Leaving Eretz Yisrael: Permissions and Restrictions
Jewish sources address the prohibition against permanently leaving Eretz Yisrael and identify specific circumstances under which temporary departure is permitted—such as Torah study, marriage, commercial trade, and rescue from famine—along with the requirement to return when the purpose is fulfilled.
The Gemara in Avodah Zarah 13a and Tosafot (Avodah Zarah 13a:10) confirm that one may leave to study Torah or marry only when intending to return, and that this leniency applies specifically to these weighty mitzvot rather than to other purposes; Tosafot (Ketubot 110b:11) discusses the related case of a slave who fled to Eretz Yisrael for its settlement.
Rambam (Hilchot Melachim 5:12) and Ketubot 110b teach that one should always dwell in Eretz Yisrael, even in a largely gentile city, rather than abroad even in a largely Jewish one, comparing the one who leaves to an idolater based on the pasuk in Shmuel, a comparison also drawn by Rashi (Shmuel I 26:19); the same equivalence extends from Bavel to other lands, as Ketubot 111a records with the case of a man barred from descending to Bei Choza'ah for levirate marriage.
A further exception concerns famine: Bava Batra 91a teaches that one may not leave Eretz Yisrael unless the price of grain has doubled, and even then only if one lacks the means to purchase it, a principle the Gemara applies to explain the punishment of Elimelech, Machlon, and Chilion for leaving during famine, as also told in Ruth 1:1-2 and elaborated in Ruth Rabbah 1:4; Sefer Charedim (Mitzvot Dependent on the Land of Israel 1:14) gathers this same account of their punishment.
Beyond the halakhic conditions for leaving, the sources also address the marital dimension: Shulchan Arukh, Even HaEzer 75:3-5 rules that a wife is forced to ascend to Eretz Yisrael even from comfortable to poor lodgings, but may never be forced to leave it, and that a husband who insists on leaving while she refuses must divorce her without her ketubah, a ruling elaborated by Beit Yosef (Even HaEzer 75:4-5) and Bach (Even HaEzer 75:4-6), and rooted in the same mishnah cited at Ketubot 110b; Tur (Even HaEzer 75) adds the related rule distinguishing movement between the three regions of Eretz Yisrael itself for purposes of forcing a spouse to relocate.
Kiddushin 31b records that Rabbi Yochanan ruled leaving Eretz Yisrael is forbidden even to greet one's mother, reflecting the severity of the underlying prohibition apart from the marriage and commerce exceptions.
Rav Menashe Klein (Mishneh Halachos 11:431) rules that leaving Eretz Yisrael merely to tour abroad is forbidden even today throughout the year, while permitting departure for a mitzvah such as visiting parents, a teacher, or a friend, or for earning a livelihood.
Tzitz Eliezer (13:22) holds that the prohibitions discussed apply specifically to leaving Eretz Yisrael for the Diaspora and not to travel from Jerusalem to another place within Eretz Yisrael, since leaving for the Diaspora may carry a Torah-level severity that internal travel does not.
Minchas Yitzchak (10:108) surveys the various reasons given for the prohibition against leaving Eretz Yisrael or even Bavel — the sanctity of the land, the sanctity of Torah, or withdrawal from mitzvot — and discusses the severity of the restriction together with exceptions such as severe food inflation, while also noting views permitting departure from Bavel toward Eretz Yisrael.
Rav Moshe Sternbuch (Teshuvos V'hanhagos 2:565) addresses the specific question of whether a kohen may travel to Eretz Yisrael intending to return, citing the Yerushalmi's position that a kohen who reaches Eretz Yisrael, even temporarily, may not then leave it.
Tzitz Eliezer (Tzitz Eliezer 20:43) — Tzitz Eliezer (20:43) addresses the halakhic authority to wage wars and the roles of the king and Sanhedrin in optional warfare, and does not state a position on whether one is generally permitted to leave Eretz Yisrael.
God commands Isaac not to descend to Egypt during famine and instead to remain in the Land, a foundational biblical precedent for the prohibition against leaving under certain circumstances.
The passage recounts that during a famine, Elimelech left Beit Lechem in Yehudah with his wife Naomi and their two sons to reside in the fields of Moav.
Presents the Mishnah’s laws about compelling a spouse to move to Eretz Yisrael and explains that dwelling there is weighed against dwelling outside the Land; it also discusses leaving the Land and qualifying exceptions.
If she says that she wishes to leave Eretz Yisrael, and he says that he does not wish to leave, one forces her not to leave. And if she does not wish to stay in Eretz Yisrael and resists all attempts to force her to stay, she is divorced without receiving her marriage contract. If he says that he wishes to leave Eretz Yisrael and she says that she does not wish to leave, one forces him not to leave. And if he does not wish to stay in Eretz Yisrael, he must divorce her and give her the marriage contract. § In relation to the basic point raised by the mishna concerning living in Eretz Yisrael, the Sages taught: A person should always reside in Eretz Yisrael, even in a city that is mostly populated by gentiles, and he should not reside outside of Eretz Yisrael, even in a city that is mostly populated by Jews. The reason is that anyone who resides in Eretz Yisrael is considered as one who has a God, and anyone who resides outside of Eretz Yisrael is considered as one who does not have a God. As it is stated: “To give to you the land of Canaan, to be your God” (Leviticus 25:38). The Gemara expresses surprise: And can it really be said that anyone who resides outside of Eretz Yisrael has no God? Rather, this comes to tell you that anyone who resides outside of Eretz Yisrael is considered as though he is engaged in idol worship. And so it says with regard to David: “For they have driven me out this day that I should not cleave to the inheritance of the Lord, saying: Go, serve other gods” (I Samuel 26:19). But who said to David: Go, serve other gods? Rather, this comes to tell you that anyone who resides outside of Eretz Yisrael is considered as though he is engaged in idol worship.
Discusses the prohibition against leaving Eretz Yisrael and identifies travel for commercial purposes and other temporary needs within the halakhic framework of permitted departure.
The Gemara asks: And is it so that they do not disagree? But isn’t it taught in a baraita: One may go to a fair of gentiles, whose purpose is to honor idol worship, and buy from the gentiles animals, and slaves, and maidservants, as the purchase raises the items to a more sanctified state; and he may buy houses, fields, and vineyards from them, due to the mitzva to settle Eretz Yisrael. And one may write the necessary deeds and confirm them in their gentile courts [be’arkaot], although this involves an acknowledgement of their authority, because it is as though he is rescuing his property from their hands, as the court’s confirmation and stamp of approval prevents the seller from denying the sale and claiming that the property still belongs to him. And if he is a priest, he may become ritually impure by going outside Eretz Yisrael, even though a priest is usually prohibited from leaving Eretz Yisrael to the impure land outside, in order to litigate with them and to contest their claims. And just as a priest may become ritually impure by going outside Eretz Yisrael, so may he become ritually impure for this purpose by entering a cemetery. The baraita continues: And a priest may likewise become ritually impure and leave Eretz Yisrael in order to study Torah or in order to marry a woman. Rabbi Yehuda says: When does this allowance apply? It applies when he cannot find a place to study in Eretz Yisrael. But when the priest can find a place to study in Eretz Yisrael, he may not become ritually impure by leaving the country.
Records the prohibition against leaving Eretz Yisrael during famine and discusses the conduct of major biblical figures who departed or remained during hardship, providing context for exceptions and restrictions.
The Sages taught: One may not leave Eretz Yisrael to live outside of Eretz Yisrael unless the price of two se’a of grain stood at a sela, which is double its usual price. Rabbi Shimon said: When does this exception, permitting one to leave Eretz Yisrael under certain circumstances, apply? It applies when one is unable to find produce to buy, as he has no money. But when one has money and is able to find produce to buy, even if the price of a se’a of grain stood at a sela, he may not leave. And Rabbi Shimon ben Yoḥai would likewise say: Elimelech and his sons Mahlon and Chilion were prominent members of their generation and were leaders of their generation. And for what reason were they punished? They were punished because they left Eretz Yisrael to go outside of Eretz Yisrael, as it is stated concerning Naomi and Ruth: “And all the city was astir concerning them, and the women said: Is this Naomi?” (Ruth 1:19). The Gemara asks: What is the meaning of the phrase: “Is this Naomi”? How does this indicate that her husband and sons were punished for leaving Eretz Yisrael? Rabbi Yitzḥak says that the women said: Have you seen what befell Naomi, who left Eretz Yisrael for outside of Eretz Yisrael? Not only did she not escape tribulations there, but she lost her status entirely. The Gemara provides a mnemonic for the ensuing statements that Rav Ḥanan bar Rava said that Rav said: Melech; Abraham; ten years; when he died; and He alone was exalted. Rav Ḥanan bar Rava says that Rav says: With regard to Elimelech, and Boaz’s father, Salmon, and So-and-so, the unnamed relative who was a closer relative to Elimelech than Boaz (Ruth 4:1), and Naomi’s father, all of these are descendants of Nahshon, son of Amminadab, the head of the tribe of Judah (see Ruth 4:20–21 and Numbers 2:3). The Gemara asks: What is he teaching us by this statement? He is teaching that even in the case of one who has the merit of his ancestors to protect him, this merit does not stand for him when he leaves Eretz Yisrael to go outside of Eretz Yisrael, as Elimelech died on account of this sin.
The Gemara relates with regard to a certain man from Eretz Yisrael that a yevama, i.e., a woman whose childless husband died and left a surviving brother, happened before him, the surviving brother, for levirate marriage. This yevama was living in the district of Bei Ḥoza’a, far away in southeast Babylonia. The man came before Rabbi Ḥanina and said to him: What is the halakha as to whether I may descend to Babylonia to enter into levirate marriage with this woman? Rabbi Ḥanina said to him: His brother married a Samaritan woman [kutit] and died. Rabbi Ḥanina described the man’s late brother in these terms because he had left Eretz Yisrael to marry, and for the same reason he called his wife a Samaritan. Blessed be the Omnipresent who killed him. And yet the brother wishes to follow in his footsteps and descend after him? Better that he stay in Eretz Yisrael. § Rav Yehuda said that Shmuel said: Just as it is prohibited to leave Eretz Yisrael and go to Babylonia, so too, is it prohibited to leave Babylonia for any of the other lands. Rabba and Rav Yosef both say: Even to go from Pumbedita to Bei Kuvei, which is located beyond the border of Babylonia proper, is not permitted. The Gemara relates: A certain man left Pumbedita to live in Bei Kuvei, and Rav Yosef excommunicated him. A certain man left Pumbedita to live in Astonia, which also lay beyond the borders of Babylonia proper, and he died. Abaye said: Had this Torah scholar wanted, he would still be alive, as he could have stayed in Babylonia.
Chachmei Hamidrash discuss leaving Eretz Yisrael during famine: one should not leave while even a seah can be purchased for a shekel, though leaving during famine may otherwise be permitted, and Elimelech was punished for fleeing as a prominent provider and thereby discouraging Israel.
The passage recounts several sages who began leaving Eretz Yisrael but, upon recalling it, wept and returned, declaring that dwelling in Eretz Yisrael is equivalent to all the mitzvot of the Torah.
Chachmei Bavel cite Rabbi Yosei bar Rabbi Chanina’s explanation of three oaths: that Israel should not ascend to Eretz Yisrael as a collective force, rebel against the nations, or be excessively subjugated by them.
Chachmei Bavel recount that Rav Asi left his senile mother to go to Eretz Yisrael, was told that leaving Eretz Yisrael is prohibited but received permission to leave to meet her, and then learned that she had died before he reached her.
Rav Asi had an elderly mother. She said to him: I want jewelry, and he made jewelry for her. She said to him: I want a man whom I can marry, and he said to her: I will seek one for you. She said to him: I want a husband who is as handsome as you. At this point, he realized that she was senile, and that he would be unable to fulfill all her requests. Therefore, he left her and went to Eretz Yisrael. Rav Asi heard that she was following him to Eretz Yisrael. He came before Rabbi Yoḥanan and said to him: What is the halakha with regard to leaving Eretz Yisrael to go outside of Eretz Yisrael? Rabbi Yoḥanan said to him: It is prohibited. Rav Asi further asked: If one is going to greet his mother, what is the halakha? Rabbi Yoḥanan said to him: I do not know. Rav Asi waited a little while, and then came back to him. Rabbi Yoḥanan said to him: Asi, you are evidently determined to leave. May the Omnipresent return you in peace, and he said no more. Rav Asi came before Rabbi Elazar, because he did not know how to interpret Rabbi Yoḥanan’s statement. He said to Rabbi Elazar: God forbid, perhaps he is angry with me that I wished to leave? Rabbi Elazar said to him: What exactly did he say to you? Rav Asi said to him: May the Omnipresent return you in peace. Rabbi Elazar said to him: If it is so that he was angry, he would not have blessed you. Rabbi Yoḥanan certainly gave you permission to leave. In the meantime, while he was traveling to meet her, Rav Asi heard that her coffin was coming, i.e., his mother had died and her coffin was being brought to Eretz Yisrael. He said: Had I known I would not have left, as after his mother’s death he was not obligated to leave Eretz Yisrael to honor her.
Chachmei Bavel discuss Akko’s geographic status relative to Eretz Yisrael, contrasting Rabbi Yehuda’s boundary statement with a baraita that assigns differing impurity, tithing, and Sabbatical-year obligations on either side of the road from Akko to Keziv, and explain that a strip extends northward from Akko.
§ The mishna teaches that Rabbi Yehuda says: From Rekem and eastward is considered to be a country overseas, from Akko and northward is also outside of Eretz Yisrael, and Akko itself is like north of Eretz Yisrael. The Gemara asks: Is this to say that Akko is located to the north of Eretz Yisrael? And the Gemara raises a contradiction from a baraita (Tosefta, Oholot 18:14) that indicates that Akko is not on the northern border of Eretz Yisrael: If one was traveling from Akko to Keziv, the area on his right, to the east of the road, is impure due to the impurity of the land of the nations, and that area is exempt from the obligation to separate tithe from its produce and from the mitzvot of the Sabbatical Year, as it is assumed to be outside of Eretz Yisrael, until he arrives at a place where it is known to you that it is obligated. The baraita continues: Conversely, the territory on his left, to the west of the road, is pure with regard to the impurity of the land of the nations, as it is assumed to be within Eretz Yisrael, and obligated in the mitzva to separate tithe from its produce and in the mitzvot of the Sabbatical Year, until he arrives at a place where it is known to you that it is exempt. Until where does this halakha apply? Until Keziv. Rabbi Yishmael, son of Rabbi Yosei, said in the name of his father: Until the place known as Lavlevu. In any case, this indicates that Akko is not considered the northern border of Eretz Yisrael, as the description in the baraita indicates that Keziv is further north than Akko. Abaye said: A strip extends northward from Akko, which is still considered part of Eretz Yisrael, but the general border is at the latitude of Akko. The Gemara asks: But would the tanna of the baraita provide a sign in this manner for an area of a strip of land? The Gemara answers: Yes, and a verse also provides a sign in this manner, as it is written: “And they said: Behold, there is the feast of the Lord from year to year in Shiloh, which is on the north of Bethel, on the east side of the highway that goes up from Bethel to Shechem, and on the south of Lebonah” (Judges 21:19). And Rav Pappa said: The expression: “On the east side,” should be understood as meaning to the east of the highway. This verse demonstrates that an area as narrow as a road can be used as a sign.
States the special status of Eretz Yisrael and the prohibition or restriction against leaving it permanently, while distinguishing temporary departure and travel for certain needs.
Discusses the obligation to dwell in Eretz Yisrael and the prohibition against leaving it, including the principle that one should not leave except for Torah study, marriage, or rescue from famine, with return required when the need passes.
Codifies the laws of compelling a spouse to move to or from Eretz Yisrael and the restrictions on leaving, serving as the principal pre-Shulchan Arukh halakhic framework.

Explains that Isaac was not to leave the Land because he was considered an offering, making the passage a classic source for the exceptional restriction on departure.
Rashi explains that during the time of the Temple, one who leaves Eretz Yisrael for the Diaspora is considered as though he worships idolatry, as reflected in Yonatan’s translation.
Rashi explains that “ascending” means traveling from outside Eretz Yisrael or from other borders to Jerusalem, while “departing” means traveling from Jerusalem to the surrounding regions or from Eretz Yisrael outside it.

Moses of Coucy explains that Eretz Yisrael is defined by conquest undertaken by a king, judge, or prophet with the consent of most of Israel, while individual or tribal conquest does not establish its full halachic status; lands conquered by David outside Canaan are classified as Suria, possessing an intermediate status because they were conquered before all of Canaan.

Her forfeiture of the dower applies only as long ashe remains in Eretz Yisrael. However, if he returns to settle in the Diaspora after a a few years, he must pay the dower to her or her inheritors (ibid.). If she proposes ascending [to Eretz Yisrael] and he does not want to, he must divorce her and give her dower. The same applies for anyplace in Eretz Yisrael to Jerusalem. Anyone may initiate ascent to Eretz Yisrael, and no one may compel departure; anyone may initiate ascent to Jerusalem, and no one may compel departure. There is one who says, that which we compel to go up to the land of Israel, that's when it's possible without danger. Therefore, from the end of the West until Noe Amon we don't compel to go up, and from Noe Amon and upwards, we compel to go up by the way of the dry land, and also the way of the sea during the "days of sun" (summer), if there are no robbers.
Hida explains that the phrase “Ephrathites from Bethlehem in Judah” indicates that even Elimelech’s adult sons, who could have protested but did not, were held accountable for their father’s departure from Eretz Yisrael.

Rabbi Chaim Chizkiyahu Medini infers from several authorities that leaving Eretz Yisrael for other lands is permitted by Torah law, except for Egypt, while noting a dispute over whether dwelling in Eretz Yisrael nowadays is mandated by Torah law or rabbinic law.

Azikri states that dwelling in Eretz Yisrael is a Torah mitzvah equal to all the mitzvot, and that leaving it to live abroad is likened to idolatry; the passage also attributes the punishment of Elimelech, Machlon, and Kilyon to leaving Eretz Yisrael without seeking mercy for their generation.

According to Rashi's reading, a strip of non-Jewish land that separated Judah and Galilee was never consecrated as part of the Land of Israel, since the returning exiles from Babylon did not conquer it and the second consecration only applied to territory already consecrated in the first consecration.
Tanya states that travel for a mitzvah is permitted even on Friday, though one should initially arrange for the non-Jewish ship operator to stop on Shabbat; some prohibit departure until after Shabbat if this cannot be arranged, unless delaying would jeopardize the mitzvah, in which case leniency is allowed.
Rav Eliezer Melamed (Peninei Halakhah, The Nation and the Land 3:9)
Peninei Halakhah, The Nation and the Land 3:9
The passage states that one may not permanently leave Eretz Yisrael, except temporarily for Torah study, marriage, or commerce with the intention of returning, while severe famine permits leaving for an extended period.
The passage states that leaving Eretz Yisrael without intending to return is prohibited, while leaving with the intention of returning is permitted for any purpose, including commerce, an educational trip, or a family vacation unavailable within Eretz Yisrael.
Rav Yitzchak Yosef states that institution emissaries temporarily residing abroad with their families for a year or more, intending to return to Eretz Yisrael, must observe the second day of festivals entirely like residents of the Diaspora, including prayer, Torah reading, refraining from tefillin, and conducting a second-night Pesach seder, and may not eat chametz on the eighth day of Pesach.
Rav Yitzchak Yosef rules that an Israeli resident traveling abroad temporarily for business or an institutional mission, even for one or two months, follows the practice of Eretz Yisrael regarding prayer on the second day of Yom Tov, puts on tefillin and recites Shema privately, but must be stringent regarding performing work, even in private.
Rav Yitzchak Yosef rules that an Eretz Yisrael resident who travels abroad intending to return may be cooked and baked for by a Diaspora resident on the second day of Yom Tov, even though that day is treated as a weekday for him and he must discreetly put on tefillin.
Rav Yitzchak Yosef states that an Eretz Yisrael resident traveling abroad with the intention of returning should not receive an aliyah as Chatan Torah on Simchat Torah in the Diaspora, since that day is his own Isru Chag and a weekday, and he must discreetly put on tefillin at home.
Rav Yitzchak Yosef states that a resident of outside Eretz Yisrael who visits Eretz Yisrael intending to return may not travel by public or private vehicle on the second day of Yom Tov, even for a mitzvah such as praying at the Western Wall or with fellow visitors from outside Eretz Yisrael, including when the driver is an Eretz Yisrael resident for whom it is an ordinary weekday.
Gray Matter III, Israel, Must Diaspora Jews Make Aliyah?

Gray Matter III, Israel, Must Diaspora Jews Make Aliyah?
The passage cites the Rambam’s prohibition against leaving Israel and Rav Feinstein’s inference that there is no absolute obligation to move there, while emphasizing concern about properly observing mitzvot hateluyot ba’aretz.
The Rambam (Hilchot Melachim 5:9) writes that it is prohibited to leave Israel but does not state that one is prohibited to reside outside Israel. If an absolute obligation to move to Israel exists, writes Rav Feinstein, the Rambam would have recorded a prohibition to live outside of Israel. Rav Feinstein concludes that since there is no absolute obligation to move to Israel, one must "certainly" consider Rabbeinu Chaim Cohen's concern that one might not fulfill the mitzvot hateluyot ba’aretz properly.
The passage states that someone who comes to Eretz Yisrael for an academic year is considered a resident of Eretz Yisrael during that stay, even with plans to return to the Diaspora and a mid-year visit to parents there, because the extended stay establishes residency and there is a Torah commandment to live in Eretz Yisrael.
Therefore, one who comes to Eretz Yisrael for an entire academic year is considered a resident of Eretz Yisrael, even if he has definite plans to return to the Diaspora, his parents live there, and he goes to visit them mid-year. His extended stay in Eretz Yisrael renders him a resident of Eretz Yisrael for the duration of his stay. Additionally, there is always the chance that he will decide to make aliya, given that there is a Torah commandment to live in Eretz Yisrael.
The passage states that leaving Eretz Yisrael is permitted only for Torah study or marriage, and that Torah study must be pursued properly; one who undertakes such conduct should therefore come to study there.

The passage states that the cited teachings apply only to leaving Eretz Yisrael for the Diaspora, not to traveling from Jerusalem to another place in Eretz Yisrael, because leaving Eretz Yisrael for the Diaspora may involve a Torah-level prohibition.

The passage discusses the prohibition against leaving Eretz Yisrael and even Babylonia, attributing it variously to Eretz Yisrael’s sanctity, the sanctity of Torah, or withdrawing from mitzvot, and considers the restriction’s severity and exceptions such as severe food inflation; it also cites views that one may leave Babylonia for Eretz Yisrael and that the rule of “all may ascend” applies even כיום.

Rav Yitzchak Yosef rules that an Eretz Yisrael resident traveling abroad intending to return should generally not be called to the Torah on the second day of Yom Tov, except on Monday or Thursday when he may receive an additional aliyah; if he is a kohen, he may recite Birkat Kohanim during Mussaf on the final day of Yom Tov abroad with a blessing.
The passage states that a convert whose parents live abroad is commanded to move to Eretz Yisrael like any other Jew, but may appropriately travel to visit them in special circumstances, such as illness or a special celebration, if financially able.

Rabbi Mordechai Eliyahu cites the view that traveling to Eretz Yisrael is a mitzvah even without intending to settle there, and notes the Rambam’s ruling that one may leave Eretz Yisrael only under specified conditions.
