Sukkah Validity on Moving Vehicles

Sources address whether a sukkah constructed on a wagon, boat, or other moving platform fulfills the holiday requirement. The halakhic discussion centers on stability standards, the concept of fixed dwelling, and the structural specifications that determine validity.

What the sources say

The question of whether a sukkah on a moving wagon or boat is valid touches several distinct halachic issues, including the structural stability required of a sukkah and the dimensional and locational requirements that govern its validity.

Sukkah structure and stability

The governing rule for a sukkah built atop a wagon or boat is stated explicitly by the Shulchan Aruch (Orach Chayim 628:2): if the sukkah cannot withstand ordinary land winds it is invalid, but if it can withstand ordinary land winds it is valid — even if it could not withstand the stronger winds typically found at sea.

Underlying this stability requirement is the broader principle, derived exegetically by the Gemara (Sukkah 2a), that the Torah's command to dwell in a sukkah for seven days demands a temporary rather than permanent residence — a structure sturdy enough to serve as a dwelling yet sufficiently impermanent to qualify as dirat arai; a sukkah built above twenty cubits is disqualified precisely because it requires the permanence of a fixed structure.

The Shem MiShmuel (Shem MiShmuel, Sukkot 3:31) and the Sefat Emet (Sefat Emet, Devarim, Sukkot 21:4) both engage the fundamental machlokes over whether a sukkah must be a dirat arai or a dirat keva, illuminating why the structural character of the sukkah — its balance between durability and impermanence — is itself a defining halachic issue.

The Rambam (Mishneh Torah, Shofar, Sukkah and Lulav 5:9) rules that a sukkah is valid wherever it is constructed in accordance with halacha, provided it was made for the purpose of shade, establishing that intentional construction for shelter is a foundational structural criterion applicable even in unusual locations.

Sukkah dimensions and placement

The Rambam (Mishneh Torah, Shofar, Sukkah and Lulav 4:1) sets the core dimensional requirements: the sukkah must be at least ten tefachim high and no more than twenty amot high, and at least seven by seven tefachim in width — any deviation in these measures renders it invalid.

The Gemara's mishna (Sukkah 16a) addresses how walls are configured relative to the ground, requiring that hanging walls lowered from above must reach within three tefachim of the ground to be valid, while walls built upward must achieve a height of ten tefachim — rules that bear on the placement and enclosure of a sukkah in any setting, including on a vessel.

The Rambam (Mishneh Torah, Shofar, Sukkah and Lulav 4:7) adds that a sukkah must have a distinct roof — walls whose tops simply lean together without a separate covering are invalid — and that even a circular sukkah is valid if its circumference is sufficient to inscribe a seven-by-seven-tefach square, indicating that the geometry of placement matters as well as absolute dimensions.

The Rambam (Mishneh Torah, Shofar, Sukkah and Lulav 5:20) rules that a gap of three tefachim in the s'chach — whether in the middle or at the side — invalidates the sukkah unless reduced, connecting the physical integrity of the covering's placement directly to validity, a concern equally relevant when a sukkah is positioned on a moving platform.

The Gemara's mishna (Sukkah 22a) confirms that even a sukkah whose s'chach is so thick that stars cannot be seen through it remains valid so long as shade exceeds sunlight, while debates between Abaye and Rava address when a double layer of roofing counts as a single valid covering — dimensional and spatial nuances that apply regardless of the sukkah's location.

Yalkut Shimoni on Torah (209:1) records the view of the Sages that the word sukkot refers to an actual place — derived from the juxtaposition with Etam in Shemot — raising the question of whether a sukkah on a moving vehicle, which continuously changes its location, can qualify as the requisite "place" for dwelling.

Midrash Lekach Tov (Vayikra 23:42) teaches that dwelling in a sukkah must resemble one's normal manner of living — eating, drinking, sleeping, and walking within it — suggesting that the sukkah's placement must be one that genuinely accommodates habitation, a standard relevant to assessing a sukkah aboard a moving truck or boat.

Sukkah 16a:9

A sukkah with walls extending downward from above is invalid if more than three handbreadths above the ground, but valid if extending upward from below with a height of ten handbreadths; Rabbi Yosi holds that walls extending downward require ten handbreadths just as upward-extending walls do, and similarly a large enclosed courtyard surrounded by a structure unsuitable for roofing is invalid if there are four cubits of space beneath it.

Sukkah 2a

Sukkah 2a:12

Rava derives from the verse "In sukkot shall you reside seven days" that throughout the festival one must leave his permanent dwelling and reside in a temporary one; a sukka up to twenty cubits high can constitute such temporary residence, but above that height the structure becomes permanent and unsuitable for use as a sukka.

Rava said that the halakha is derived from here: “In sukkot shall you reside seven days” (Leviticus 23:42). The Torah said: For the entire seven days, emerge from the permanent residence in which you reside year round and reside in a temporary residence, the sukka. In constructing a sukka up to twenty cubits high, a person can render his residence a temporary residence, as up to that height one can construct a structure that is not sturdy; however, in constructing a sukka above twenty cubits high, one cannot render his residence a temporary residence; rather, he must construct a sturdy permanent residence, which is unfit for use as a sukka.

Sukkah 22a

Sukkah 22a:1

The Mishna rules that a sukkah with thick roofing is fit even if stars cannot be seen through it, and discusses a machloikes between Abaye and Rava regarding a sukkah with two layers of roofing: Abaye holds it is fit only when there is less than a three-handbreadth gap between layers, while Rava holds that if the upper roof has a one-handbreadth opening, the sukkah remains fit even with a three-handbreadth gap, applying the principle of "lowering and casting down" the upper level to the lower one.

MISHNA: A sukka that is meduvlelet and whose shade exceeds its sunlight is fit. A sukka whose roofing is thick like a house of sorts, even though it is so thick that the stars cannot be seen from within it, is fit. Abaye said: They taught that a sukka with two layers of roofing is fit only in a case where there is not a gap of at least three handbreadths between the top and bottom layers. However, if there is a gap of three handbreadths between them it is unfit. Rava said: Even if there is a gap of three handbreadths between them, we say that the two layers of roofing are not considered joined only in a case where there is not the width of a handbreadth in its upper roof. However, if there is the width of a handbreadth in its upper roof, even if the gap between them is three handbreadths, the sukka is fit, because we say that the principle: Lower and cast down the upper level of the sukka roofing down to the level of the lower sukka roofing, applies here.

A sukkah constructed according to halakha is valid even if not made for the sake of the mitzvah, provided it was made for shade purposes (such as a non-Jewish sukkah or animal shelter), but a sukkah that formed by itself is invalid because it was not made for shade; similarly, one who digs into a haystack and fashions it into a sukkah has not created a valid sukkah if the haystack was not originally gathered for shade, though if one initially created a hollow space in the haystack for the purpose of a sukkah and later dug through it and completed it to the required height, it is valid because the s'khakh was made for shade.

We do not find in the Mishkan a tent moving from place to place when a person carries it themselves, and regarding a tent on a boat—even though according to law of acquisition a boat at rest is stable and water reaches it, nonetheless for the laws of Shabbat there is no resting since in the Mishkan objects were not concealed in this manner—therefore similarly, and the proof is clear from the matter of a corpse in the sun where two people sit beside it and bring a mat and spread it over it, creating a tent-like partition with their own bodies while standing fixed in place, yet we do not find in the Mishkan a tent where a person covers himself or certainly when moving about and carrying the tent with him, and certainly not when a person carries a tent on objects.

A permanent sukkah structure left standing year-round with the intention that it serve as a dwelling after the holiday is disqualified because it resembles a fixed dwelling rather than a temporary shelter, and this applies even if light coverings are used; however, if people actually dwell in it throughout the year as it stands, the question becomes moot, though in practice such structures are not inhabited year-round but only used for light tasks, and those who wish to dwell in them permanently reinforce them after the holiday with a wooden ceiling and covering over the schach, which they remove when the holiday arrives.

A sukkah constructed on top of a wagon must be secured firmly enough to withstand an ordinary wind; if it cannot, it is invalid even when there is no wind present.

On this pageThis chapter discusses the laws of a Sukkah constructed on top of a wagon or vehicle. It rules that the Sukkah must be anchored securely enough to withstand a normal wind; if not, it is invalid even when there is no wind blowing. It also notes that one fulfills the mitzvah even while the vehicle is in motion, though some authorities rule stringently on this. The passage outlines the halakhic status of Sukkahs built on moving vehicles, such as ships, cars, and airplanes. It rules that a Sukkah on a boat is valid if it can withstand common land winds, a Sukkah may be built inside or on top of a car, and a Sukkah built in an airplane while in flight is not valid.
