק ספיקא הא באמת איכא ג' ספיקות שמא מעלמא ואת"ל מגופה שמא מעלייה ואת"ל מהחדר שמא לא הרגישה אמנם לפי מה שכתב הרמב"ם מקודם דכשמצאה דם בפרוזדור ה"ז בחזקת שבא בהרגשה ובארנו בסעי' א' דכוונתו דווקא בפרוזדור כשכבר נעקר מהמקור תלינן שבעת עקירתו מהמקור הרגישה ולאו אדעתה משא"כ כשראתה עתה מן המקור בלא הרגשה והטעם בארנו בסי' קפ"ג דמשם דרוב דמים באים בהרגשה ולכן כל שעבר זמן שיצא מהמקור אמרינן שוודאי בא בהרגשה ולפ"ז בכתמים כל שכן שאמרינן שוודאי בא בהרגשה בעת שיצא הדם מהמקור שהרי עבר זמן רב מאז עד מציאת הכתם וזהו שאומר הרמב"ם כאלו מצאה לפנים בבשרה כלומר דלא עשאוה כאלו ראתה עתה מהמקור שהרי לא הרגישה אלא כאלו מצאה לפנים בבשרה והיינו בפרוזדור דאמרינן שוודאי היתה הרגשה ולאו אדעתה ונמצא שאין כאן ספק שמא לא הרגישה וגם סיים שמא מדם החדר בא כלומר דרוב דמים מהחדר וא"כ אין כאן אלו ב' ספיקות מן העלייה ובלא הרגשה ולא נשאר רק ספק אחד שמא מגופה שמא מעלמא וספיקא דאורייתא לחומרא וכל החומרות שבסי' קצ"ו נוהגות בכתמים:

דין כתמים ודם שנמצא על בדיקה מאשה (סי' ק"צ): מה"ת אין האשה טמאה נדה אא"כ הרגישה שיצא מגופה שנאמר זוב יהיה בבשרה וקבלו חז"ל דר"ל שתרגיש בבשרה והרגשה זו אינן שוות יש שמרגשת שנפתח המקור ויש שמרגשת שזב ממנה דבר לח ויש שמרגשת שנזדעזעו איבריה ובאיזה ענין שתרגיש טמאה מדאורייתא: ולא עוד אלא שאפילו אם לא הרגישה זיבת דם רק שהרגישה שנפתח מקורה להוציא דם אם לא בדקה א"ע אח"ז תיכף או אפילו בדקה ולא מצאה כלום טמאה שאני אומר טפת דם כחרדל יצא ממנה ונאבד שבודאי בחנם לא תפתח המקור ואע"ג שיש לה חזקת טהרה מ"מ רוב דמים שבמקור טמאין לפיכך אם בדקה עצמה תיכף ומצאה מראה כשרה כגון ליחה לבנה או ירוקה או כמראה געל טהורה שגם דברים אלו באים מן המקור ולא מחזקינן איסור שאינו לפנינו כיון שיש לפנינו דבר טהור לתלות בו (סי' ק"צ) אבל בהרגשה שנזדעזעו איבריה אם בדקה ולא מצאה כלום טהורה שתלינן ההרגשה בשאר מקרים כן נ"ל: וכל זה מה"ת אבל חכמים גזרו שאפי' לא הרגישה כלום אלא שמצאה בין על בשרה במקום שיכול דם המקור ליפול שם כדלקמן או אפילו על בגדיה אפי' לא הרגישה כלום טמאה (שם) ויתבאר לקמן ואפילו בדקה עצמה ומצאה טהורה יש עלי' כל דיני נדה כדלקמן ודוקא בבגד האשה גזרו על הכתמים אבל אם נמצא כתם בבגד האיש ואפילו על חלוקו לאחר התשמיש אין לו דין כתם כלל אם לא שקינח עצמו בו דאז האשה טמאה כדלקמן כלל קי"א:
