What the sources say

The foundational source for the three oaths is Ketubot 111a, where Rabbi Yosei son of Rabbi Ḥanina derives from the repeated language in Shir HaShirim that God administered three oaths: one that Israel should not ascend to Eretz Yisrael "as a wall" (en masse, by force), one that Israel should not rebel against the rule of the nations of the world, and one that the nations should not subjugate Israel excessively.

Midrash Tanchuma, Devarim 4:1 similarly records three oaths administered through Shir HaShirim — that Israel should not reveal the End of Days, not press the End, and not rebel against the kingdoms — and מדרש רבה, שיר א סג ב יח records Rabbi Yosei son of Rabbi Ḥanina's formulation that God swore Israel not to rebel against the yoke of the kingdoms, and swore the nations not to make Israel's yoke too heavy, since doing so would cause the End to arrive before its time.

Peninei Halakhah, Zemanim 4:4 synthesizes the Talmudic and midrashic tradition, summarizing the oaths as prohibiting a forceful mass ascent to the Land and rebellion against the nations, while also transmitting the warning of Rabbi Elazar that if Israel does not keep the oaths, God will permit their flesh to be taken like gazelles of the field.

However, none of these sources — Ketubot 111a, Midrash Tanchuma, Devarim 4:1, מדרש רבה, שיר א סג ב יח, or Peninei Halakhah, Zemanim 4:4 — extend the prohibition specifically to the establishment of a Jewish government in Eretz Yisrael, whether religiously observant or not; the oaths as recorded address mass forceful aliyah and rebellion against gentile rule, not the specific act of governmental formation.

The Gemara asks: And how does Rabbi Zeira explain the repetition of this oath in these verses? The Gemara explains: That verse is necessary for that which was taught by Rabbi Yosei, son of Rabbi Ḥanina, who said: Why are these three oaths (Song of Songs 2:7, 3:5, 8:4) needed? One, so that the Jews should not ascend to Eretz Yisrael as a wall, but little by little. And another one, that the Holy One, Blessed be He, adjured the Jews that they should not rebel against the rule of the nations of the world. And the last one is that the Holy One, Blessed be He, adjured the nations of the world that they should not subjugate the Jews excessively.

The twelfth foundation of faith is belief in and affirmation of the coming of the Messiah, and one must not delay or set a time for his arrival but rather wait for him; the Sages say that those who calculate the end of days have wasted their spirit, and one must believe that the Messiah will have superiority and honor above all kings that ever were, as all the prophets from Moses to Malachi prophesied about him, and whoever doubts this or diminishes his greatness denies the Torah which explicitly addresses this in the portion about Balaam and in Netzavim. A corollary of this foundation is that Israel can have no king except from the house of David and the seed of Solomon alone, and whoever disputes this lineage denies the name of God and the words of His prophets.

The Sages explain that God administered three oaths: two to Israel – not to ascend to their land forcefully all together (lit. “on a wall”) and not to rebel against the nations – and one to the gentiles – not to subjugate the Jews excessively (Ketubot 111a). Afterward, the Gemara adds three other oaths that God administered to the Jews: “That they will not reveal the End of Days, that they will not delay the End, and that they will not reveal the secret to the idolaters.” Furthermore, “R. Elazar says: The Holy One, blessed be He, said to Israel, ‘If you fulfill the oath, well and good; but if not, I will allow your flesh [to be devoured] like [that of] the gazelles and the hinds of the field.’” R.   • חג שבועות הוא אשר צוה הש"י לעשות חג אחר שבעה שבועות של הספירה. וקבלתי ממורי הגאון מהר"ש ז"ל מלובלין שקיבל איש מפי איש מפי הגאון רבינו יעקב פולק ז"ל, שלא לעשות קידוש ולאכול בליל ראשון של חג שבועות עד צאת הכוכבים. והטעם, מפני שבספירה כתיב (ויקרא כג, טו) שבע שבתות תמימות תהיינה, ואם כן כשמקדש בעוד יום, מחסר אותו המקצת ממ"ט ימי הספירה, שהרי חג שבועות הוא לאחר ספירה, וכשיש ספירה אינו שבועות, וכשמקדש אם כן מקבל על עצמו החג ומחסר אותו המקצת מימי הספירה ונמצא שאינן תמימות. ואל תשיבני ממה שמתפללין אז התפילה מבעוד יום, דזה אינו כלום, דהא ר' אושעיא צלי של מוצאי שבת בשבת כדאיתא בברכות (כז, ב) אע"ג דעדיין ממש שבת גמור הוא. ואל תקשה מקידוש הש"ץ בבית הכנסת, דזה אינו אלא בשביל אורחים ולא מחזי כלום ממחסר משבע התמימות, משא"כ אלו היה כל יחיד מקדש לעצמו. גם מצינו בהדלקת נרות חנוכה קצת דומה לזה, שהש"ץ מדליקין בבית הכנסת בעוד היום, והקהל מחויבין להמתין מלהדליק בביתם עד שיגיע זמן ההדלקה: בלילה ההוא של חג שבועות ידוד השינה מכל מי שרוצה לדבק בקדושה, ויעסוק בתורה כל הלילה, וכדאיתא בזוהר (ח"ג צז, א), ר' אבא ור' חייא הוו אזלי באורחא, אמר ר' חייא כתיב (ויקרא כג, טו) וספרתם לכם ממחרת השבת מיום הביאכם את עומר התנופה, מאי קא מיירי. א"ל הא אוקמוה חברייא. אבל תא חזי, ישראל כד הוו במצרים הוו ברשותא אחרא, והוו אחודן במסאבותא כאתתא דא כד היא יתבא ביומי דמסאבתא. בתר דאתגזרו, עאלו בחולקא קדישא דאקרי ברית. כיון דאתאחדו ביה, פסק מסאובתא מנייהו כדא אתתא כד פסקו מנה דמי מסאובתא. בתר דאספסקו מנה מה כתיב (ויקרא טו, כח), וספרה לה שבעת ימים. אוף הכא כיון דעאלו בחולקא קדישא פסקא מסאובתא מנייהו, ואמר קב"ה מכאן ולהלא חושבנא לדכיותא וספרתם לכם. לכם דייקא, כמה דאיתמר וספרה לה שבעת ימים, לה לעצמה, אוף הכא לכם לעצמכם. ולמה, בגין לאתדכאה במיין עלאין קדישין. ולבתר למיתי לאתחברא ביה במלכא ולקבלא אורייתא. כתיב וספרה לה שבעת ימים, אוף הכא שבע שבתות. אמאי שבע שבתות, ודאי בגין למזכי לאתדכאה במיין דההוא נהר דנגיד ונפיק ואקרי מים חיים, וההוא נהר שבע שבתות נפקו מניה. ועל דא שבע שבתות ודאי בגין למזכי ביה, כמה דאתתא זביו דילה בלילא לאשתמשא בבעלה, כך כתיב (במדבר יא, ט) וברדת הטל על המחנה לילה, על המחנה כתיב, ולא כתיב וברדת הטל לילה, ואימתי נחת האי טלא, כד קריבו ישראל לטורא דסיני, כדין נחת ההוא טלא בשלימו באדם ואתפסקא זוהמתן מנייהו ואתחברו ביה במלכא וקבילו אורייתא לכנסת ישראל הא אוקמינ', ובההוא זמנא וראי כל הנחלים הולכים אל הים (קהלת א, ז) לאתדכאה ולאתחסאה וכלא אתקשרו (ס"א אתקדשו) ואתחברו ביה במלכא קדישא: וסדר הלימוד של זו הלילה כבר נתפרסם ונודע לרבים ע"י הקונטריסין שנתפשטו, והמנהג הזה נתפשט בכל ארץ ישראל ובכל המלכות אין נקי כולם כאחד מגדולים ועד קטנים, וכן קיימו וקבלו עליהם ועל זרעיהם. ומאחר שהוספתי ג"כ נופך משלי בענין סדר לימוד זאת הלילה, על כן ארשום הכל ביחד:
