Calling Previously-Prayed Individuals for Torah Honors

Jewish law requires a quorum of ten for communal Torah reading. These sources address the rules governing who may be called to the Torah and under what circumstances, including the status of individuals who have already participated in the service.

What the sources say

The core rule is that a Torah reading requires ten adult free men present, but if the quorum was present at the start, those who leave may be counted so that the readers who remain complete the reading, as stated in Shulchan Arukh, Orach Chayim 143:1 and the Rambam (Hilchot Tefillah 8:4), who adds that this works provided the majority of the ten have not yet prayed.

Building on this principle, later authorities extend it to the case of mixed minyanim: Arukh HaShulchan, Orach Chaim 143:1 and the Mishnah Berurah (143:4-6) explain that once ten were counted at the start of the reading, those who already fulfilled their obligation may be included to complete the count, and Mishnah Berurah 143:16 states plainly that those who already prayed may be joined into the minyan of seven (or three) readers.

This is applied directly to the scenario of six who have not yet prayed and four who already have: Kitzur Shulchan Arukh Yalkut Yosef, Orach Chaim 143:3 rules that six who have not yet heard the Torah reading may join with four who already heard it, reading with the full blessings before and after, and Kaf HaChayim on Shulchan Arukh, Orach Chayim 143:3 cites the same ruling, that seven who have not heard the reading may join with three who already have in order to take out the Torah scroll.

The underlying structure of how many must read the Torah on a given day is set by the Rambam (Hilchot Tefillah 12:16), who fixes seven readers on Shabbat morning, and by Megillah 21a:11-13 and Mishnah Megillah 4:3, which establish that the reading, like other matters of sanctity, cannot be performed with fewer than ten present.

The general principle that a quorum begun with ten may be completed even after some depart is also found regarding Kaddish, Kedushah, and the repetition of the Amidah, as in Shulchan Arukh, Orach Chayim 55:1, Beit Yosef, Orach Chayim 55:3, Arukh HaShulchan, Orach Chaim 55:6, and Kaf HaChayim on Shulchan Arukh, Orach Chayim 55:7, and the Rambam (Hilchot Tefillah 9:3) notes that the chazzan's repetition is heard equally by those who already fulfilled their obligation and those who have not, showing that presence, not prior exemption, is what counts toward the quorum.

B'Mareh HaBazak Volume V 2:8-9 extends this logic to a related scenario, ruling that even one who already prayed may descend before the amud to lead Kedushah or the repetition for those still praying, based on the principle that all Israel are responsible for one another.

Other sources on the sheet address related but distinct aspects of Torah reading practice — the counting of who may be called to the Torah among the seven (Shulchan Arukh, Orach Chayim 282:3, Megillah 23a:11, the Rambam (Hilchot Tefillah 12:17)), the order of kohen, levi, and yisrael and the number of readers on various days (Tur, Orach Chayim 135, Arukh HaShulchan, Orach Chaim 135:3, Beit Yosef, Orach Chayim 135:1, Mishnah Berurah 135:42, Magen Avraham 282:6, Ketubot 25b:3-4), the case of a sefer Torah found invalid mid-reading (Mishnah Berurah 143:14), the recitation of Birkot HaShachar for those who already fulfilled it (Mishnah Berurah 6:13-14), and Poreis Al Shema for those who prayed alone (Shulchan Arukh, Orach Chayim 69:1) — all reinforcing the same theme that prior fulfillment of an obligation does not disqualify one from joining or assisting a quorum for a communal matter.

On the specific practical question of giving an aliyah to someone who already prayed, Revavos Ephraim (Revavos Ephraim 5:208) rules that one who already prayed or already received an aliyah in an earlier minyan may receive another aliyah in a later minyan, even from the same Torah scroll, though he notes a stricter view with respect to repeated aliyot within the same reading.

Megillah 23a:11

Expands the Mishnah’s rules for Torah reading and aliyot, including the communal framework and the qualifications relevant to those receiving aliyot.

§ The Sages taught in a Tosefta (Megilla 3:11): All people count toward the quorum of seven readers, even a minor and even a woman. However, the Sages said that a woman should not read the Torah, out of respect for the congregation.

Ketubot 25b

Ketubot 25b:3-4

Chachmei Bavel relate that Rabbi Ami accepted a man’s testimony that another was a kohen because he had been called first and a Levi read after him, while Rabbi Yehoshua ben Levi accepted testimony that another was a Levi because he had been called second after a kohen.

As in the incident involving a certain man who came before Rabbi Ami and said to him: That man established presumptive status before me that he is a priest. Rabbi Ami said to him: What did you see that led you to that conclusion? He said to Rabbi Ami: I saw that he was called to the Torah and read first in the synagogue. Rabbi Ami asked him: Did he read first based on the presumptive status that he is a priest, or was it based on the presumptive status that he is a great man? The custom was that a priest would be called to the Torah first, unless there was a prominent Torah scholar among the worshippers. He said to Rabbi Ami: He read the Torah as a priest, as after him a Levite read the Torah. A Levite is called to the Torah second only when a priest is called first. And Rabbi Ami elevated him to the priesthood, on the basis of his statement. The Gemara relates an incident involving a certain man who came before Rabbi Yehoshua ben Levi and said to Rabbi Yehoshua ben Levi: That man established the presumptive status before me that he is a Levite. Rabbi Yehoshua ben Levi said to him: What did you see that led you to that conclusion? He said to Rabbi Yehoshua ben Levi: I saw that he was called to the Torah and that he read second in the synagogue. Rabbi Yehoshua ben Levi asked him: Did he read second based on the presumptive status that he is a Levite, or was it based on the presumptive status that he is a great man? When there is no priest in the synagogue, people in the synagogue are called to the Torah in order of their prominence. Perhaps he was the second most prominent man in the synagogue. He said to Rabbi Yehoshua ben Levi: I am certain that he is a Levite, as a priest read the Torah before him. And Rabbi Yehoshua ben Levi elevated him to Levite status, based on his statement.

Beit Yosef, Orach Chayim 135:1

Joseph Karo cites opinions that a wedding day is treated like a festival for the bridegrooms, permitting four aliyot when there are multiple bridegrooms, but not when there is only one because the festival status applies only to the bridegrooms themselves.

Israel Meir Kagan (Chafetz Chaim) explains that a kohen serving as shaliach tzibbur, a deputy empowered to call someone to the Torah, or a kohen or Levi who purchased an aliyah may call another kohen or Levi without concern that this reflects negatively on him, since people understand that the practice is to honor others.

Beit Yosef, Orach Chayim 55:3

Joseph Karo’s passage cites authorities who distinguish between parts of prayer begun with ten: some allow completion after several leave, generally when a majority remains, including certain kedushah passages and sometimes Kaddish, while other opinions require ten for Kaddish and do not permit beginning the Amidah’s repetition with fewer than ten.

Shulchan Arukh, Orach Chayim 69

Shulchan Arukh, Orach Chayim 69:1

Joseph Karo’s passage permits someone who has already prayed to lead Poreis al Sh’ma and pass before the Ark for those who did not hear Kaddish or Kedushah, provided these practices are performed with a quorum of ten, preferably including six who have not heard them.

The Law of "Poreis Al Sh'ma", containing 2 S'ifim If there are people who have all prayed by themselves, individually, and they did not hear the Kaddish and the K'dushah, one of them stands and says Kaddish and Bar'khu and the first blessing - Yotzei Or, and no more, and this is called "Poreis al Sh'ma", which means "a piece" or "a slice" (ie. the word "poreis" comes from the word "prusa" which means a piece or a slice), in that we do not say other than a little of it (i.e. the Recitation of the Sh'ma). Rem"a: And nowadays, the custom is to not say the entire blessing of Yotzer Or; rather, we say Kaddish and Bar'khu, and they respond afterwards "Barukh YHVH... [hamvorakh l'olam va-ed]". There are those who say that we are "poreis al Sh'ma" during the evening Recitation of the Sh'ma as with the morning (Kol Bo and Beit Yoseif in the name of the Ran), but our custom is not like that because there is no Kaddish before the Bar'khu of Arvit. And after they complete the blessing of Yotzeir Or, they say Avot and G'vurot and K'dushah, and "Atah Kadosh", and this is called "Passing before the Ark". And we do not do these things with less than 10 [men] because they are matters of sanctification [of God's name]. And one should search for 6 [men] who have not heard [Kaddish or Kedusha], for this is the majority of 10. And if they can't find [at least 6 men], then even for the sake of one [man] who has not heard, they say [these things]. And even one who has heard can be "Poreis al Sh'ma" and pass before the Ark for the sake of the one who has not heard. However, if the one who did not hear is an expert on "Poreis al Sh'ma" and passing before the Ark, it is better that he should "poreis" and pass before the Ark rather than one who already heard should "poreis" and pass before the Ark. Rem"a: And the one who passed before the Ark and said the 3 first blessings should complete the entire prayer, and not make any interruption, even if he already prayed, but the others may interrupt after that. And certainly if the one who does "poreis" and passes before the Ark has not already prayed, he should first complete his prayer (ie. Sh'mona Esrei) even though he [still] needs to recite the Sh'ma afterwards and [by doing so] will not adjoin redemption to prayer [Beit Yoseif in the name of the Mahari]. And it is forbidden for one to interrupt for these things (ie. to be poreis al shema) between redemption and prayer or the Recitation of the Sh'ma and its blessings, and therefore, it is forbidden for the prayer-leader to interrupt between the Sh'ma and prayer (i.e. Sh'mona Esrei] or within the Sh'ma and its blessings in order to "poreis al Sh'ma" for those who came to the synagogue after the congregation prayed Kaddish and Bar'khu and began the blessing of Yotzeir Or. But in the blessings of Aravit [i.e. Maariv Aravim in the evening service] which is optional, one can interrupt in order to fulfill the obligation of others. And in any case, another person can "poreis al Sh'ma" or pray the entire prayer for 10, even in the same synagogue which has already prayed, in order to fulfill the obligation of others. However, the second chazzan should not stand in the place that the first chazzan stood, in that this would seem disgraceful to the first ones because it's like [they are saying that] the first ones have not fulfilled their obligation (Teshuvah of the Mahari of Mainz Siman 15). And it seems to me that this is specifically when the first ones are still in the synagogue but have completed their prayers, but if the first ones left, the chazzan can stand even in the the place that the first one did.

Yechiel Michel Epstein states that matters of sanctity, including Kaddish, Kedushah, and Barechu, require ten free adult Jewish males, based on “ונקדשתי בתוך בני ישראל,” because the Divine Presence rests among ten.

Mishnah Berurah 6

Mishnah Berurah 6:13-14

Israel Meir Kagan (Chafetz Chaim) explains that communities should follow their established custom regarding repeating the morning blessings for those who have already fulfilled their obligation, since different authorities provide grounds for permitting or restricting it; according to the Levush and Pri Megadim, the need for ten men may depend on whether the listeners can recite the blessings themselves.

There are those who have a custom etc. - Their intent is in order to [help] each one meet their quota of 100 Amen's for the day. See further in Shaarei Teshuva [who discusses] that there are many who question this. And in Teshuvah M'Ahava [chelek 2, siman 212], he raises the point that for us who's custom it is to not fulfill our obligation with the prayer leader [morning] blessings, everyone agrees that it would be permitted to do so. Pri Megadim wrote that it's proper nowadays that only the prayer leader recite [the blessings] out loud, see there further. Therefore, each place should do according to what their custom is, for each one has what to rely on. That they already fulfilled their obligation - From the Levush, it's implied that one cannot fulfill other's obligation of the Morning Blessings with less than 10 men [present]. See in Pri Megadim who, at the conclusion of his words, leans towards saying that it's specifically when [each of the listeners] are capable [of reciting the blessing on their own] that one cannot fulfill [other's obligation] with less than 10 men. But when [the listeners are] not capable, then you don't need 10 men, even according to the Levush.

Magen Avraham 282:6

Abraham Abele Gombiner discusses the eligibility of a minor to serve as the Torah reader and receive aliyot, concludes that contemporary practice generally calls a minor only for maftir, and examines women’s obligation to hear Torah reading, noting differing views and the custom for women to leave.

B'Mareh HaBazak Volume V 2:8-9

B'Mareh HaBazak Volume V 2:8-9

ה passage states that when nine have prayed silently and a tenth arrives, a full Chazarat HaShatz is not technically present if six or more of the majority did not pray together, but someone who already prayed may lead the communal prayer, and Kedushah may be recited for the tenth if he has not yet prayed.
